Subsection (a)(1) was recognized in Rathbun v. Hill, 187 Kan. 130, Syl. 3, 354 P.2d 338<br />

Subsection (c) modifies <strong>Kansas</strong> law which allows the court to fill a vacancy. See K.S.A. 58-<br />
2410 (court shall appoint successor upon death of sole or suviving <strong>trust</strong>ee); K.S.A. 58-2412 (court<br />
may fill all vacancies in express <strong>trust</strong>s).<br />

This section lists the ways in which a <strong>trust</strong>eeship becomes vacant and the rules on filling the<br />
vacancy. See also Sections 701 (accepting or declining <strong>trust</strong>eeship), 705 (resignation), and 706<br />
(removal). Good drafting practice suggests that the terms of the <strong>trust</strong> deal expressly with the<br />
problem of vacancies, naming successors and specifying the procedure for filling vacancies. This<br />
section applies only if the terms of the <strong>trust</strong> fail to specify a procedure.<br />
The disqualification of a <strong>trust</strong>ee referred to in subsection (a)(4) would include a financial<br />
institution whose right to engage in <strong>trust</strong> business has been revoked or removed. Such<br />
disqualification might also occur if the <strong>trust</strong>’s principal place of administration is transferred to a<br />
jurisdiction in which the <strong>trust</strong>ee, whether an individual or institution, is not qualified to act.<br />
