<strong>Procurement</strong> Regulations<br />

1.5.38 “INCLUDES” shall mean, unless the context otherwise<br />

clearly requires, “includes but is not limited to”.<br />

1.5.39 “INVITATIONS FOR BIDS” shall mean all documents,<br />

whether attached or incorporated by reference, utilized<br />

for soliciting bids in accordance with the procedures<br />

set forth in these regulations and KRS 45A.365 (Competitive<br />

Sealed Bidding), as implemented by these regulations.<br />

1.5.40 “LOCAL PUBLIC AGENCY” shall mean a city,<br />

county, urban-county, consolidated local government,<br />

school district, special district or any other agency formed<br />

by a combination of such agencies under KRS Chapter 79,<br />

or any department, board, commission, authority, officer<br />

or other subunit of a political subdivision which shall include<br />

the offices of the county clerk, county sheriff, county<br />

attorney, coroner and jailer. The Board is a local public<br />

agency.<br />

1.5.41 “MAIL” shall mean, unless otherwise specified<br />

herein, any method of transmission of documents to another<br />

party, including without limitation the U.S. Postal<br />

Service, or similar delivery service, or electronic mail.<br />

1.5.42 “MAY” shall mean permissive. However, the words<br />

“no person may . . .” shall mean that no person is required,<br />

authorized or permitted to do the act prescribed.<br />

1.5.43 “NEGOTIATION” shall mean contracting by either<br />

the method set forth in KRS 45A.370 (Competitive<br />

Negotiation), 45A.375 (Negotiations After Competitive<br />

Sealed Bidding When All Bids Exceed Available Funds)<br />

or 45A.380 (Noncompetitive Negotiation), as implemented<br />

by these regulations.<br />

1.5.44 “NONCOMPETITIVE NEGOTIATION” shall<br />

mean informal negotiation with one or more vendor, contractor<br />

or individual as permitted by these regulations and<br />

KRS 45A.380, as implemented by these regulations.<br />

1.5.45 “OBJECTIVE MEASURABLE CRITERIA”<br />

shall mean sufficient information in the invitation for bids<br />

as to weight and method of evaluation so that the evaluation<br />

may be determined with reasonable mathematical<br />

certainty. Criteria which are otherwise subjective, such as<br />

taste and appearance, may be established when appropriate.<br />

1.5.46 “OFFICIAL RESPONSIBILITY” shall mean<br />

direct administrative or operating authority, whether intermediate<br />

or final, either exercisable alone or with others,<br />

either personally or through subordinates, to approve, disapprove,<br />

or otherwise direct action by or on behalf of the<br />

Board.<br />

1.5.47 “PERSON” shall mean any business, individual,<br />

union, committee, club or other organization or group of<br />

individuals.<br />

1.5.48 “PRICE ANALYSIS” shall mean the evaluation of<br />

price data without analysis of the separate cost components<br />

and profits which may assist in arriving at prices to be paid<br />

and costs to be reimbursed.<br />

1.5.49 “PRICE DATA” shall mean factual information<br />

concerning prices for supplies, services or construction,<br />

substantially identical to those being procured. Prices for<br />

purposes of this definition may include offered or proposed<br />

selling prices, historical selling prices and current selling<br />

prices.<br />

1.5.50 “PROCUREMENT” shall mean the purchasing,<br />

buying, renting, leasing or otherwise obtaining any supplies,<br />

services or construction. It also includes all functions<br />

that pertain to the obtaining of any Board procurement,<br />

including description of requirements, selection and solicitation<br />

of sources, preparation and award of contract, and<br />

all phases of contract administration.<br />

1.5.51 “PROCUREMENT ACTIVITY” shall mean any<br />

activity which is undertaken for or in connection with procurement.<br />

1.5.52 “PROCUREMENT AUTHORITY” shall mean<br />

decision-making authority over the procurement activity<br />

of the Board in any particular proceeding, application,<br />

request for ruling or determination, claim, controversy or<br />

other matter.<br />

1.5.53 “PUBLIC PURCHASING UNIT” shall mean<br />

either (a) any county, city, urban-county, consolidated<br />

government, governmental entity and other subdivision of<br />

the Commonwealth of Kentucky or public agency thereof,<br />

public authority, public educational, health, or other institution,<br />

any other entity which expends public funds for the<br />

acquisition or leasing of supplies, services and construction,<br />

and any nonprofit corporation operating a charitable<br />

hospital, or (b) any purchasing unit of any governmental<br />

body.<br />

1.5.54 “PURCHASE REQUEST” shall mean that document<br />

whereby the Board requests that a contract be obtained<br />

for a specified need, and may include, but is not<br />

limited to, the technical description of the requested item,<br />

delivery schedule, transportation, criteria for evaluation of<br />

solicitees, suggested sources of supply, and information<br />

supplied for the making of any written determination and<br />

finding required by these regulations.<br />

1.5.55 “REQUEST FOR PROPOSALS” shall mean all<br />

documents, whether attached or incorporated by reference,<br />

utilized for soliciting proposals in accordance with the procedures<br />

set forth in these regulations and the provisions of<br />

KRS Chapter 45A applicable to the Board.<br />
