RESOLVED, that based on the material submitted to the Directors with respect to the<br />
Merchants Commons Capital Project, the Corporation hereby determines that the proposed<br />
action will not have a significant effect on the environment.<br />

Next, Ms. Lippowitsch presented the July Non-Discretionary Consent Calendar for<br />
Ms. Lippowitsch noted that the Directors were being asked to approve three projects<br />
totaling $4,550,498 in assistance authorized or re-appropriated in the fiscal year <strong>2012</strong>-2013<br />
<strong>New</strong> <strong>York</strong> <strong>State</strong> Budget.<br />
Ms. Lippowitsch went on to explain that due diligence has been exercised by ESD staff<br />
and that the recipients have provided ESD with the required disclosure and accountability<br />
certifications.<br />
Ms. Lippowitsch provided a brief outline of each of the projects to be approved.<br />
Ms. Lippowitsch explained that the first item is an Executive sponsored Project relating<br />
