A. <strong>New</strong> <strong>York</strong> - Restore III - Bush Terminal (W831)<br />
<strong>August</strong> 16, <strong>2012</strong><br />
present and future facilities. This project includes the demolition of Buildings 39/40 and 45,<br />
infrastructure and utility upgrades and related environmental cleanup. Utility upgrades include<br />
water, electrical and gas. Additionally, there will be pavement work, new roadways and<br />
relocation of a railroad connection.<br />
The Design and Construction Department (“D&C”) will review plans and cost estimates for<br />
conformity to the scope of work. D&C will attend meetings and visit the site at its discretion,<br />
inspect work completed and approve and recommend payment of invoices.<br />
Environmental Review:<br />
Pursuant to the requirements of the <strong>State</strong> Environmental Quality Review Act (“SEQRA”) and<br />
the implementing regulations of the <strong>New</strong> <strong>York</strong> <strong>State</strong> Department of Environmental<br />
Conservation, ESD staff performed an uncoordinated review. This review determined the<br />
project to be an Unlisted Action, which would not have a significant effect on the<br />
environment. It is recommended that the Directors make a Determination of No Significant<br />
Effect on the Environment.<br />
Due to the site’s location within the Bush Terminal Historic District, which is listed on the <strong>New</strong><br />
<strong>York</strong> <strong>State</strong> and National Registers of Historic Places, ESD has confirmed that the project<br />
sponsor consulted with the <strong>New</strong> <strong>York</strong> <strong>State</strong> Office of Parks, Recreation and Historic<br />
Preservation (“OPRHP”) pursuant to Section 14.09 of the <strong>New</strong> <strong>York</strong> <strong>State</strong> Parks, Recreation and<br />
Historic Preservation Law. ESD will ensure that all conditions stipulated by OPRHP will be met<br />
in accordance with a Letter of Understanding.<br />
Non-Discrimination and Contractor & Supplier Diversity:<br />
ESD’s Non-Discrimination and Contractor & Supplier Diversity policies will apply to this Project.<br />
The City shall be required to (i) include minorities and women in any job opportunities created, (ii)<br />
solicit and utilize <strong>New</strong> <strong>York</strong> <strong>State</strong> certified Minority and Women Business Enterprises (“MWBEs”)<br />
for any contractual opportunities generated in connection with the Project and (iii) use Good Faith<br />
Efforts (pursuant to 5 NYCRR §142.8) to achieve an overall MWBE Participation Goal of 40%. The<br />
overall goal shall include a Minority Business Enterprise (“MBE”) Participation Goal of 26% and a<br />
Women Business Enterprise (“WBE”) Participation Goal of 14% related to the total value of ESD’s<br />
funding.<br />

The area in which the project is to be located is a substandard or insanitary area, or is in<br />
danger of becoming a substandard or insanitary area and tends to impair or arrest<br />
sound growth and development of the municipality.<br />
The project involves the demolition of obsolete commercial buildings, which has been<br />
deemed by the City to arrest sound growth and development in the area.<br />
