Appointment of Qualified Counsel 103 Form CJA 30 is used for the appointment of counsel to represent eligible persons in death penalty proceedings. At the outset of a federal capital case, two attorneys must be appointed (as required by 18 U.S.C. 3005); more than two may be appointed if necessary for adequate representation. For capital habeas corpus proceedings, at least one attorney must be appointed. Judicial Conference policy is that, due to the complex, demanding, and protracted nature of capital habeas proceedings, judicial officers should consider appointing at least two attorneys The attorneys appointed in capital cases must possess special experience and qualifications as required by statute.
