Do not discuss anything with<br />

case. This may cause a mistrial.<br />
If opposing attorney comes to you<br />
during recess, do not discuss any<br />
part <str<strong>on</strong>g>of</str<strong>on</strong>g> the case. Refuse, saying you<br />
will get your attorney <strong>and</strong> talk to<br />
both at the same time.<br />
Stay with client <strong>and</strong> attorney at<br />
the counsel table if the survey is an<br />
integral part <str<strong>on</strong>g>of</str<strong>on</strong>g> the case. Make notes<br />
<strong>on</strong> what to suggest to the attorney<br />
to ask the other surveyor.<br />
It is distracting for a client to talk<br />
to his attorney. D<strong>on</strong>'t distract the<br />
attorney, but you can talk to him.<br />
You may have to ask for a recess for<br />
a few minutes.<br />
Bring the party chief, field crew,<br />
<strong>and</strong> draftsman—every<strong>on</strong>e c<strong>on</strong>cerned.<br />
Your main role is as expert<br />
witness—you may become an expert<br />
advocate instead, defending<br />
your survey against another survey.<br />
When you become an advocate, you<br />
lose your credibihty as a pr<str<strong>on</strong>g>of</str<strong>on</strong>g>essi<strong>on</strong>al<br />
witness.<br />
The Case is Over!<br />
Review your testim<strong>on</strong>y with the<br />
attorney <strong>and</strong> client. Make notes for<br />
future reference for a more effective<br />
procedure next time. Obtain a copy<br />
<str<strong>on</strong>g>of</str<strong>on</strong>g> the final document <strong>on</strong> the case for<br />
your files.<br />
Remember that any survey you<br />
perform is not complete unless you<br />
can defend it in court. The <strong>on</strong>e you<br />
short-changed—the <strong>on</strong>e about<br />
which you are called up<strong>on</strong> to testify<br />
in court—can be very embarrassing<br />
