policy of not plant<strong>in</strong>g eucalyptus <strong>in</strong> forests.<br />
to l<strong>and</strong>. Meanwhile, Chaiyo <strong>and</strong> other <strong>in</strong>vestors are try<strong>in</strong>g to<br />
move forward <strong>in</strong> this legal quicks<strong>and</strong>.<br />
Perhaps the biggest losers are the poorest farmers. “The<br />
company can only make contracts with farmers who own<br />
l<strong>and</strong>, who have papers. They are usually not the poorest<br />
people, the poor don’t have any papers. If the government<br />
can license state l<strong>and</strong> to the poorest people to guarantee<br />
their right to use, when we will be confident to make a<br />
contract,” says Chalermsak.<br />
Such issues need to be clarified because some <strong>in</strong>vestors,<br />
probably those with higher environmental <strong>and</strong> social<br />
st<strong>and</strong>ards, are unlikely to feel comfortable with anyth<strong>in</strong>g less<br />
than an unequivocal guarantee from the government.<br />
The situation is complex however because the government<br />
is reform<strong>in</strong>g l<strong>and</strong> management <strong>and</strong> appears to be shift<strong>in</strong>g<br />
away from concessions towards contract farm<strong>in</strong>g. That may<br />
entail revenue issues because concessions can provide<br />
<strong>in</strong>come through adm<strong>in</strong>istrative charges <strong>and</strong> taxes on large<br />
companies. Devis<strong>in</strong>g a realistic <strong>and</strong> efficient way to tax<br />
contract farmers could take some time <strong>and</strong> be unpopular.<br />
In the meantime Chalermsak sees a way forward <strong>in</strong> the<br />
government’s preferred model for farmers. “I am propos<strong>in</strong>g a<br />
project to the government us<strong>in</strong>g its 2+3 model as a solution<br />
to this problem. But we need laws <strong>and</strong> regulations to apply<br />
this model. We want to <strong>in</strong>vest securely <strong>and</strong> <strong>in</strong> a way that<br />
does not damage our company’s image,” he says.<br />
Nevertheless despite these issues Chaiyo still prefers<br />
contract farm<strong>in</strong>g to a concession. “Now we have only 100<br />
hectares concession pilot project. The concession has<br />
problems, people may encroach, people liv<strong>in</strong>g nearby don’t<br />
like the company. Who will take care of our trees if there is<br />
no relationship with local people? If by contract farm<strong>in</strong>g we<br />
can build a relationship with people, I don’t have to worry<br />
about the trees because the farmers will take care of them,”<br />
says Chalermsak.<br />
Grow<strong>in</strong>g money on trees<br />
Farmers began plant<strong>in</strong>g Chaiyo’s K7 <strong>and</strong> K51 varieties of<br />
eucalyptus sapl<strong>in</strong>gs under contract <strong>in</strong> 2006. Ideally each<br />
farmer should be able to plant about 8,000 seedl<strong>in</strong>gs,<br />
enough to cover three hectares. Farmers will log the trees<br />
every four years dur<strong>in</strong>g a period of 12-15 years, after which<br />
the stump is killed <strong>and</strong> new seedl<strong>in</strong>gs planted. In exchange<br />
