Operat<strong>in</strong>g outside <strong>the</strong> parameters of <strong>the</strong> <strong>framework</strong>/exceptions <strong>to</strong> <strong>the</strong><br />

<strong>framework</strong><br />

106 Operat<strong>in</strong>g outside <strong>the</strong> parameters of <strong>the</strong> Framework <strong>in</strong>cludes situations where it is proposed<br />

<strong>to</strong>:<br />

• pay fees above <strong>the</strong> levels set <strong>in</strong> <strong>the</strong> fee scales;<br />

• significantly <strong>in</strong>crease exist<strong>in</strong>g fees (even with<strong>in</strong> <strong>the</strong> applicable fee range);<br />

• use alternative methods <strong>for</strong> pay<strong>in</strong>g or sett<strong>in</strong>g fees (<strong>for</strong> example, payment of a base<br />

honorarium plus a fee <strong>for</strong> additional services, Crown <strong>bodies</strong> sett<strong>in</strong>g <strong>the</strong>ir own fees from a<br />

<strong>to</strong>tal pool, a full time fee);<br />

• make additional payments <strong>for</strong> work <strong>in</strong> excess of <strong>the</strong> ord<strong>in</strong>ary demands on body <strong>members</strong>;<br />

• make additional payments <strong>to</strong> chairs of sub-committees (see paragraphs 49 – 52).<br />

107 Department or parent statu<strong>to</strong>ry entity advisers should contact <strong>the</strong> SSC prior <strong>to</strong> prepar<strong>in</strong>g<br />

papers <strong>for</strong> M<strong>in</strong>isters <strong>for</strong> advice on <strong>the</strong> consultation process and <strong>the</strong> necessary <strong>in</strong><strong>for</strong>mation<br />

required <strong>for</strong> a proposed exception.<br />

108 Where M<strong>in</strong>isters, departments or o<strong>the</strong>r fee-sett<strong>in</strong>g authorities believe <strong>the</strong>re is a case <strong>to</strong><br />

operate outside <strong>the</strong> parameters of <strong>the</strong> Framework set out <strong>in</strong> this circular (except where<br />

proposed fees are below <strong>the</strong> Framework fee ranges), <strong>the</strong>y must consult with <strong>the</strong> M<strong>in</strong>ister of<br />

State Services. Proposals <strong>to</strong> pay fees outside <strong>the</strong> parameters of <strong>the</strong> Framework range should<br />

first be discussed with <strong>the</strong> SSC.<br />

109 The details required <strong>to</strong> justify an exception <strong>to</strong> <strong>the</strong> Framework <strong>in</strong>clude <strong>the</strong> classification of <strong>the</strong><br />

body, <strong>the</strong> exist<strong>in</strong>g fee levels (if applicable), <strong>the</strong> fee sett<strong>in</strong>g authority, and <strong>the</strong> reason <strong>for</strong><br />

seek<strong>in</strong>g an exception.<br />

110 A compell<strong>in</strong>g case is required <strong>to</strong> support <strong>the</strong> payment of fees above <strong>the</strong> levels set <strong>in</strong> <strong>the</strong> fee<br />

scales. Justification should <strong>in</strong>clude evidence of an adequate, robust and appropriate selection<br />

process and consideration of potential candidates, any difficulties <strong>in</strong> recruitment or retention,<br />

and/or particular skills and expertise that are required <strong>for</strong> a specific task. Fur<strong>the</strong>r advice is<br />

available from <strong>the</strong> SSC.<br />

111 Where <strong>the</strong> responsible M<strong>in</strong>ister and <strong>the</strong> M<strong>in</strong>ister of State Services agree that a proposed<br />

exception is:<br />

• m<strong>in</strong>or (<strong>in</strong>clud<strong>in</strong>g but not limited <strong>to</strong>):<br />

- where an additional payment is <strong>in</strong>dicated <strong>for</strong> specified additional work;<br />

- or where <strong>the</strong> additional cost <strong>in</strong>volved <strong>in</strong> an exception is small;<br />
