Appointment <strong>of</strong> Qualified Counsel<br />

Form <strong>CJA</strong> 30 is used for the appointment <strong>of</strong> counsel to<br />
represent eligible persons in death penalty proceedings.<br />
At the outset <strong>of</strong> a federal capital case, two attorneys must be<br />
appointed (as required by 18 U.S.C. 3005); more than two<br />
may be appointed if necessary for adequate representation.<br />
For capital habeas corpus proceedings, at least one attorney<br />
must be appointed.<br />
Judicial Conference policy is that, due to the complex,<br />
demanding, and protracted nature <strong>of</strong> capital habeas<br />
proceedings, judicial <strong>of</strong>ficers should consider appointing at least<br />
two attorneys<br />
The attorneys appointed in capital cases must possess<br />
special experience and qualifications as required by statute.
