We are not suggesting that the<br />

quaUfying language or<br />
"weasel words" in an effort to avoid<br />
resp<strong>on</strong>sibiUty for damages caused<br />
by his negUgent acts or omissi<strong>on</strong>s.<br />
However, it is essential that surveyors<br />
carefully review the language<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> any certificati<strong>on</strong> to determine<br />
if they are being required in<br />
the language to state as categorical<br />
fact representati<strong>on</strong>s which are impossible<br />
for an h<strong>on</strong>est man to make<br />
or are bey<strong>on</strong>d the obsolute knowledge<br />
or c<strong>on</strong>trol <str<strong>on</strong>g>of</str<strong>on</strong>g> the surveyor.<br />

HISTORY OF THE LAND<br />
SURVEYORS' ACT<br />

The L<strong>and</strong> Surveyors' Act <strong>and</strong> the<br />
Subdivisi<strong>on</strong> Map Act have been<br />
closely associated since their beginning<br />
in the early 1890's. It is almost<br />
impossible for the layman to discern<br />
the difference between the two.<br />
Because <str<strong>on</strong>g>of</str<strong>on</strong>g> their closeness, a history<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> the L<strong>and</strong> Surveyors' Act <strong>and</strong> the<br />
Subdivisi<strong>on</strong> Map Act must be discussed<br />
together to acquire a more<br />
complete underst<strong>and</strong>ing <str<strong>on</strong>g>of</str<strong>on</strong>g> each.<br />
In December 1981, Mr. Andrew<br />
B. Gustafs<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the County Counsel's<br />
Office, County <str<strong>on</strong>g>of</str<strong>on</strong>g> Ventura, was<br />
asked for <strong>and</strong> rendered an opini<strong>on</strong><br />
c<strong>on</strong>cerning the creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> lots by^^<br />
record <str<strong>on</strong>g>of</str<strong>on</strong>g> survey. It is the questioi^^^<br />
posed to Mr. Gustafs<strong>on</strong>, his answei^^<br />
<strong>and</strong> analysis that I have chosen to<br />
use to present this brief history <str<strong>on</strong>g>of</str<strong>on</strong>g><br />
the L<strong>and</strong> Surveyors' Act.<br />
