2. A partial DAPD packet must be initiated if the refugee is under<br />
65 years old and there is an SSI/SSP disability decision<br />
(medical re-exam date) at the time <strong>of</strong> the CAPI application. That<br />
is, the medical re-exam date is current or overdue.<br />
3. A full DAPD packet must be initiated if the refugee is under 65<br />
old and SSI/SSP <strong>benefit</strong>s were discontinued because the<br />
person was no longer disabled.<br />
NOTE:<br />
7-Year Refugee applicants whose application process<br />
requires a partial or full DAPD packet but meet all<br />
other CAPI eligibility criteria may receive CAPI<br />
<strong>benefit</strong>s pending a DAPD disability determination.<br />
Benefits received during this period are not<br />
considered an overpayment even if DAPD finds the<br />
person not disabled.<br />
How are partial DAPD packet for 7-year refugee applicants<br />
processed?<br />
Upon receipt <strong>of</strong> a CAPI application from the refugee the EW must<br />
follow these procedures:<br />
• Obtain verification <strong>of</strong> SSI/SSP payment discontinuance due to<br />
expiration <strong>of</strong> seven-year SSI/SSP eligibility.<br />
• Identify the person's disability SSA re-exam date in one <strong>of</strong> two<br />
ways:<br />
1. Obtain an SSA printout, from the applicant, showing the<br />
medical re-exam date.<br />
or<br />
2. Contact the SSA via telephone.<br />
If the medical re-exam date cannot be obtained from the<br />
applicant or SSA <strong>of</strong>fice, then proceed to prepare a partial DAPD<br />
packet as indicated below.<br />
• Prepare and send a partial (limited) DAPD packet. The packet<br />
consists <strong>of</strong> just the MC 221 with the following remark in item #10<br />
“7-Year Refugee CAPI case – SSI was discontinued as <strong>of</strong><br />
(date). Please check for SSI disability. “<br />
Follow up with DAPD if there is no response to the disability<br />
determination request within 30 days.<br />
NOTE: If DAPD does not find the person disabled, discontinue aid<br />
and clearly document immigrant's status and reason for<br />
termination. CAPI issued on these cases is not considered<br />
an overpayment.
