for Transport, a designation <strong>of</strong> a public authority under this paragraph shall<br />

not be made until all <strong>of</strong> the Ministers aforesaid have been consulted by the<br />

appropriate Minister who intends to make the designation.<br />

(3) Where a public authority was designated under the 2000 Regulations, the<br />

designation shall continue in force as if it was made under these Regulations.<br />

(4) In this Regulation—<br />

"appropriate Minister" means—<br />

(a) in relation to the exercise by a Minister <strong>of</strong> the Government <strong>of</strong> any powers,<br />

functions or duties vested in him or her by virtue <strong>of</strong> any enactment in respect<br />

<strong>of</strong> a public authority, that Minister, and<br />

(b) in relation to the administration and business <strong>of</strong> the public service by<br />

virtue <strong>of</strong> any enactment by a Department <strong>of</strong> State in respect <strong>of</strong> a public<br />

authority, the Minister <strong>of</strong> the Government having charge <strong>of</strong> that Department;<br />

"public authority" means any person or body exercising powers or performing duties<br />

for the benefit <strong>of</strong> the public by virtue <strong>of</strong> any enactment or otherwise under law and<br />

includes—<br />

(a) the Garda Síochána.<br />

(b) a local authority,<br />

(c) the health service executive,<br />

(d) a harbour authority within the meaning <strong>of</strong> the Harbours Act 1946 (No. 9 <strong>of</strong><br />

1946),<br />
