PRESIDENT'S MESSAGE<br />

By the time this message is pub-<br />

^^ed, I will have attended the Jan-<br />

^^gy <strong>CLSA</strong> Board <str<strong>on</strong>g>of</str<strong>on</strong>g> Directors<br />

^Bfeting for the first time as your<br />

President, representing the members<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the Associati<strong>on</strong>. I am<br />

h<strong>on</strong>ored to have the opportunity to<br />

join together with this Board representing<br />

members throughout the<br />

State <str<strong>on</strong>g>of</str<strong>on</strong>g> CaUfornia for the purpose<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>ducting business <strong>and</strong> estab-<br />

Ushing directi<strong>on</strong> for such a prestigeous<br />

organizati<strong>on</strong>. The Board<br />

members are elected by the individual<br />

Chapters <strong>and</strong> the <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers<br />

which are elected by the membership<br />

at large, to represent <strong>and</strong> put<br />

iorth your interest as a L<strong>and</strong> Surveyor<br />

in the State <str<strong>on</strong>g>of</str<strong>on</strong>g> California. If<br />

your interest, c<strong>on</strong>cerns, <strong>and</strong> positi<strong>on</strong>s<br />

are to show up at the State<br />

level, you, the individual surveyor,<br />

whether presently a member <str<strong>on</strong>g>of</str<strong>on</strong>g> this<br />

Associati<strong>on</strong> or not, must take resp<strong>on</strong>sibiUty<br />

for your pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> by<br />

being in c<strong>on</strong>tact with these representatives<br />

<strong>and</strong> communicating to<br />

the appropriate committees or <str<strong>on</strong>g>of</str<strong>on</strong>g>ficers,<br />

your c<strong>on</strong>cerns <strong>and</strong> sugges-<br />

W<strong>on</strong>s. We need your help <strong>and</strong> input<br />

|do the best job.<br />

I<strong>CLSA</strong> 's track record has been impressive<br />

in the last few years <strong>and</strong><br />

can be additi<strong>on</strong>ally improved by increasing<br />

the membership, so that it<br />

truly represents the majority <str<strong>on</strong>g>of</str<strong>on</strong>g> surveyors<br />

in California. If you are not<br />

cmrently a member, c<strong>on</strong>sider the<br />

possibilities that, by joining, you<br />

can mEike a difference in your pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong><br />

from your own individual attitudes<br />

<strong>and</strong> effectiveness, up<br />

through the State Board <str<strong>on</strong>g>of</str<strong>on</strong>g> Directors'<br />

attitudes <strong>and</strong> effectiveness.<br />

Presently, less than 1/3 <str<strong>on</strong>g>of</str<strong>on</strong>g> our<br />

membership has participated in the<br />

State organizati<strong>on</strong> <strong>on</strong> committees<br />

or as a member <str<strong>on</strong>g>of</str<strong>on</strong>g> the Board <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Directors or as an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer <str<strong>on</strong>g>of</str<strong>on</strong>g> the Associati<strong>on</strong>.<br />

C<strong>on</strong>sider the effectiveness<br />

yet to be realized by your c<strong>on</strong>tributi<strong>on</strong><br />

<strong>on</strong> the State level. If you<br />

have served, then c<strong>on</strong>sider renewing<br />

your dedicati<strong>on</strong> to the Associati<strong>on</strong>.<br />

Your experience is an asset this<br />

organizati<strong>on</strong> needs.<br />

Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>aHsm is a popular topic<br />

Mi<strong>on</strong>g surveyors in these times,<br />

tis being my first opportunity to<br />

dress the membership, it seems<br />

appropriate to state my views <strong>on</strong><br />

the subject.<br />

The criteria for pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>aHsm is<br />

more a statement than a qualificati<strong>on</strong>.<br />

<strong>Surveying</strong> is an art, although it<br />

uses scientific methods for gathering<br />

evidence; analysis <strong>and</strong> c<strong>on</strong>clusi<strong>on</strong>s<br />

are empirical, based <strong>on</strong> a clear<br />

underst<strong>and</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> the law <strong>and</strong> a comprehensive<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the st<strong>and</strong>ards <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>. Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>aHsm is created<br />

by pfu"ticipating in a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>fil<br />

society that establishes a<br />

comm<strong>on</strong> b<strong>on</strong>d. By furthering educati<strong>on</strong><br />

<strong>and</strong> at the sacrifice <str<strong>on</strong>g>of</str<strong>on</strong>g> some individuality,<br />

a comm<strong>on</strong> ground is<br />

created, a b<strong>on</strong>d <str<strong>on</strong>g>of</str<strong>on</strong>g> mutual respect, a<br />

c<strong>on</strong>venti<strong>on</strong>al wisdom, <strong>and</strong> support<br />

that raises the stature <str<strong>on</strong>g>of</str<strong>on</strong>g> the individual<br />

to that <str<strong>on</strong>g>of</str<strong>on</strong>g> a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al. Each<br />

<strong>and</strong> every surveyor has a resp<strong>on</strong>sibility<br />

to themselves for the quality<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> their practice <strong>and</strong> to their peers<br />

for the quahty <str<strong>on</strong>g>of</str<strong>on</strong>g> their pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>.<br />

MESSAGE FROM THE<br />

OUTGOING PRESIDENT:<br />

The year is over. It is a time to<br />

look back <strong>and</strong> reflect. But to look<br />

back <strong>on</strong>ly as a "backsight" to guide<br />

us in going forward.<br />

This has been quite a year. The<br />

<strong>Surveying</strong> Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> has been<br />

recognized with Nati<strong>on</strong>al Surveyors<br />

Week. We have had a successful<br />

c<strong>on</strong>ference at Lake Tahoe. We<br />

started a state wide Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>esi<strong>on</strong>al<br />

Practice Committee <strong>and</strong> have established<br />

a forum where the surveyor in<br />

private practice can be hefird. We<br />

have started a "news letter" to keep<br />

the pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> more informed <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

events that affect us all <strong>and</strong> have<br />

worked with other pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

associati<strong>on</strong>s in refining the L<strong>and</strong><br />

Surveyors Act. Towards that end,<br />

our new legislative advocates,<br />

Winner/Wagner <strong>and</strong> Associates<br />

have added the very pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

<strong>and</strong> very necessary touch needed for<br />

our legislative efforts.<br />

We need to look forward, but with<br />

pride that comes from our heritage.<br />

I have <str<strong>on</strong>g>of</str<strong>on</strong>g>ten teased that surveying<br />

is the oldest "H<strong>on</strong>orable" Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>.<br />

History shows us that in order<br />

to assess <strong>and</strong> tax the rich river bottom<br />

l<strong>and</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Nile in 4000 B.C.,<br />

Egypt, surveyors were already<br />

there. In the Bible, before the <str<strong>on</strong>g>of</str<strong>on</strong>g>fice<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> High Priest was created, surveyors<br />

wre already there, "setting their<br />

neighbors l<strong>and</strong>mark." And as a<br />

word <str<strong>on</strong>g>of</str<strong>on</strong>g> warning,' 'woe be unto them<br />

that moveth their neighbors l<strong>and</strong>mark."<br />

In our own country, our hertitage<br />

includes George Washingt<strong>on</strong>,<br />

Thomas Jeffers<strong>on</strong> <strong>and</strong> Abraham<br />

Lincoln, to a name a few.<br />

In 1891, CaUfornia was the first<br />

state to Ucense surveyors, <strong>and</strong> we<br />

were the first science discipUne to be<br />

licensed.<br />

We have a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong> to be proud<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>. But then how should we act?<br />

With smugness? With c<strong>on</strong>ceit?<br />

With c<strong>on</strong>tempt for others? Of<br />

course not!<br />

But if we are to use our heritage<br />

as a backsight, we need to look at organizati<strong>on</strong><br />

<strong>and</strong> structure. Washingt<strong>on</strong><br />

dem<strong>and</strong>ed absolute obedience<br />

from his troops. He received it<br />

because he earned it <strong>and</strong> his men<br />

respected him. But then he represented<br />

a cause <strong>and</strong> not himself.<br />

Lincoln had a dream <strong>and</strong> a fmth in<br />

democracy. He was a man <str<strong>on</strong>g>of</str<strong>on</strong>g> visi<strong>on</strong><br />

who saw a country "<str<strong>on</strong>g>of</str<strong>on</strong>g> the people,<br />

by the people <strong>and</strong> for the people."<br />

To enforce those principles, he<br />

waged war. For principles too need<br />

discipline <strong>and</strong> organizati<strong>on</strong>, then<br />

can people as government work together<br />

to provide for the comm<strong>on</strong><br />

good.<br />

So surveyors should walk forward<br />

with an inner pride that puts forth<br />

an inner glow. A light that can not<br />

be hidden. If that Ught glows, then<br />

by our own pride we too have discipUne<br />

<strong>and</strong> organizati<strong>on</strong> working<br />

together to provide for the comm<strong>on</strong><br />

good.<br />

The most distressing words I<br />

have ever heard are: "but I am <strong>on</strong>ly<br />

a surveyor." Should this then be an<br />

excuse not to be pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, not to<br />

work together, not to support<br />

elected leadership, <strong>and</strong> if we act this<br />

way, who is to blame?<br />

The <strong>on</strong>e involved because there is<br />

not a majority with the courage to<br />

speak out <strong>and</strong> protect our heritage?<br />

Or is it the fault <str<strong>on</strong>g>of</str<strong>on</strong>g> those who d<strong>on</strong>'t<br />

get involved <strong>and</strong> then complain<br />

about the results? But then, what<br />

kind <str<strong>on</strong>g>of</str<strong>on</strong>g> pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al does not get involved<br />

<strong>and</strong> complains? "Is it <strong>on</strong>ly a<br />

surveyor?"<br />

My dear friends, if we can not see<br />

ourselves as a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al, with<br />

order, structure <strong>and</strong> an inner pride,<br />

then how wiU society view us?<br />

This then begs the final questi<strong>on</strong>.<br />

Who is resp<strong>on</strong>sible? I suggest it is<br />

all <str<strong>on</strong>g>of</str<strong>on</strong>g> us.<br />

If we could all st<strong>and</strong> in fr<strong>on</strong>t <str<strong>on</strong>g>of</str<strong>on</strong>g> a<br />

mirror <strong>and</strong> look through <strong>and</strong> see our<br />

heritage, would we be proud <str<strong>on</strong>g>of</str<strong>on</strong>g> what<br />

we see? That answer is obvious. We<br />

are all proud <str<strong>on</strong>g>of</str<strong>on</strong>g> the heritage we<br />

share as surveyors.<br />

But what if those surveyors in our<br />

past, who gave us our heritage,<br />

would they have the same pride<br />

looking at us as we have in looking<br />

back at them? To answer this questi<strong>on</strong>,<br />

we should each examine ourselves<br />

closely.<br />

Suppose that you could step<br />

through the mirror <strong>and</strong> from the<br />

other side look into the future. Will<br />

there be pride in what we see in the<br />

future surveyor? That my friends<br />

MUST PAY BEFORE<br />

THEY CAN SURVEY!<br />

recently wrote to Caltrans reguesting<br />

that Caltrans maintain<br />

crews to be made aware <str<strong>on</strong>g>of</str<strong>on</strong>g> new<br />

State Law: AB2555, Statutes <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

1982, now Civil Code 846.a,b&c<br />

which prodes that the owner or tenant<br />

who owns or c<strong>on</strong>trols property<br />

is resp<strong>on</strong>sible to provide access, as<br />

specified.<br />

in full for the reader to judge <strong>and</strong><br />

decide for himself.<br />

Dear Mr. Dorsey:<br />

The California Department <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Transportati<strong>on</strong> (Caltrans) is charge<br />

with the care <strong>and</strong> protecti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> state<br />

highways (Streets <strong>and</strong> Highways<br />

Code Secti<strong>on</strong> 660 Et. Seq.). In carrying<br />

our this duty, Caltrans issues encroachment<br />

permits.<br />

Encroachment permits are required<br />

for surveyors who wish to<br />

work <strong>on</strong> c<strong>on</strong>venti<strong>on</strong>al highways.<br />

Caltrans issues annual encroachment<br />

permits for this purpose. The<br />

fee charged for this permit is $80.00<br />

<strong>and</strong> is for the cost to the Department<br />

for administrati<strong>on</strong> <strong>and</strong> review<br />

as authorized by Statutes 671.1. ^^<br />

Caltrans doesn^t deny the surv^^^<br />

or's right <str<strong>on</strong>g>of</str<strong>on</strong>g> entry, but <strong>on</strong>ly c<strong>on</strong>tr^^^<br />

the way surveyors work to assure<br />

the safety <str<strong>on</strong>g>of</str<strong>on</strong>g> the traveling public,<br />

the surveyors <strong>and</strong> the integrity <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the highway.<br />

The encroachment permit, or a<br />

copy there<str<strong>on</strong>g>of</str<strong>on</strong>g> nust be kept at the<br />

site <str<strong>on</strong>g>of</str<strong>on</strong>g> the work <strong>and</strong> must be shown<br />

to any representative <str<strong>on</strong>g>of</str<strong>on</strong>g> Caltrans or<br />

any law enforcement <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer <strong>on</strong> dem<strong>and</strong>.<br />

Work shall be suspended if<br />

the permit is not at job site.<br />

The Caltrans maintenance people<br />

are <strong>on</strong>ly carrying out the duties imposed<br />

<strong>on</strong> Caltrans by Streets <strong>and</strong><br />

Highways Code Secti<strong>on</strong> 660Et. Seq.<br />

when they find surveyors working<br />

in the state highway right-<str<strong>on</strong>g>of</str<strong>on</strong>g>-way<br />

without a permit.<br />

misunderst<strong>and</strong>ing. I am sure you<br />

are as c<strong>on</strong>cerned as Caltrans is regarding<br />

charged several thous<strong>and</strong> dollars<br />

per year.<br />

Each <strong>and</strong> every surveyor is urged<br />

to write his or her State Senator <strong>and</strong><br />

Assemblyman <strong>and</strong> inform them <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

this situati<strong>on</strong>.<br />

Only by all <str<strong>on</strong>g>of</str<strong>on</strong>g> us getting together<br />

can we protect our existing rights.<br />

SENECA H. MARLETTE<br />

Thu-d State Surveyor General<br />

Term <str<strong>on</strong>g>of</str<strong>on</strong>g> Office: 1854-1856<br />

Seneca Hunt Marlette, a native <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

Syracuse, New York, was bom<br />

January 18, 1824. After taking a<br />

degree in Civil Engineering from<br />

Renssalaer University, Marlette<br />

worked for the New York <strong>and</strong> Erie<br />

Railroad. He then traveled to San<br />

Francisco in 1849 <strong>and</strong>, for a time,<br />

worked as a Surveyor for William<br />

M. Eddy in the City <str<strong>on</strong>g>of</str<strong>on</strong>g> San Francisco's<br />

City Surveyors Office. The<br />

April 1, 1850, Editor <str<strong>on</strong>g>of</str<strong>on</strong>g> the ALTA<br />

California reported that Marlette<br />

withdrew as a c<strong>and</strong>idate for the<br />

positi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> City surveyor <str<strong>on</strong>g>of</str<strong>on</strong>g> San<br />

Francisco in favor <str<strong>on</strong>g>of</str<strong>on</strong>g> Mr. Eddy; the<br />

assurance <str<strong>on</strong>g>of</str<strong>on</strong>g> a job appears to have<br />

been a part <str<strong>on</strong>g>of</str<strong>on</strong>g> the agreement to<br />

withdraw.<br />

S.H. Marlette served as County<br />

Surveyor <str<strong>on</strong>g>of</str<strong>on</strong>g> Calaveras County during<br />

1852 <strong>and</strong> 1853, <strong>and</strong> later w<strong>on</strong><br />

electi<strong>on</strong> to the State Surveyor<br />

General's positi<strong>on</strong>; he assumed the<br />

duties <str<strong>on</strong>g>of</str<strong>on</strong>g> that <str<strong>on</strong>g>of</str<strong>on</strong>g>fice <strong>on</strong> January 2,<br />

1854, just sixteen days short <str<strong>on</strong>g>of</str<strong>on</strong>g> this<br />

thirtieth birthday.<br />

During his service as the State<br />

Surveyor General, Marlette's<br />

abilities <strong>and</strong> competence were<br />

acknowledged as superior. He suffered,<br />

however, with low pay, lack <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

a reas<strong>on</strong>able budget, <strong>and</strong> far too<br />

many duties. In 1855, the State<br />

Legislature ordered the Surveyor<br />

General to survey a good wag<strong>on</strong><br />

road over the Sierras; however, no<br />

m<strong>on</strong>ey was made available for the<br />

work. N<strong>on</strong>etheless, Marlette<br />

managed to raise the sums needed<br />

<strong>and</strong> got the job d<strong>on</strong>e. The California<br />

Historical Society, in 1938, speaks<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> that fact as follows:<br />

Benicia, California, in 1854 became<br />

Surveyor-General <str<strong>on</strong>g>of</str<strong>on</strong>g> California, He<br />

was recognized as California's first<br />

road builder. Against many odds,<br />

under his directi<strong>on</strong> the road was<br />

built over the Sierra to Cars<strong>on</strong><br />

Valley, now the route followed by<br />

the State Highway from Scramento<br />

through Placerville to Lake Tahoe,<br />

thence into Nevada. The Virginia<br />

City Water Supply comes from<br />

Marlette Lake, which was named<br />

for him. In order to reach the lake, a<br />

tunnel three thous<strong>and</strong> feet l<strong>on</strong>g<br />

beneath the dividing ridge <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Tahoe <strong>and</strong> the Great Basin had to be<br />

dug at a cost <str<strong>on</strong>g>of</str<strong>on</strong>g> two milli<strong>on</strong> dollars.<br />

When the water reached the Comstock<br />

<strong>on</strong> August 1, 1873, there was<br />

great rejoicing."<br />

Up<strong>on</strong> leaving State service,<br />

Marlette worked as a private Surveyor<br />

in Calaveras County, <strong>and</strong><br />

later in Nevada. In 1860, he was<br />

elected to the <str<strong>on</strong>g>of</str<strong>on</strong>g>fice <str<strong>on</strong>g>of</str<strong>on</strong>g> County Surveyor<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> Nevada's Cars<strong>on</strong> County.<br />

In successive moves, he served as<br />

the County Surveyor <str<strong>on</strong>g>of</str<strong>on</strong>g> Storey<br />

County, <strong>and</strong> in 1864 as Nevada's<br />

first State Surveyor General.<br />

Marlette left that positi<strong>on</strong> in 1868<br />

after two terms in <str<strong>on</strong>g>of</str<strong>on</strong>g>fice.<br />

S.H. Marlette pursued private<br />

lumber interests after his public<br />

career, <strong>and</strong> at age 63 started the<br />

Ment<strong>on</strong>e Irrigati<strong>on</strong> Company. He<br />

remained active in the Company for<br />

the next twenty-four years.<br />

In 1874, Marlette married Alice<br />

Ingham, <str<strong>on</strong>g>of</str<strong>on</strong>g> California. They eventually<br />

settled in southern California.<br />

Seneca H. Marlette died August 24,<br />

1911, in Glendale; Alice Marlette<br />

died January 24, 1914, in Los<br />

Angeles.<br />

S.H. MfU"lette was <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g> seven<br />

children. The name is <str<strong>on</strong>g>of</str<strong>on</strong>g> French<br />

origin, but his ancestors entered the<br />

country before the <str<strong>on</strong>g>American</str<strong>on</strong>g><br />

Revoluti<strong>on</strong>. Writers have spoken<br />

well <str<strong>on</strong>g>of</str<strong>on</strong>g> Marlette; historian J.M.<br />

Guinn's view is summed up in these<br />

favorable terms: "The pi<strong>on</strong>eer days<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> General Marlette have resulted in<br />

a material upbuilding for California,<br />

for he brought with him to the State<br />

the ability <strong>and</strong> perserverance which<br />

al<strong>on</strong>e could give to the comm<strong>on</strong>wefilth<br />

its impetus toward the positi<strong>on</strong><br />

it now occupies am<strong>on</strong>g its sister<br />

states <str<strong>on</strong>g>of</str<strong>on</strong>g> the Uni<strong>on</strong>."<br />

THE SURVEYOR IN COURT<br />

Having underg<strong>on</strong>e several experiences<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> helping the surveyor at<br />

our house prepare for court—after<br />

being advised by ph<strong>on</strong>e at 4 p.m. <strong>on</strong><br />

Friday about a court case scheduled<br />

for 10 a.m. the following M<strong>on</strong>day, or<br />

by an attorney suggesting they g<br />

together a few minutes just bef<br />

court c<strong>on</strong>venes the next day<br />

looked forward to sitting in the audience<br />

for the 1982 Associati<strong>on</strong> C<strong>on</strong>venti<strong>on</strong><br />

to learn how it was supposed<br />

to be d<strong>on</strong>e when the surveyor<br />

goes to court.<br />

Through the years we have heard<br />

speakers at short courses <strong>and</strong> c<strong>on</strong>venti<strong>on</strong>s<br />

address this particular<br />

subject <strong>on</strong>ly as segments <str<strong>on</strong>g>of</str<strong>on</strong>g> other<br />

programs; therefore, we were particularly<br />

pleased that an entire c<strong>on</strong>venti<strong>on</strong><br />

program was being set<br />

aside for an area becoming increasingly<br />

important to surveyors.<br />

The c<strong>on</strong>venti<strong>on</strong> inspired me to<br />

assemble my notes <strong>and</strong> comments<br />

so they would be <str<strong>on</strong>g>of</str<strong>on</strong>g> benefit to attorneys,<br />

as weU as surveyors <strong>and</strong><br />

other interested individuals. The informati<strong>on</strong><br />

that follows is written<br />

strictly from a layman's point <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

view.<br />

Preparing for the<br />

Courtroom Appearance<br />

When the attorney calls to advise<br />

that you are going to court, askj<br />

you are being called as an exp'<br />

witness or as a lay witness. Nin in^^<br />

times out <str<strong>on</strong>g>of</str<strong>on</strong>g> 10 you will be an expert<br />

witness.


An expert witness is <strong>on</strong>e who is<br />

qualified to testify in a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

field,<br />

mil<br />

while a lay witness is <strong>on</strong>e who<br />

'.s physically observed something<br />

the field—such as a fence having<br />

'en there a l<strong>on</strong>g time.<br />

Obtain a copy <str<strong>on</strong>g>of</str<strong>on</strong>g> the case documents<br />

from the attorney before preparing<br />

to go to court. As an expert<br />

witness, you may be able to provide<br />

additi<strong>on</strong>al informati<strong>on</strong> to the case to<br />

make it complete. The attorney<br />

needs a complete underst<strong>and</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

what the problem is in order to present<br />

it in court. Discuss with him<br />

what questi<strong>on</strong>s he will ask you in<br />

court. Advise him if you need to tell<br />

the bad as well as the good—d<strong>on</strong>'t<br />

compromise your moral obligati<strong>on</strong>.<br />

C<strong>on</strong>sult with the attorney about<br />

the dress code preferred by the<br />

judge. A coat <strong>and</strong> tie are usually in<br />

order, especially if there is to be a<br />

jury. Your pers<strong>on</strong>al appearance <strong>and</strong><br />

c<strong>on</strong>duct are very important.<br />

Have a visit with your abstractor.<br />

(You have probably visited him<br />

before the survey was performed.)<br />

Compile the documentary evidence<br />

you will take to court. Have<br />

all copies <str<strong>on</strong>g>of</str<strong>on</strong>g> plats clean <strong>and</strong> legible.<br />

I^^nlarge copies <str<strong>on</strong>g>of</str<strong>on</strong>g> plats <strong>and</strong> draw-<br />

^^Bgs so judge <strong>and</strong> jury can read the<br />

I^Rtails easily. Write out the GLO<br />

calls <strong>on</strong> the plat. Insure that all the<br />

surveying st<strong>and</strong>ards are followed in<br />

preparing the plat. You will want to<br />

show the judge <strong>and</strong> jury that the<br />

survey meets these st<strong>and</strong>ards.<br />

C<strong>on</strong>sult textbooks, mark pages.<br />

Be able to refer to the reference<br />

books used, with famiUarity—know<br />

the name <str<strong>on</strong>g>of</str<strong>on</strong>g> the author <strong>and</strong> his<br />

status as an expert in his particular<br />

field. You might xerox certain<br />

paragraghs or pages out <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

books for circulati<strong>on</strong> to the judge<br />

<strong>and</strong> jury.<br />

Review the survey records in the<br />

clerk's <str<strong>on</strong>g>of</str<strong>on</strong>g>fice in the county where<br />

the property is located, so you will<br />

be able to describe the research procedure<br />

<strong>and</strong> the records available in<br />

that county.<br />

Make copies <str<strong>on</strong>g>of</str<strong>on</strong>g> all surveys used in<br />

performing the survey. Have a sufficient<br />

number <str<strong>on</strong>g>of</str<strong>on</strong>g> copies for every<strong>on</strong>e<br />

c<strong>on</strong>cerned. Keep in mind that<br />

when you used Short-Cut Charlie's<br />

^^rner, you accepted resp<strong>on</strong>sibility<br />

I^Hr it being in the correct positi<strong>on</strong><br />

l^^st as if you had set it yourself.<br />

Compile your documentary<br />

evidence in an orderly manner—<br />

arrange the data so that you can<br />

just reach for what you want when<br />

you need it, <strong>and</strong> will not appear<br />

flustered, c<strong>on</strong>fused or disorganized<br />

when trying to find something during<br />

testim<strong>on</strong>y.<br />

Go to the field <strong>and</strong> review the field<br />

work, especially if it has been a<br />

period <str<strong>on</strong>g>of</str<strong>on</strong>g> time since the work was<br />

d<strong>on</strong>e. Make sure you have current<br />

knowledge <str<strong>on</strong>g>of</str<strong>on</strong>g> the situati<strong>on</strong>. Talk to<br />

the party chief, field crew, <strong>and</strong><br />

draftsman—every<strong>on</strong>e c<strong>on</strong>cerned<br />

with the survey. Get your act<br />

together before going to court!<br />

Have them prepare to accompany<br />

you to court. You might have a practice<br />

sessi<strong>on</strong> in your <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, explaining<br />

the procedure used <strong>on</strong> the survey,<br />

especially if you are inexperienced<br />

in speaking in public or<br />

under pressure.<br />

Take photographs <str<strong>on</strong>g>of</str<strong>on</strong>g> roads,<br />

fences, timber, or corners—or<br />

whatever is applicable to the<br />

case—have photographs enlarged<br />

so they can be easily seen by<br />

every<strong>on</strong>e c<strong>on</strong>cerned. It may be<br />

necesary to cut a cross-secti<strong>on</strong> out<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a tree <strong>and</strong> have an expert examine<br />

it to determine the age or kind <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

tree.<br />

Make arrangements for your fee<br />

ahead <str<strong>on</strong>g>of</str<strong>on</strong>g> time. D<strong>on</strong>'t make the fee<br />

(No doubt you have kept copies <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

presentati<strong>on</strong>s <strong>on</strong> various aspects <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

surveying from short courses <strong>and</strong><br />

have them properly filed at your <str<strong>on</strong>g>of</str<strong>on</strong>g>fice<br />

for reference at times like this.)<br />

If there is a jury, go to great length<br />

to describe your quaUficati<strong>on</strong>s—it<br />

might be wise to explain the curriculum<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> certain courses to show<br />

the j ury you have had educati<strong>on</strong> in a<br />

particular area.<br />

Let the attorney guide you in your<br />

testim<strong>on</strong>y. Listen to all the questi<strong>on</strong>s—the<br />

attorney may have<br />

changed the form <str<strong>on</strong>g>of</str<strong>on</strong>g> the questi<strong>on</strong><br />

since your pre-trial c<strong>on</strong>ference.<br />

Be sure you underst<strong>and</strong> the questi<strong>on</strong>s.<br />

Be calm, deliberate, <strong>and</strong><br />

methodical in answering questi<strong>on</strong>s.<br />

Be low-key—d<strong>on</strong>'t talk too loudly.<br />

D<strong>on</strong>'t volunteer more than the questi<strong>on</strong>s<br />

ask for, even if there is something<br />

adverse <strong>on</strong> your survey. D<strong>on</strong>'t<br />

ramble. D<strong>on</strong>'t get angry. D<strong>on</strong>'t talk<br />

back to the attorney. If there is a<br />

questi<strong>on</strong>able situati<strong>on</strong>, d<strong>on</strong>'t be too<br />

positive—there may be varing<br />

opini<strong>on</strong>s.<br />

You may be asked these questi<strong>on</strong>s:<br />

Did you discuss this case before<br />

coming to court? (Certainly you did,<br />

with the client <strong>and</strong> his attorney.)<br />

How much were you paid to come<br />

today? (Answer, telling the amount.)<br />

Have you talked to your own attorney?<br />

(Yes, you did—or should<br />

have.)<br />

Have you talked to the other attorney?<br />

(Answer, explaining why.}<br />

The other attorney will try to take<br />

you out <str<strong>on</strong>g>of</str<strong>on</strong>g> yoiu- pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al role.<br />

D<strong>on</strong>'t get any more technical than<br />

necessary. Use comm<strong>on</strong>, ordinary<br />

language as much as possible.<br />

Remember that the members <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

jury probably do not underst<strong>and</strong><br />

much about surveying.<br />

D<strong>on</strong>'t be afraid to say, "I d<strong>on</strong>'t<br />

know." D<strong>on</strong>'t rely <strong>on</strong> heresay—<br />

bring the oldtimer to court with you<br />

if he is able to come, so he can explain<br />

the situati<strong>on</strong> for himself.<br />

Do not let the other attorney set<br />

the pace. You are a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

man—if you break, you are in<br />

trouble. Stay cool. Answer to the<br />

judge, but do not c<strong>on</strong>fuse him. If<br />

your attorney objects, this is a<br />

signal—think hard. Ask to have the<br />

questi<strong>on</strong> repeated—this buys time.<br />

Be specific in describing the procedure<br />

used. Have large copy <strong>on</strong><br />

chalkboard. Use pointer to explain<br />

procedure, going from A to B, B to<br />

C, in a very systematic, orderly<br />

manner.<br />

Bring your pocket calculator to<br />

coiut with you—make sure it is properly<br />

charged so it can be used without<br />

c<strong>on</strong>necting to electric current.<br />

Listen to the whole proceedings, if<br />

allowed. Keep your mind <strong>on</strong> what is<br />

It is distracting for a client to talk<br />

to his attorney. D<strong>on</strong>'t distract the<br />

attorney, but you can talk to him.<br />

You may have to ask for a recess for<br />

a few minutes.<br />

Bring the party chief, field crew,<br />

<strong>and</strong> draftsman—every<strong>on</strong>e c<strong>on</strong>cerned.<br />

Your main role is as expert<br />

witness—you may become an expert<br />

advocate instead, defending<br />

your survey against another survey.<br />

When you become an advocate, you<br />

lose your credibihty as a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

witness.<br />

Review your testim<strong>on</strong>y with the<br />

attorney <strong>and</strong> client. Make notes for<br />

future reference for a more effective<br />

procedure next time. Obtain a copy<br />

Remember that any survey you<br />

perform is not complete unless you<br />

As we all know, the Bi-Centennial<br />

Year for the celebrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the creati<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the U.S. Rectangular Survey<br />

published an editorial in its October<br />

the Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal Procurement<br />

As predicted in the February<br />

Reagan <strong>on</strong> October 19 vetoed a bill<br />

providing authorizati<strong>on</strong> for Nati<strong>on</strong>al<br />

Oceanic <strong>and</strong> Atmospheric<br />

Administrati<strong>on</strong> programs for fiscal<br />

year 1985, citing a <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>i<strong>on</strong>al<br />

Umitati<strong>on</strong> <strong>on</strong> Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Management<br />

<strong>and</strong> Budget Circular A-76 studies as<br />

an objecti<strong>on</strong>able feature. In a message<br />

withholding approval <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

bill, the President said the antic<strong>on</strong>tracting<br />

out provisi<strong>on</strong> would result<br />

in "excessive <strong>and</strong> unjustifiable<br />

delays" in agency c<strong>on</strong>tracting activities.<br />

He also noted the bill's provisi<strong>on</strong>s<br />

would "unduly effect the<br />

ability <str<strong>on</strong>g>of</str<strong>on</strong>g> the Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Commerce<br />

to manage its programs<br />

resp<strong>on</strong>sibly <strong>and</strong> effectively." Mr.<br />

Reagan called the bill "an unwarranted<br />

matters normally <strong>and</strong> properly<br />

within the management discreti<strong>on</strong><br />

the veto is "in the interest <str<strong>on</strong>g>of</str<strong>on</strong>g> efficient<br />

The Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Management <strong>and</strong><br />

Budget has announced a redirecti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> its Circular A-76. 0MB has emphasized<br />

that the circular is to be<br />

used as part <str<strong>on</strong>g>of</str<strong>on</strong>g> a government "productivity<br />

enhancement program,"<br />

not a blank check for massive c<strong>on</strong>tracting<br />

out as some had previously<br />

alleged it to be. The new directive instructs<br />

agencies to not <strong>on</strong>ly compare<br />

their cost <str<strong>on</strong>g>of</str<strong>on</strong>g> providing services<br />

against the private sector, but also<br />

obtain a bid for "the service under<br />

study from another government<br />

agency" currently providing these<br />

services. The most ec<strong>on</strong>omical <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the three opti<strong>on</strong>s (keeping the service<br />

in the agency, c<strong>on</strong>tract out to<br />

the private sector, or c<strong>on</strong>tract with<br />

another government agency) will be<br />

selected." The productivity review<br />

will focus <strong>on</strong> 14 major functi<strong>on</strong>al<br />

categories. The Ust includes "architecture<br />

<strong>and</strong> civil engineering"<br />

which is defined as "activities involved<br />

in the planning, designing,<br />

c<strong>on</strong>structing, modificati<strong>on</strong>, restorati<strong>on</strong><br />

<strong>and</strong> maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> structures<br />

<strong>and</strong> facilities. Includes the investigating,<br />

This year's c<strong>on</strong>ference will be held<br />

at the Town & Country Hotel &<br />

C<strong>on</strong>venti<strong>on</strong> Center located in Sunny<br />

San Diego. The c<strong>on</strong>venti<strong>on</strong> will be a<br />

memorable event as we celebrate<br />

the 200th anniversary <str<strong>on</strong>g>of</str<strong>on</strong>g> the rectangular<br />

survey system.<br />

Since 1785, the surveys <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

public l<strong>and</strong>s have been c<strong>on</strong>ducted.<br />

The first surveys, beginning in<br />

Ohio, were made under the Geographer<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the United States. These<br />

secti<strong>on</strong>s or "lots" were <strong>on</strong>e mile<br />

square numbered 1 to 36 commencing<br />

with No. 1 in the southeast corner<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the township.<br />

On May 18,1796 an Act provided<br />

for the appointment <str<strong>on</strong>g>of</str<strong>on</strong>g> a Surveyor<br />

General. His duty was to survey the<br />

pubUc l<strong>and</strong>s located northwest <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the Ohio River. Half <str<strong>on</strong>g>of</str<strong>on</strong>g> the township<br />

were to be subdivided into two-mile<br />

blocks, while the rule for numbering<br />

secti<strong>on</strong>s within the township was<br />

changed to the same system used<br />

;oday.<br />

In 1831, the Commissi<strong>on</strong>er <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

eneral L<strong>and</strong> Office issued detailed<br />

instructi<strong>on</strong>s to the surveyors<br />

general c<strong>on</strong>cerning surveys <strong>and</strong><br />

plats. Subsequent to these directi<strong>on</strong>s,<br />

the Manual <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>Surveying</strong> Instructi<strong>on</strong>s<br />

evolved.<br />

The Act <str<strong>on</strong>g>of</str<strong>on</strong>g> July 4, 1836, placed<br />

the overall directi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the pubUc<br />

l<strong>and</strong> surveys under the principal<br />

clerk <str<strong>on</strong>g>of</str<strong>on</strong>g> surveys in the General L<strong>and</strong><br />

Office. The first "manual" was<br />

printed in 1851 as Instructi<strong>on</strong>s to<br />

the Surveyor General <str<strong>on</strong>g>of</str<strong>on</strong>g> Oreg<strong>on</strong>; Being<br />

a Manual for Field Operati<strong>on</strong>s."<br />

Immediately, its' use was extended<br />

to Minnesota, Kansas, Nebraska,<br />

New Mexicao, <strong>and</strong> California. A<br />

shghtly revised versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the instructi<strong>on</strong>s<br />

were issued in 1855.<br />

Today, we still use this system to<br />

locate <strong>and</strong> relocate most <str<strong>on</strong>g>of</str<strong>on</strong>g> our l<strong>and</strong><br />

boundaries.<br />

Our unique Uvelihood is to a certain<br />

degree dependant up<strong>on</strong> our<br />

abihty to establish <strong>and</strong> reestabUsh<br />

t. these l<strong>and</strong> boundaries.<br />

Today in 1985, we find the system<br />

o still be effective.<br />

It never ceases to amaze me when<br />

<strong>on</strong>e finds an old secti<strong>on</strong> corner<br />

m<strong>on</strong>ument. Our heritage is rich with<br />

noticeble changes. Obviously <strong>on</strong>e <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the most dramatic has been the use<br />

<strong>and</strong> advent <str<strong>on</strong>g>of</str<strong>on</strong>g> electr<strong>on</strong>ic distance<br />

meters <strong>and</strong> calculating devices.<br />

This years c<strong>on</strong>ference will feature<br />

exhibits <strong>and</strong> distributor's displays<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> modem electr<strong>on</strong>ic equipment. As<br />

always, the program committee is<br />

striving to present the best possible<br />

guests <strong>and</strong> programs available today.<br />

In staying in with the theme,<br />

the Surveyor's Historical Society<br />

will have an exhibit <strong>on</strong> display. Incidently,<br />

if any<strong>on</strong>e has some antique<br />

instruments <strong>and</strong>/or artifacts they<br />

would like to display, please feel free<br />

the San Diego Chapter may host a<br />

regard to their developing a series <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

workshops for the Associati<strong>on</strong>. ITS<br />

would develop the seminars, carry<br />

the expenditures <strong>and</strong> receive the income.<br />

The workshop would be<br />

scheduled <strong>on</strong> the Fridays prior to<br />

the Board <str<strong>on</strong>g>of</str<strong>on</strong>g> Directors meetings to<br />

allow attendees to attend Board<br />

meetings.The objective <str<strong>on</strong>g>of</str<strong>on</strong>g> the program<br />

HISTORY OF THE LAND<br />

SURVEYORS' ACT<br />

The L<strong>and</strong> Surveyors' Act <strong>and</strong> the<br />

Subdivisi<strong>on</strong> Map Act have been<br />

closely associated since their beginning<br />

in the early 1890's. It is almost<br />

impossible for the layman to discern<br />

the difference between the two.<br />

Because <str<strong>on</strong>g>of</str<strong>on</strong>g> their closeness, a history<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the L<strong>and</strong> Surveyors' Act <strong>and</strong> the<br />

Subdivisi<strong>on</strong> Map Act must be discussed<br />

together to acquire a more<br />

complete underst<strong>and</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> each.<br />

In December 1981, Mr. Andrew<br />

B. Gustafs<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the County Counsel's<br />

Office, County <str<strong>on</strong>g>of</str<strong>on</strong>g> Ventura, was<br />

asked for <strong>and</strong> rendered an opini<strong>on</strong><br />

c<strong>on</strong>cerning the creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> lots by^^<br />

record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey. It is the questioi^^^<br />

maps required by the Subdivisi<strong>on</strong><br />

Map Act <strong>and</strong> local ordinances<br />

are filed.<br />

It was these two secti<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Subdivisi<strong>on</strong> Map Act that led to the<br />

questi<strong>on</strong> <strong>and</strong> subsequent answer. A<br />

review <str<strong>on</strong>g>of</str<strong>on</strong>g> the histories <str<strong>on</strong>g>of</str<strong>on</strong>g> the Subdivisi<strong>on</strong><br />

Map Act <strong>and</strong> the L<strong>and</strong> Surveyor's<br />

Act leads to the c<strong>on</strong>clusi<strong>on</strong><br />

that the <strong>on</strong>ly "prior law" regulating<br />

the creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> legal lots is set forth<br />

in the earUer versi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> the Subdivisi<strong>on</strong><br />

Map Act itself. The L<strong>and</strong><br />

Surveyors' Act has never regulated<br />

the creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> legal lots, <strong>and</strong> record<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> survey maps prepared <strong>and</strong> filed<br />

pursuant soley to that act are not<br />

the functi<strong>on</strong>al equivalent <str<strong>on</strong>g>of</str<strong>on</strong>g> a final<br />

or parcel map.<br />

L<strong>and</strong> Surveyor's Act<br />

The L<strong>and</strong> Surveyor's Act had its<br />

genesis in 1891 with the enactment<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> Chapter 255 <str<strong>on</strong>g>of</str<strong>on</strong>g> the 1891 Statutes.<br />

That seminal act was entitled "an<br />

act to define the duties <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>and</strong> to<br />

Ucense l<strong>and</strong> surveyors." It provided<br />

for the examinati<strong>on</strong> <strong>and</strong> hcensing <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

surveyors <strong>and</strong>, at Secti<strong>on</strong> 11, further<br />

provided:<br />

''Within sixty days after a survey<br />

relating to the sale or subdivisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

l<strong>and</strong>s, the retracing or establishing<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> property <strong>and</strong> boundary lines<br />

(etc.). . . has been made by a licensed<br />

surveyor, he shall file with the<br />

Recorder <str<strong>on</strong>g>of</str<strong>on</strong>g> the county. . .a record<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> survey. . . "<br />

The entire thrust <str<strong>on</strong>g>of</str<strong>on</strong>g> the Act was<br />

to ensure the competence <str<strong>on</strong>g>of</str<strong>on</strong>g> surveyors,<br />

the accuracy <str<strong>on</strong>g>of</str<strong>on</strong>g> surveys, <strong>and</strong><br />

the integrity <str<strong>on</strong>g>of</str<strong>on</strong>g> records <str<strong>on</strong>g>of</str<strong>on</strong>g> surveys.<br />

The Act did not require a survey as<br />

a c<strong>on</strong>diti<strong>on</strong> precedent to a sale or<br />

subdivisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong>. It merely stated<br />

that, if a survey were made relating<br />

to a sale or subdivisi<strong>on</strong>, a record <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the survey should be recorded. The<br />

sale or subdivisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong> was not<br />

restricted or regulated in any way.<br />

Since 1891, the L<strong>and</strong> Surveyors'<br />

Act has underg<strong>on</strong>e many amendments.<br />

For example: Stats. 1907,<br />

Ch. 247; Stats. 1931, Ch. 1091;<br />

Stats. 1933, Ch. 506; <strong>and</strong> Stats.<br />

1939, Ch. 41. The last <str<strong>on</strong>g>of</str<strong>on</strong>g> these<br />

codified the L<strong>and</strong> Surveyors' Act in<br />

the Business <strong>and</strong> Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>s Code,<br />

commencing with Secti<strong>on</strong> 8700.<br />

More recent amendments are Usted<br />

in the annotated versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> that<br />

Code. Its main thrust has remained<br />

unchanged.<br />

At no time has the L<strong>and</strong> Surveyors'<br />

Act purported to regulate<br />

sales <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong> or the design <strong>and</strong> improvement<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> subdivisi<strong>on</strong>s. In fact,<br />

since 1933 the L<strong>and</strong> Surveyors' act<br />

has provided that, if the county surveyor<br />

<strong>and</strong> the licensed surveyor are^^<br />

unable to agree up<strong>on</strong> whether th6^^<br />

record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey is satisfactory, the^^<br />

county recorder must n<strong>on</strong>etheless<br />

accept the record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey for filing<br />

<strong>on</strong>ce an explanati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the disagreement<br />

is noted <strong>on</strong> the map. The Attorney<br />

General opined that this provisi<strong>on</strong>,<br />

when read in c<strong>on</strong>juncti<strong>on</strong><br />

with other provisi<strong>on</strong>s enacted in<br />

1943 but since repealed, meant that<br />

a record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey could be recorded<br />

pursuant to the L<strong>and</strong> Surveyors'<br />

Act even though it depicted hnes<br />

which did not represent existing<br />

boundary or property hnes. 18 Ops.<br />

Cal.Atty. Gen. 110 (1951). It does<br />

not follow, however, that the recording<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> such a record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey would<br />

create new legal lots. If that were<br />

the case, the regulatory process exercised<br />

by local agencies pursuant<br />

to the Subdivisi<strong>on</strong> Map Act <strong>and</strong><br />

local subdivisi<strong>on</strong> ordinances could<br />

have been frustrated simply by<br />

recording a record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey. This,<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> course, is not the case.<br />

"L<strong>and</strong> <strong>Surveying</strong> Educati<strong>on</strong> Being<br />

Re-Established<br />

in California Universities"<br />

The California Foundati<strong>on</strong> for<br />

L<strong>and</strong> <strong>Surveying</strong> Educati<strong>on</strong>, has<br />

made progress in the past year,<br />

toward the re-estabhshment <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong><br />

surveying educati<strong>on</strong> in California<br />

universities.<br />

The initial effort was to work with<br />

California State University at<br />

Pom<strong>on</strong>a, to get a "Survey Opti<strong>on</strong>"<br />

to the Civil Engineering program<br />

<strong>and</strong> ultimately estabUsh a baccalaureate<br />

in surveying. Indicati<strong>on</strong><br />

has been given that approval <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

"Survey Opti<strong>on</strong>" at Cal Poly,<br />

Pom<strong>on</strong>a is very likely to receive approval,<br />

<strong>and</strong> be in place, by the Fall<br />

Poly. A third course, '' Public<br />

THE MOOG SURVEY PAC<br />

For the HP-41CX<br />

Versi<strong>on</strong> 2E now has more than 27 K bytes <str<strong>on</strong>g>of</str<strong>on</strong>g> s<str<strong>on</strong>g>of</str<strong>on</strong>g>tware, including a new<br />

traverse data reducti<strong>on</strong> <strong>and</strong> adjustment program. The new program computes<br />

<strong>and</strong> prints the raw traverse, then balances the angular error. After<br />

angular balancing <strong>and</strong> traverse computati<strong>on</strong> are completed, the data is<br />

balanced according to Robert Adrian's general method <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>diti<strong>on</strong>al<br />

least squares adjustment. Since the mean raw field data is stored in<br />

A map recorded piarsuant to the<br />

1893 act might very well be labeled<br />

"record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey", but it would be<br />

distinguishable from a record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey<br />

prepared <strong>and</strong> filed pursuant<br />

<strong>on</strong>ly to the L<strong>and</strong> Surveyors' Act.<br />

The former would have lots designated<br />

by number or letter, the latter<br />

would probably not.' The former<br />

would be acknowledged by the<br />

owner, the latter might not even<br />

show the owner's name.^ The former<br />

would be certified by a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial<br />

respecting the owner's acknowledgment,<br />

the latter would not.<br />

Secti<strong>on</strong> 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the 1893 act was<br />

amended by Stats. 1901, Chapter<br />

124, to read:<br />

"The map or plat so made, acknowledged,<br />

<strong>and</strong> certified shall be<br />

presented to the governing body<br />

having c<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g> the streets. . .in<br />

the territory shown <strong>on</strong> the map or<br />

plat, <strong>and</strong> said governing body shall<br />

endorse there<strong>on</strong> which streets. . . <str<strong>on</strong>g>of</str<strong>on</strong>g>fered<br />

by said map or plat, they accept<br />

<strong>on</strong> behalf <str<strong>on</strong>g>of</str<strong>on</strong>g> the public, <strong>and</strong><br />

thereup<strong>on</strong> such streets. . .<strong>on</strong>ly as<br />

have been -thus accepted, shall be<br />

<strong>and</strong> become dedicated to public use.<br />

When so endorsed, <strong>and</strong> not before,<br />

said map or plat shall be recorded in<br />

the <str<strong>on</strong>g>of</str<strong>on</strong>g>fice <str<strong>on</strong>g>of</str<strong>on</strong>g> the county recorder. . . "<br />

Hence, after 1901. the endorsement<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the governing body became<br />

another mark which distinguishes<br />

maps filed pursuant to the subdivisi<strong>on</strong><br />

statute from those filed pursuant<br />

to the L<strong>and</strong> Surveyors' Act.<br />

In additi<strong>on</strong>, from 1901 (Stats. 1901,<br />

Ch. 124) until at least 1929 {Stats.<br />

1929, Ch. 837, § 30) the Subdivisi<strong>on</strong><br />

Map Act permitted maps as large as<br />

36 inches square, whereas from<br />

1907 (Stats. 1907, Ch. 247, § 9) to<br />

the present (Bus. & Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>. Code §<br />

8763) the L<strong>and</strong> Surveyors' Act has<br />

never permitted maps larger than<br />

21 inches by 30 inches.<br />

The 1893 act. as amended in 1901,<br />

was substantially reenacted by<br />

Stats. 1907, Chapter 231, with<br />

minor changes. Secti<strong>on</strong> 3 <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

1907 act required, in additi<strong>on</strong> to the<br />

endorsements <strong>and</strong> acknowledgments<br />

required by the earlier versi<strong>on</strong>s,<br />

a certificate from the county<br />

auditor respecting tax liens. The<br />

prohibiti<strong>on</strong> against selling or <str<strong>on</strong>g>of</str<strong>on</strong>g>fering<br />

to sell lots within a subdivisi<strong>on</strong><br />

unless a subdivisi<strong>on</strong> map had been<br />

filed was modified by Secti<strong>on</strong> 8 <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the 1907 act to apply <strong>on</strong>ly to sales or<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>fers to sell "by reference to any<br />

map or plot." Hence, lots would<br />

map. so l<strong>on</strong>g as the deed c<strong>on</strong>tained a<br />

metes <strong>and</strong> bounds descripti<strong>on</strong> <strong>and</strong><br />

did not refer to any map.<br />

The Subdivisi<strong>on</strong> Map Act was<br />

greatly modified by Chapter 837 <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the 1929 Statutes. Its applicati<strong>on</strong><br />

was generally limited to "subdivisi<strong>on</strong>"<br />

which was defined as the divi<br />

si<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong> into five or more lots<br />

Design <strong>and</strong> improvements were ex<br />

pressly regulated for the first time<br />

Before any sale <str<strong>on</strong>g>of</str<strong>on</strong>g> lots in a "subdivi<br />

si<strong>on</strong>" could occur, the subdivider<br />

had to submit a "tentative map". If<br />

the tentative map were approved,<br />

he could either prepare <strong>and</strong> record a<br />

"final map" or divide the property<br />

by executing deeds c<strong>on</strong>taining <strong>on</strong>ly<br />

metes <strong>and</strong> bounds descripti<strong>on</strong>s. If<br />

the tentative map were not approved,<br />

he could not record any map pursuant<br />

to the Subdivisi<strong>on</strong> Map Act.<br />

but he could n<strong>on</strong>etheless divide the<br />

property by executing deeds c<strong>on</strong>taining<br />

metes <strong>and</strong> bounds descripti<strong>on</strong>s.<br />

Because the 1929 Act coined<br />

the term "final map" to describe the<br />

<strong>on</strong>ly map which could be recorded<br />

pursuant to its provisi<strong>on</strong>s, it seems<br />

unlikely any such map would be<br />

labeled "record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey", although<br />

that is not impossible. In<br />

any event, a map recorded pursuant<br />

to the 1929 Act. however labeled,<br />

can be readily distinguished from a<br />

record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey recorded pursuant<br />

to the L<strong>and</strong> Surveyors' Act by the<br />

certificates <strong>and</strong> endorsements appearing<br />

there<strong>on</strong>. These include, in<br />

additi<strong>on</strong> to those required by the<br />

1907 act, a certificate by the county<br />

surveyor respecting special assessments<br />

<strong>and</strong> a certificate by the county<br />

surveyor (or other <str<strong>on</strong>g>of</str<strong>on</strong>g>ficer or body<br />

designated in local regulati<strong>on</strong>s) <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

compliance with the tentative map<br />

<strong>and</strong> other requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> the act.<br />

Similar certificates have been required<br />

for all "final maps" ever<br />

since.<br />

In 1937, the Subdivisi<strong>on</strong> Map Act<br />

underwent another major revisi<strong>on</strong>.<br />

See Stats. 1937, Ch. 670. A tentative<br />

map was still the first step in a<br />

"subdivisi<strong>on</strong>." But before any sales<br />

within a "subdivisi<strong>on</strong>" could occur,<br />

the owner would have to record, at<br />

his opti<strong>on</strong>, either a "final map" or a<br />

"record or survey map." This was<br />

the first time the term "a record <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

survey" appeared in the Subdivisi<strong>on</strong><br />

Map Act, The opti<strong>on</strong> to use<br />

such a "record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey map" as an<br />

alternative to a final map was incorporated<br />

into Article 6 <str<strong>on</strong>g>of</str<strong>on</strong>g> the act in<br />

1943 (see Stats. 1943, Ch. 128) <strong>and</strong><br />

remained in the Act until 1955 when<br />

it was deleted by Stats. 1955, Ch.<br />

1593. Such record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey maps<br />

are hereinafter called "Article 6<br />

records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey." As the Attorney<br />

Gen. 7.8 (1947). the Article 6 records<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> survey were not the same as th€^^<br />

records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey referred to in th^^B<br />

L<strong>and</strong> Surveyors' Act. Am<strong>on</strong>g the<br />

features that distinguish them is<br />

the requirement set forth in the Subdivisi<strong>on</strong><br />

Map Act that the Article 6<br />

record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey map have a certificate<br />

by the clerk <str<strong>on</strong>g>of</str<strong>on</strong>g> the approving<br />

governing body stating that the<br />

map was approved for subdivisi<strong>on</strong><br />

purposes in accordance with the<br />

c<strong>on</strong>diti<strong>on</strong>al approval <str<strong>on</strong>g>of</str<strong>on</strong>g> the tentative<br />

map.' Clearly, an Article 6<br />

record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey which was recorded<br />

piu*suant to the Subdivisi<strong>on</strong> Map<br />

Act from 1937 to 1955 is the functi<strong>on</strong>al<br />

equivalent <str<strong>on</strong>g>of</str<strong>on</strong>g> a final map <strong>and</strong><br />

would create legal lots in the same<br />

manner as a recorded final map.<br />

The 1937 versi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the Subdivisi<strong>on</strong><br />

Map Act (Stats. 1937, Ch. 670),<br />

at secti<strong>on</strong> 2(g), also required the filing<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> a "record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey map"<br />

with respect to certain l<strong>and</strong> divisi<strong>on</strong>s<br />

into five or more lots which<br />

were exempted from the definiti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> "subdivisi<strong>on</strong>." When the Subdivisi<strong>on</strong><br />

Map Act was codified in 1943<br />

(Stats. 1943, Ch. 128), these require-j<br />

ments were set forth in somewhat<br />

modified form in Business <strong>and</strong> Pro-^<br />

fessi<strong>on</strong>s Code Secti<strong>on</strong>s 11535(b) <strong>and</strong><br />

(c). These records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey, unlike<br />

Article 6 records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey, were to<br />

be filed "pursuant <strong>on</strong>ly to the provisi<strong>on</strong>s<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>" the L<strong>and</strong> Surveyors' Act.<br />

However, the requirements <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

Subdivisi<strong>on</strong> Map Act could be met<br />

<strong>on</strong>ly if, prior to such filing, the<br />

governing body had given certain<br />

approvals regarding lot design, access<br />

<strong>and</strong>, in some cases, drainage. In<br />

short, notwithst<strong>and</strong>ing the statement<br />

that Secti<strong>on</strong> 11535 records <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

survey were to be filed pursuant<br />

<strong>on</strong>ly to the L<strong>and</strong> Surveyors' Act,<br />

their preparati<strong>on</strong> <strong>and</strong> filing was<br />

m<strong>and</strong>ated by the Subdivisi<strong>on</strong> Map<br />

Act. They are the functi<strong>on</strong>al<br />

equivalent <str<strong>on</strong>g>of</str<strong>on</strong>g> a parcel map, <strong>and</strong> logic<br />

dictates that they too should create<br />

legal lots up<strong>on</strong> recordati<strong>on</strong>.<br />

distinguishes Secti<strong>on</strong> 11535 records<br />

In such a case, it may be necessary<br />

to resort to extrinsic evidence <strong>on</strong> a<br />

case-by-case basis to determine<br />

whether the map created legal lots.<br />

Happily, the problem exists <strong>on</strong>ly<br />

with respect to records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey<br />

depicting five or more lots which<br />

were filed from August 27, 1937.<br />

(the effective date <str<strong>on</strong>g>of</str<strong>on</strong>g> Stats. 1937,<br />

Ch. 670) to September 17, 1965. On<br />

the latter date, Business <strong>and</strong> Pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>s<br />

Code Secti<strong>on</strong> 11535 was<br />

amended so as to delete all reference<br />

to a "record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey" <strong>and</strong> to re-<br />

(See Stats. 1965, Ch. 1180.) The<br />

1965 amendment also authorized<br />

local agencies to enact ordinances<br />

requiring a "parcel map" for l<strong>and</strong><br />

divisi<strong>on</strong>s creating less than five lots.<br />

The Subdivisi<strong>on</strong> Map Act as<br />

codified in 1943 (Stats. 1943, Ch.<br />

128) was similar to the 1937 versi<strong>on</strong>.<br />

On September 7, 1955, (Stats. 1955,<br />

Ch. 1593) the provisi<strong>on</strong>s permitting<br />

Article 6 records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey as an alternative<br />

to a final map were deleted<br />

so that all "subdivisi<strong>on</strong>" (i.e., divisi<strong>on</strong><br />

into five or more lots, with<br />

some excepti<strong>on</strong>s) could be by "final<br />

map" <strong>on</strong>ly. In 1965 (Stats. 1965, Ch.<br />

1180) the term "parcel maps" was<br />

introduced into the Subdivisi<strong>on</strong><br />

Map Act, <strong>and</strong> the reference to Secti<strong>on</strong><br />

11535 "records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey" was<br />

delted. Am<strong>on</strong>g other things, the<br />

1965 Act required that, when required<br />

by local ordinance, a parcel<br />

map must be filed for divisi<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

l<strong>and</strong> into four or less lots. Parcel<br />

maps were also required for certain<br />

divisi<strong>on</strong>s into five or more lots<br />

which did not fall within the definiti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> "subdivisi<strong>on</strong>" <strong>and</strong> for which<br />

Secti<strong>on</strong> 11535 records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey had<br />

been required theret<str<strong>on</strong>g>of</str<strong>on</strong>g>ore. All parcel<br />

maps were required to have a certificati<strong>on</strong><br />

by the county surveyor<br />

that they were in compUance with<br />

the Subdivisi<strong>on</strong> Map Act, <strong>and</strong> this<br />

requirement has been retained in<br />

the law to date.<br />

In summary, the L<strong>and</strong> Surveyors'<br />

Act does not, <strong>and</strong> never did, purport<br />

to regulate the sale <str<strong>on</strong>g>of</str<strong>on</strong>g> divided l<strong>and</strong><br />

<strong>and</strong>, moreover, is not, <strong>and</strong> never<br />

was, a "law regulating the divisi<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> l<strong>and</strong>" or a ' 'law regulating design<br />

<strong>and</strong> improvement <str<strong>on</strong>g>of</str<strong>on</strong>g> subdivisi<strong>on</strong>s".<br />

It follows that records <str<strong>on</strong>g>of</str<strong>on</strong>g> survey<br />

prepared <strong>and</strong> recorded pursuant<br />

<strong>on</strong>ly to the L<strong>and</strong> Surveyors' Act or<br />

its predecessor acts do not, <strong>and</strong><br />

never did, create legal lots. •<br />

'The 1981 amendment to the L<strong>and</strong> Surveyors' Act expressly forbade lot numbers or letters unless the lot numbers or letters already appeared <strong>on</strong><br />

another "map <str<strong>on</strong>g>of</str<strong>on</strong>g> record." 1931 Stats., Ch. 1091, § 3. This prohibiti<strong>on</strong> has deleted in the 1935 amendment. 1935 Stats., Ch. 775, f§ 6-12. Lot<br />

numbers or letters are <str<strong>on</strong>g>of</str<strong>on</strong>g> obvious utility <strong>on</strong> a map which creates legal lots; they are likely to be superfluous <strong>on</strong> a map which does not.<br />
