(b) take account in the manner outlined in sub-paragraph (3)(a) <strong>of</strong> information<br />

provided to him or her by each establishment in the group, and<br />

(c) co-operate with those establishments to enable them to carry out any<br />

obligations they have under Regulations 15(1), 17(3), 18(1) and 18(7).<br />

<strong>Major</strong> accident prevention policy.<br />

10 (1) It shall be the duty <strong>of</strong> every operator to prepare, or cause to be prepared, a<br />

statement in writing which shall set out the manner in which major accidents are to be<br />

prevented, which statement shall be known and is hereinafter referred to as a “major<br />

accident prevention policy document”.<br />

(2) Operators <strong>of</strong> existing establishments shall, where necessary, amend<br />

existing major accident prevention policy documents drawn up pursuant to Regulation<br />

10 <strong>of</strong> the 2000 Regulations to comply with these Regulations within 3 months <strong>of</strong> the<br />

commencement <strong>of</strong> these Regulations.<br />

(3)(a) Subject to subparagraph (b), operators <strong>of</strong> new establishments shall<br />

prepare a major accident prevention policy document without delay and in any<br />

event within 3 months <strong>of</strong> the date on which these Regulations first apply to the<br />

establishment concerned.<br />

(b) Operators <strong>of</strong> new establishments under construction shall prepare a major<br />

accident prevention policy document prior to commencement <strong>of</strong> operation.<br />

(4) The major accident prevention policy shall –<br />

(a) be designed to guarantee a high level <strong>of</strong> protection for people and the<br />

environment by appropriate means, structures and management systems, and<br />

(b) take account <strong>of</strong> the principles specified in Annex III to the Directive<br />

(which is set out in Schedule 2).<br />
