published an editorial in its October<br />

editi<strong>on</strong> str<strong>on</strong>gly supporting<br />

the Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Federal Procurement<br />

PoUcy (OFPP) study <str<strong>on</strong>g>of</str<strong>on</strong>g> pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />

services which <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g> m<strong>and</strong>ated<br />

in the Competiti<strong>on</strong> In C<strong>on</strong>tracting<br />

Act. "C<strong>on</strong>sulting Engineer" noted<br />

that since passage <str<strong>on</strong>g>of</str<strong>on</strong>g> the Brooks<br />

Act <str<strong>on</strong>g>of</str<strong>on</strong>g> 1972, the General Accounting<br />

Office "has persisted in ruUng<br />

that some traditi<strong>on</strong>al A/E services,<br />

such as . . . surveying <strong>and</strong> mapping,<br />

can be procured through price competiti<strong>on</strong><br />

rather than competitive<br />

negotiati<strong>on</strong> at the opti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> the procurement<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g>ficer." While recognizing<br />

that reopening the Brooks Act<br />

would be a "dangerous procedure,"<br />

the editorial notes that "after 12<br />

years <str<strong>on</strong>g>of</str<strong>on</strong>g> dealing with bidding requests<br />

<strong>on</strong> a case by case basis, it appears<br />

that those services that fell<br />

through the crack (<str<strong>on</strong>g>of</str<strong>on</strong>g> the Brooks<br />

Act) may finally be put <strong>on</strong> a par<br />

with design services."<br />

Reagan Vetoes NCAA<br />

As predicted in the February<br />

issue <str<strong>on</strong>g>of</str<strong>on</strong>g> Field Notes, President<br />

Reagan <strong>on</strong> October 19 vetoed a bill<br />

providing authorizati<strong>on</strong> for Nati<strong>on</strong>al<br />

Oceanic <strong>and</strong> Atmospheric<br />

Administrati<strong>on</strong> programs for fiscal<br />

year 1985, citing a <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>i<strong>on</strong>al<br />

Umitati<strong>on</strong> <strong>on</strong> Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Management<br />

<strong>and</strong> Budget Circular A-76 studies as<br />

an objecti<strong>on</strong>able feature. In a message<br />

withholding approval <str<strong>on</strong>g>of</str<strong>on</strong>g> the<br />

bill, the President said the antic<strong>on</strong>tracting<br />

out provisi<strong>on</strong> would result<br />

in "excessive <strong>and</strong> unjustifiable<br />

delays" in agency c<strong>on</strong>tracting activities.<br />

He also noted the bill's provisi<strong>on</strong>s<br />

would "unduly effect the<br />

ability <str<strong>on</strong>g>of</str<strong>on</strong>g> the Department <str<strong>on</strong>g>of</str<strong>on</strong>g> Commerce<br />

to manage its programs<br />

resp<strong>on</strong>sibly <strong>and</strong> effectively." Mr.<br />

Reagan called the bill "an unwarranted<br />

intrusi<strong>on</strong> by <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g> into<br />

matters normally <strong>and</strong> properly<br />

within the management discreti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> the Executive branch" <strong>and</strong> said<br />

the veto is "in the interest <str<strong>on</strong>g>of</str<strong>on</strong>g> efficient<br />

<strong>and</strong> ec<strong>on</strong>omical c<strong>on</strong>duct <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

government activities." The A-76<br />

provisi<strong>on</strong> would have prohibited<br />

NOAA from issuing any Request<br />

for Proposals to c<strong>on</strong>tract with the<br />

private sector for functi<strong>on</strong>s provided<br />

by government employees until<br />

<str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g> is given 30 days in which<br />

the House or Senate are in sessi<strong>on</strong><br />

to review the c<strong>on</strong>tracting out proposal.<br />

In a letter to ACSM, Associate<br />

NOAA Administrator James<br />

W. Winchester quickly noted that<br />

"while this acti<strong>on</strong> might appear to<br />

clear the way for NOAA to move<br />

ahead with this process without appropritate<br />

c<strong>on</strong>sultati<strong>on</strong>, I want to<br />

assure you that this will not be the<br />

case. . We wiU c<strong>on</strong>tinue our emphasis<br />

<strong>on</strong> frequent c<strong>on</strong>tact <strong>and</strong> c<strong>on</strong>sultati<strong>on</strong><br />

with user c<strong>on</strong>miunities as<br />

NOAA's A-76 process proceeds."<br />

0MB Redirects A-76, <strong>Surveying</strong><br />

<strong>and</strong> Mapping Still to be Studied<br />

The Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Management <strong>and</strong><br />

Budget has announced a redirecti<strong>on</strong><br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> its Circular A-76. 0MB has emphasized<br />

that the circular is to be<br />

used as part <str<strong>on</strong>g>of</str<strong>on</strong>g> a government "productivity<br />

enhancement program,"<br />

not a blank check for massive c<strong>on</strong>tracting<br />

out as some had previously<br />

alleged it to be. The new directive instructs<br />

agencies to not <strong>on</strong>ly compare<br />

their cost <str<strong>on</strong>g>of</str<strong>on</strong>g> providing services<br />

against the private sector, but also<br />

obtain a bid for "the service under<br />

study from another government<br />

agency" currently providing these<br />

services. The most ec<strong>on</strong>omical <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

the three opti<strong>on</strong>s (keeping the service<br />

in the agency, c<strong>on</strong>tract out to<br />

the private sector, or c<strong>on</strong>tract with<br />

another government agency) will be<br />

selected." The productivity review<br />

will focus <strong>on</strong> 14 major functi<strong>on</strong>al<br />

categories. The Ust includes "architecture<br />

<strong>and</strong> civil engineering"<br />

which is defined as "activities involved<br />

in the planning, designing,<br />

c<strong>on</strong>structing, modificati<strong>on</strong>, restorati<strong>on</strong><br />

<strong>and</strong> maintenance <str<strong>on</strong>g>of</str<strong>on</strong>g> structures<br />

<strong>and</strong> facilities. Includes the investigating,<br />

measuring, surveying <strong>and</strong><br />

mapping <str<strong>on</strong>g>of</str<strong>on</strong>g> the earth's physical<br />

features <strong>and</strong> phenomena."<br />

Budget Rug May Be Pulled From<br />

L<strong>on</strong>e L<strong>and</strong>sat Negotiator<br />

Published reports indicate that<br />

negotiati<strong>on</strong>s between the U.S. Commerce<br />

Department's Source Evaluati<strong>on</strong><br />

Board <strong>and</strong> the sole private sector<br />

L<strong>and</strong>sat bidder are at an impasse<br />

due to the Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Manage-<br />

ment <strong>and</strong> Budget's unwillingness to<br />

provide the funds needed to assist<br />

the firm in estabhshing a viablt ble^<br />

commercial L<strong>and</strong>sat operati<strong>on</strong>. Tl<br />

remaining bidder is the Eart! rtli^<br />

Observati<strong>on</strong> Satellite Corp.<br />

(EOSAT), a joint venture <str<strong>on</strong>g>of</str<strong>on</strong>g> RCA,<br />

Hughes Aircraft <strong>and</strong> several subc<strong>on</strong>tractors.<br />

The original request for<br />

proposfds <strong>and</strong> the L<strong>and</strong>sat Commercializati<strong>on</strong><br />

Act passed by <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g><br />

earher this year authorize $75<br />

a subsidy or other financial aid<br />

to the successful bidder. It is reported<br />

that Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Management<br />

<strong>and</strong> Budget Director David<br />

Stockman blocked <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g> from<br />

specifically appropriating the funds<br />

before adjournment <strong>and</strong> is now opposed<br />

to any internal reprogranmiing<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> start up funds by the Commerce<br />

Department. If a c<strong>on</strong>tract<br />

cannot be successfully negotiated,<br />

the law requires Commerce to readvertise<br />

a Request for Proposals. The<br />

Reagan Administrati<strong>on</strong> has already<br />

indicated it will not fund future<br />

government financed civil l<strong>and</strong><br />

remote sensing satellites, so the<br />

future <str<strong>on</strong>g>of</str<strong>on</strong>g> America's leadership ii^^<br />

the field hinges <strong>on</strong> the c<strong>on</strong>trac^^<br />

negotiati<strong>on</strong>s. Individual ACSM^P<br />

ASP members <strong>and</strong> firms are asked<br />

to write their <str<strong>on</strong>g>C<strong>on</strong>gress</str<strong>on</strong>g>man <strong>and</strong><br />

Senators (particularly RepubUcans)<br />

<strong>and</strong> urge them to c<strong>on</strong>tact Commerce<br />

Secretary Malcohn Baldrige <strong>and</strong><br />

0MB Director Stockman in support<br />

<str<strong>on</strong>g>of</str<strong>on</strong>g> full funding for L<strong>and</strong>sat commercieilizati<strong>on</strong><br />

that the Administrati<strong>on</strong><br />

committed to when the sale process<br />

began.<br />

Interior Releases Draft Surveyors/<br />

Surface Mining Act Regulati<strong>on</strong>s<br />

The Office <str<strong>on</strong>g>of</str<strong>on</strong>g> Surface Mining has<br />

released for public comment draft<br />

regulati<strong>on</strong>s implementing Senator<br />

Robert C. Byrd's (D-WV) amendment<br />

reinstating the l<strong>and</strong> surveyor<br />

as lead pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al in the Surface<br />

Mining C<strong>on</strong>trol <strong>and</strong> Reclamati<strong>on</strong><br />

Act. The deadline for comments was<br />

extended to December 3. An initial<br />

review by several key ACSM members<br />

with mine surveying experience<br />
