What is the eligibility criteria for Pre-August 22, 1996<br />

immigrants?<br />

To be potentially eligible to CAPI, individuals whose date <strong>of</strong> entry<br />

into the United States was prior to 8/22/96 must meet one <strong>of</strong> the<br />

criteria below:<br />

• Qualified aliens, age 65 or older (aged), who were lawfully<br />

residing in the United States on 8/21/96; or,<br />

NOTE: Certain Qualified Aliens are not eligible to CAPI<br />

during the first seven years following the date they<br />

are granted their Qualified Alien status by the United<br />

States Citizenship and Immigration Services<br />

(USCIS), formerly known as INS, due to eligibility to<br />

SSI.<br />

• Qualified Alien victims <strong>of</strong> abuse/battery with proper USCIS<br />

status granted under the Violence Against Women Act<br />

(VAWA) (See section below for more information); or<br />

• Disabled, blind or aged persons (not meeting the definition <strong>of</strong><br />

qualified aliens) who are permanently residing in the United<br />

States under color <strong>of</strong> law (PRUCOL). Pro<strong>of</strong> <strong>of</strong> PRUCOL<br />

status is required.<br />

What is the eligibility criteria for Post August 21, 1996<br />

immigrants?<br />

To be potentially eligible to CAPI, individuals whose date <strong>of</strong> entry<br />

into the United States was after 8/21/96 must be:<br />

• Disabled, blind or aged qualified aliens who legally entered<br />

the United States after 8/21/96 and who have a sponsor who<br />

is deceased, disabled, or abusive (including sponsor’s<br />

spouse).<br />

• Disabled, blind or aged qualified aliens or PRUCOLS who<br />

have a sponsor or whose sponsor is not deceased, disabled,<br />

or abusive.
