52 Where an annual fee is paid, it is usual practice <strong>for</strong> <strong>the</strong> chair, and <strong>the</strong> deputy chair, where one<br />

is <strong>appo<strong>in</strong>ted</strong>, <strong>to</strong> have responsibility <strong>for</strong> chair<strong>in</strong>g one or more sub-committees. No additional<br />

fee is payable <strong>to</strong> <strong>the</strong> chair and deputy chair <strong>for</strong> chair<strong>in</strong>g sub-committees. Where <strong>the</strong>re are<br />

sub-committees that are not chaired by ei<strong>the</strong>r <strong>the</strong> chair or deputy chair, <strong>the</strong>n an additional<br />

10% of <strong>the</strong> member’s rate may be paid <strong>to</strong> one o<strong>the</strong>r member with responsibility <strong>for</strong> chair<strong>in</strong>g<br />

a sub-committee. This does not apply <strong>to</strong> <strong>the</strong> three District Health Board statu<strong>to</strong>ry advisory<br />

committees because additional fees are paid <strong>to</strong> <strong>members</strong> of those committees (paragraphs 28<br />

and 93 refer). Any case <strong>for</strong> fur<strong>the</strong>r additional payments <strong>for</strong> chair<strong>in</strong>g sub-committees must be<br />

treated as an exception <strong>to</strong> <strong>the</strong> Framework (see section E).<br />

One person committees<br />

53 Where an <strong>in</strong>dividual member constitutes a committee and <strong>the</strong>re are decision-mak<strong>in</strong>g or<br />

recommenda<strong>to</strong>ry powers, that member should receive <strong>the</strong> rate applicable <strong>to</strong> <strong>the</strong> chair of a<br />

body at that level.<br />

Payments <strong>to</strong> public servants/State servants/employees of Crown <strong>bodies</strong> <strong>appo<strong>in</strong>ted</strong> <strong>to</strong> <strong>bodies</strong><br />

54 Public servants are not generally <strong>appo<strong>in</strong>ted</strong> <strong>to</strong> statu<strong>to</strong>ry boards and o<strong>the</strong>r public <strong>bodies</strong>,<br />

although Cab<strong>in</strong>et has recognised that <strong>the</strong>re may be circumstances <strong>in</strong> <strong>which</strong> such<br />

appo<strong>in</strong>tments, properly managed, can be justified. Cab<strong>in</strong>et Office Circular CO (02) 5<br />

provides advice about <strong>the</strong> appo<strong>in</strong>tment of Public Servants <strong>to</strong> statu<strong>to</strong>ry boards.<br />

55 The follow<strong>in</strong>g paragraphs provide advice about <strong>the</strong> payment of fees <strong>to</strong> public servants, state<br />

servants and employees of Crown <strong>bodies</strong> <strong>in</strong> <strong>the</strong> special circumstances where <strong>the</strong>y are<br />

<strong>appo<strong>in</strong>ted</strong> <strong>to</strong> a Crown body. They may be <strong>appo<strong>in</strong>ted</strong> <strong>in</strong> <strong>the</strong>ir own right, <strong>the</strong>y may be<br />

ex officio (someone who has a right because of an office held) or <strong>the</strong>y may be o<strong>the</strong>rwise<br />

<strong>appo<strong>in</strong>ted</strong> as representatives of <strong>the</strong>ir department.<br />

56 An underly<strong>in</strong>g pr<strong>in</strong>ciple is that public and state servants and employees of Crown <strong>bodies</strong> are<br />

able <strong>to</strong> do <strong>the</strong>ir primary job unh<strong>in</strong>dered and without detriment <strong>to</strong> <strong>the</strong> public <strong>in</strong>terest. They<br />

must not be double-paid <strong>for</strong> <strong>the</strong>ir job and <strong>the</strong>ir appo<strong>in</strong>tment <strong>to</strong> a Crown body.<br />

Public servants/State servants as ex officio <strong>members</strong> of <strong>bodies</strong><br />

57 Public Servants may be <strong>appo<strong>in</strong>ted</strong> <strong>to</strong> statu<strong>to</strong>ry <strong>bodies</strong> <strong>in</strong> an ex officio capacity. Cab<strong>in</strong>et has<br />

agreed, however, that as a general policy, public servants will not be <strong>appo<strong>in</strong>ted</strong> as ex officio<br />

<strong>members</strong> of Crown entity boards.<br />

58 Where any such exceptional appo<strong>in</strong>tments are permitted by a body’s enabl<strong>in</strong>g Act, <strong>the</strong><br />

representative cont<strong>in</strong>ues <strong>to</strong> receive his/her ord<strong>in</strong>ary pay (or may represent <strong>the</strong> department or<br />

Crown body on a voluntary basis), and is not paid a daily or annualised fee <strong>for</strong> participat<strong>in</strong>g.<br />

Where <strong>the</strong>re are out of pocket expenses such as airfares or accommodation, <strong>the</strong>se should be<br />

reimbursed on <strong>the</strong> same basis as <strong>for</strong> o<strong>the</strong>r <strong>members</strong> of <strong>the</strong> board. Public and state servants<br />

must not profit f<strong>in</strong>ancially from <strong>the</strong>ir <strong>in</strong>volvement as an ex officio member of a board.<br />
