and expenses incurred in the taking <strong>of</strong> samples, the carrying out <strong>of</strong> tests, examinations<br />

and analyses and in respect <strong>of</strong> the remuneration and other expenses <strong>of</strong> employees or<br />

persons engaged by the Authority.<br />

Charges for services.<br />

46. (1) A Competent Authority may charge and shall be entitled to be paid for the<br />

provision by that Competent Authority <strong>of</strong> a service or the performance <strong>of</strong> a duty<br />

imposed on any such Authority pursuant to these Regulations, including—<br />

(a) the examination <strong>of</strong> notifications or safety reports and any revisions <strong>of</strong><br />

same,<br />

(b) the preparation and revision <strong>of</strong> external emergency plans,<br />

(c) the testing and putting into effect <strong>of</strong> emergency plans, and<br />

(d) the provision <strong>of</strong> information pursuant to Regulation 34(1).<br />

(2) A charge made by a Competent Authority to which paragraph (1) refers<br />

shall be made only in accordance with such scale <strong>of</strong> charges as may be specified by<br />

the appropriate Minister as respects that Competent Authority, which scale <strong>of</strong> charges<br />

may include particulars <strong>of</strong> the person by whom the fee is payable.<br />

(3) A Competent Authority may recover, as a simple contract debt in any court<br />

<strong>of</strong> competent jurisdiction, from the person by whom it is payable, any amount due and<br />

owing to it under this Regulation.<br />

(4) An operator who makes available to a member <strong>of</strong> the public, other than a<br />

person referred to in Regulation 18(1)(a), the information referred to in Regulation<br />

18(1)(a) or a safety report referred to in Regulation 12 or 13 shall be entitled to charge<br />

such person a sum <strong>of</strong> money in respect <strong>of</strong> the making available <strong>of</strong> such information or<br />
