project area or in other areas not generally less desirable in regard to public utilities and public<br />
and commercial facilities, at rents or prices within the financial means of such families or<br />
individuals, and reasonably accessible to their places of employment.<br />
Any current residential tenant of one of the properties to be acquired shall be assisted by a<br />
relocation company hired by NMSDC with benefits determined by NMSDC, including benefits<br />
under General Municipal Law Section 970(j) . The accommodations for residential tenants shall<br />
include NMSDC providing all residential tenants with relocation assistance in the form of<br />
assistance in finding a new apartment, relocation stipends to cover the costs of moving, utility<br />
disconnect and reconnection costs, and possible rent increases for comparable space in<br />
accordance with applicable <strong>New</strong> <strong>York</strong> Division of Housing and Community Renewal guidelines<br />
and regulations. The foregoing provides a feasible method for the relocation of families and<br />
individuals displaced from the project area into decent, safe and sanitary dwellings, which are<br />
or will be provided in the project area or in other areas not generally less desirable in regard to<br />
public utilities and public and commercial facilities, at rents or prices within the financial<br />
means of such families and individuals, and reasonably accessible to their places of<br />
employment.<br />
Disclosure and Accountability Certifications:<br />
The Grantee and Beneficiary have provided ESD with the required Disclosure and<br />
Accountability Certifications. Grantee’s certification acknowledges that Grantee has the<br />
following Conflict of Interest:<br />
• When the subject grant was initially announced, Mayor Mike Spano’s brother, then<br />
Senator Nick Spano, was a member of the <strong>New</strong> <strong>York</strong> <strong>State</strong> Senate; however, this grant<br />
has been reappropriated every year since the grant was first announced.<br />
Grantee’s certification acknowledges the following under Good Standings:<br />
• Former City Council member Sandy Annabi was recently convicted for corruption while<br />
in office, which constitutes a felony but this councilwoman was not involved with the<br />
subject property or project.<br />
• The City participated with <strong>New</strong> <strong>York</strong> <strong>State</strong> Department of Environmental Coordination<br />
in a voluntary cleanup at a site located at 1061 North Broadway in Yonkers.<br />
• The City received a notice of violation issued by the Environmental Protection Agency<br />
regarding the removal of hazardous waste from City facilities.<br />
• As with any large municipal entity, the City is a defendant in various legal matters and<br />
will have judgments entered against it on occasion. None of these judgments impair<br />
the City’s ability to function and provide necessary services.<br />
• As with any large municipal entity, from time to time, the City or its employees or<br />
agents will be subject to investigation by regulatory or enforcement agencies.<br />
