el<strong>at</strong>ing <str<strong>on</strong>g>to</str<strong>on</strong>g> a m<strong>at</strong>ter <str<strong>on</strong>g>of</str<strong>on</strong>g> administr<strong>at</strong>i<strong>on</strong> or c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g> Council staff, whereby<br />

a pers<strong>on</strong> is, or <strong>may</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> aggrieved.<br />

Those <str<strong>on</strong>g>council</str<strong>on</strong>g> staff investig<strong>at</strong>ed shall <str<strong>on</strong>g>be</str<strong>on</strong>g> bound by the Internal<br />

Ombudsman’s recommend<strong>at</strong>i<strong>on</strong>s, <strong>on</strong>ce the General Manager has<br />

addressed them. Where the Internal Ombudsman has carried out an<br />

investig<strong>at</strong>i<strong>on</strong> <strong>on</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g>half <str<strong>on</strong>g>of</str<strong>on</strong>g> the C<strong>on</strong>duct Review Committee in<str<strong>on</strong>g>to</str<strong>on</strong>g> the c<strong>on</strong>duct<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a Councillor or the General Manager, any findings made by the Internal<br />

Ombudsman shall <str<strong>on</strong>g>be</str<strong>on</strong>g> referred directly <str<strong>on</strong>g>to</str<strong>on</strong>g> the C<strong>on</strong>duct Review Committee.<br />

While it <strong>may</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> usual practice th<strong>at</strong> a complainant should <strong>at</strong> first exhaust<br />

the internal complaint procedures in place within Ku-ring-gai Council, the<br />

Internal Ombudsman shall have the right <str<strong>on</strong>g>to</str<strong>on</strong>g> waive this requirement <strong>on</strong> a<br />

case by case basis. The Internal Ombudsman shall have the right <str<strong>on</strong>g>to</str<strong>on</strong>g><br />

investig<strong>at</strong>e any complaint or initi<strong>at</strong>e any investig<strong>at</strong>i<strong>on</strong> without the need for<br />

any prior c<strong>on</strong>sent <str<strong>on</strong>g>of</str<strong>on</strong>g> any pers<strong>on</strong> or body against whom the complaint is<br />

made.<br />

4.2 Limit <strong>on</strong> jurisdicti<strong>on</strong><br />

Nothing in this part authorises the Internal Ombudsman <str<strong>on</strong>g>to</str<strong>on</strong>g> investig<strong>at</strong>e a<br />

decisi<strong>on</strong> or recommend<strong>at</strong>i<strong>on</strong>, an act d<strong>on</strong>e or omitted, or a procedure used<br />

by Council, a committee <str<strong>on</strong>g>of</str<strong>on</strong>g> Council or a community committee, or a m<strong>at</strong>ter<br />

where an adequ<strong>at</strong>e remedy or right <str<strong>on</strong>g>of</str<strong>on</strong>g> appeal exists, whether or not the<br />

complainant uses it. Notwithstanding, m<strong>at</strong>ters <str<strong>on</strong>g>of</str<strong>on</strong>g> maladministr<strong>at</strong>i<strong>on</strong> or<br />

misc<strong>on</strong>duct th<strong>at</strong> have not, or are not likely <str<strong>on</strong>g>to</str<strong>on</strong>g> <str<strong>on</strong>g>be</str<strong>on</strong>g> addressed through the<br />

remedy or right <str<strong>on</strong>g>of</str<strong>on</strong>g> appeal <strong>may</strong> <str<strong>on</strong>g>be</str<strong>on</strong>g> investig<strong>at</strong>ed by the Internal Ombudsman.<br />

4.3 Questi<strong>on</strong>s as <str<strong>on</strong>g>to</str<strong>on</strong>g> jurisdicti<strong>on</strong><br />

Where a questi<strong>on</strong> arises as <str<strong>on</strong>g>to</str<strong>on</strong>g> the jurisdicti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Internal Ombudsman<br />

<str<strong>on</strong>g>to</str<strong>on</strong>g> investig<strong>at</strong>e a m<strong>at</strong>ter, the Internal Ombudsman <strong>may</strong> discuss the m<strong>at</strong>ter<br />

with the General Manager and/or any expert as required, <str<strong>on</strong>g>to</str<strong>on</strong>g> determine the<br />

questi<strong>on</strong>.<br />
