Re: City of Poway General Plan Extension<br />
Dear [name]:<br />
This is to in<strong>for</strong>m you that I have approved the City of Poway's<br />
request <strong>for</strong> an extension of time <strong>for</strong> the revision of its general plan.<br />
This extension of time does not apply to the housing element<br />
because of statutory constraints. <strong>The</strong> extension is granted <strong>for</strong> a oneyear<br />
period beginning on October 23, 1990, and ending on October<br />
22,1991, or upon the adoption of the revised general plan,<br />
whichever is earlier. <strong>The</strong> extension, as provided in Government<br />
Code section 65361, releases the city from the requirement that it<br />
maintain a complete and adequate general plan.<br />
As the basis <strong>for</strong> granting this extension, I reference the finding<br />
made by the Poway City Council in Resolution No. 90-199. I<br />
have determined that the resolution and the additional explanatory<br />
and supporting data submitted with the application<br />
satisfy the requirements of Government Code section 65361<br />
and its relevant subsections.<br />
In accordance with the powers granted me by Government<br />
Code section 65361,1 have determined that the following conditions<br />
are necessary in order to ensure full compliance with<br />
the Planning and Zoning Law during the term of the extension.<br />
1. Discretionary land use projects shall be approved by the city<br />
only when the city makes written finding, based upon substantial<br />
evidence in the record, that: (1) the proposed project will<br />
be consistent with the existing general plan and (2) there is a<br />
reasonable probability that the project will be consistent with<br />
the proposed general plan.<br />
2. <strong>The</strong> city shall neither initiate, accept, process, nor act on<br />
any proposals <strong>for</strong> general plan amendments during the term of<br />
this extension.<br />
3. <strong>The</strong> city shall not enter into any development agreement or<br />
other such agreement or document (such as a vesting tentative<br />
map) which vests and legally precludes unilateral changes in<br />
land use by the city, with the following exceptions:<br />
a. a development agreement <strong>for</strong> the previously approved "Old<br />
Coach Golf Estates" project.<br />
b. disposition and development agreements or similar agreements<br />
entered into by the city redevelopment agency <strong>for</strong> the<br />
purposes of redevelopment.<br />
4. For the purposes of this extension —<br />
"Discretionary land use project" is defined to include: a specific<br />
plan, a city-initiated annexation request, a tentative map (including<br />
parcel map), a zoning ordinance amendment (including rezoning),<br />
a planned community development plan, a conditional<br />
use permit, a variance, a development review, or a public<br />
works/capital improvement project (except as necessary to maintain<br />
existing facilities or protect the public health and safety).<br />
"City" is defined to include the city council as well as any city<br />
official, committee, or board-delegated administrative responsibilities<br />
under city ordinances and policies.<br />
