GENERAL STATEMENTS OF PRINCIPLE<br />

These Guidelines have <str<strong>on</strong>g>be</str<strong>on</strong>g>en adopted by resoluti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Ku-ring-gai<br />

Council as part <str<strong>on</strong>g>of</str<strong>on</strong>g> Council’s policy making functi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> assist in the good<br />

governance <str<strong>on</strong>g>of</str<strong>on</strong>g> the Council and <str<strong>on</strong>g>to</str<strong>on</strong>g> further compliance by Council with the<br />

Council’s charter as c<strong>on</strong>tained in secti<strong>on</strong> 8 <str<strong>on</strong>g>of</str<strong>on</strong>g> the Local Government Act<br />

1993 (the Act).<br />

All Councillors and employees <str<strong>on</strong>g>of</str<strong>on</strong>g> the Council are <str<strong>on</strong>g>to</str<strong>on</strong>g> cooper<strong>at</strong>e fully with<br />

the Internal Ombudsman in any investig<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> carried out pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

these Guidelines. In particular all Councillors and employees must comply<br />

with any lawful directi<strong>on</strong> given by the Internal Ombudsman in c<strong>on</strong>necti<strong>on</strong><br />

with any investig<strong>at</strong>i<strong>on</strong> undertaken or any recommend<strong>at</strong>i<strong>on</strong> made by the<br />

Internal Ombudsman pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> these Guidelines.<br />

Any power <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> exercised and any functi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> performed by the<br />

Internal Ombudsman pursuant <str<strong>on</strong>g>to</str<strong>on</strong>g> these Guidelines shall <str<strong>on</strong>g>be</str<strong>on</strong>g> exercised and<br />

performed subject <str<strong>on</strong>g>to</str<strong>on</strong>g> the rules <str<strong>on</strong>g>of</str<strong>on</strong>g> procedural fairness.<br />

These Guidelines, despite anything <str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>trary c<strong>on</strong>tained herein, do not<br />

affect any right in law <str<strong>on</strong>g>of</str<strong>on</strong>g> any pers<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> seek redress from any court or<br />

tribunal <str<strong>on</strong>g>of</str<strong>on</strong>g> competent jurisdicti<strong>on</strong> in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> any investig<strong>at</strong>i<strong>on</strong><br />

undertaken or recommend<strong>at</strong>i<strong>on</strong> made by the Internal Ombudsman.<br />

In the event <str<strong>on</strong>g>of</str<strong>on</strong>g> any inc<strong>on</strong>sistency <str<strong>on</strong>g>be</str<strong>on</strong>g>tween any functi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> exercised or<br />

oblig<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> performed under these Guidelines, and any functi<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g><br />

exercised and any oblig<strong>at</strong>i<strong>on</strong> <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> performed under the Council’s Code <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

C<strong>on</strong>duct, the provisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Code <str<strong>on</strong>g>of</str<strong>on</strong>g> C<strong>on</strong>duct shall prevail <str<strong>on</strong>g>to</str<strong>on</strong>g> the extent<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> any such inc<strong>on</strong>sistency.<br />
