THE FREEDOM OF INFORMATION ACT 2000<br />

CONFIDENTIALITY OF CONSULTATIONS<br />

1. The Department may publish a summary of resp<strong>on</strong>ses following<br />

completi<strong>on</strong> of the c<strong>on</strong>sultati<strong>on</strong> process. Your resp<strong>on</strong>se, and all other<br />

resp<strong>on</strong>ses to the c<strong>on</strong>sultati<strong>on</strong>, may be disclosed <strong>on</strong> request. The<br />

Department can <strong>on</strong>ly refuse to disclose informati<strong>on</strong> in excepti<strong>on</strong>al<br />

circumstances. Before you submit your resp<strong>on</strong>se, please read the<br />

paragraphs below <strong>on</strong> the c<strong>on</strong>fidentiality of c<strong>on</strong>sultati<strong>on</strong>s and they will<br />

give you guidance <strong>on</strong> the legal positi<strong>on</strong> about any informati<strong>on</strong> given<br />

by you in resp<strong>on</strong>se to this c<strong>on</strong>sultati<strong>on</strong>.<br />

2. The Freedom of Informati<strong>on</strong> Act gives the public a right of access to<br />

any informati<strong>on</strong> held by a public authority, namely, the Department in<br />

this case. This right of access to informati<strong>on</strong> includes informati<strong>on</strong><br />

provided in resp<strong>on</strong>se to a c<strong>on</strong>sultati<strong>on</strong>. The Department cannot<br />

automatically c<strong>on</strong>sider as c<strong>on</strong>fidential informati<strong>on</strong> supplied to it in<br />

resp<strong>on</strong>se to a c<strong>on</strong>sultati<strong>on</strong>. However, it does have the resp<strong>on</strong>sibility<br />

to decide whether any informati<strong>on</strong> provided by you in resp<strong>on</strong>se to this<br />

c<strong>on</strong>sultati<strong>on</strong>, including informati<strong>on</strong> about your identity, should be<br />

made public or be treated as c<strong>on</strong>fidential.<br />

3. This means that informati<strong>on</strong> provided by you in resp<strong>on</strong>se to the<br />

c<strong>on</strong>sultati<strong>on</strong> is unlikely to be treated as c<strong>on</strong>fidential, except in very<br />

particular circumstances. The Lord Chancellor’s Code of Practice <strong>on</strong><br />

the Freedom of Informati<strong>on</strong> Act provides that:<br />

• the Department should <strong>on</strong>ly accept informati<strong>on</strong> from third parties in<br />

c<strong>on</strong>fidence if it is necessary to obtain that informati<strong>on</strong> in<br />
