(d) treat the date of receipt of documents received by IPOS as the day on which the<br />

documents are received by IPOS as long as the time of receipt is before the midnight<br />

of the day.<br />

It is to be noted that applicants must still comply with the requirement to provide an address<br />

for service under rule 9. The electronic address of these persons, if they are using the<br />

eCommunications Portal to send documents to and receive documents from the Registrar,<br />

is not intended to be part of their address for service. However, service of documents by<br />

electronic communication through the eCommunications Portal is intended to be valid<br />

service notwithstanding that there is an address for service filed in accordance with rule 9.<br />

The Trade Marks (International Registration) Rules have also been amended to permit the<br />

use of one Form for multiple classes of goods or services for Forms for use in opposition,<br />

namely Form TM 11 and Form TM 12.<br />

Application for Renewal of Registration (Form TM 19) (Circular No. 18/2008, dated 12<br />

December 2008)<br />

With effect from 1 st January 2009, the Registrar will not be issuing renewal certificates<br />

confirming that a mark has been renewed. This is applicable to all applications for renewal<br />

of registration (Form TM 19) lodged on or after 1 st January 2009.<br />

For applications for renewal made online, the renewal will be processed instantaneously<br />

and an acknowledgement of the renewal showing the extended expiry date will be<br />

displayed for printing. These acknowledgements of renewal will remain available for printing<br />

for a period of one month from the renewal application date. In very limited circumstances,<br />

such as where there are pending applications affecting the validity of the trade mark, instant<br />

renewal will not be possible and the applicant will be notified that the acknowledgement of<br />

renewal will be posted in due course.<br />

Where the application for renewal is posted or submitted over the counter, the applicant will<br />

not be receiving any acknowledgement from the Registry. The onus will be on the applicant<br />

to check the expiry date of the mark at www.etrademarks.gov.sg within 2 weeks of<br />

lodgement of the application for renewal of registration (From TM 19) to confirm that the<br />

expiry date has been extended by the Registry. If the expiry date has not been extended,<br />

applicants are advised to contact our Renewal Officer at 63302 707 immediately for<br />

assistance.<br />

This change in practice does not apply to Late Application for Renewal of Registration<br />

(Form TM 24) and Application for Restoration and Renewal of Registration Removed from<br />

the Register (Form TM 21).<br />

To reflect the change in practice in Form TM 19, an information note has been incorporated<br />

into the form. This revised form should be used from 1 st January 2009.<br />

A copy of the revised Form TM 19 will be available for downloading by end of December<br />

2008 at www.ipos.gov.sg.
