• The codes don’t make any distinction between bush<br />
camps and <strong>camping</strong> grounds in an urban area, nor<br />
are there any provisions relating to motorhomes.<br />
Foundations for enforcement<br />
This <strong>toolkit</strong> provides a foundation for action, but the<br />
final implementation and wording is up to each local<br />
government. Following are some examples of how local<br />
governments have provided a foundation for enforcement.<br />
Cook Shire Council<br />
Local Law No. 22 (Caravan Parks and Camping)<br />
S. 3: Camp in relation to land includes the physical<br />
occupation of, or staying overnight on land by a person,<br />
whether in accommodation, car or otherwise sleeping out.<br />
Redland City Council<br />
Local Law No. 7 (Camping Grounds)<br />
S. 27: A person must not camp on local government<br />
land unless—<br />
(a) the land is within—<br />
i. a <strong>camping</strong> ground; or<br />
ii.<br />
a lawfully established and operated caravan<br />
park; or<br />
(b) the person has the local government’s written<br />
approval to camp on the land.<br />
Gold Coast City Council<br />
Local Law No. 9 (Parks and Reserves)<br />
S. 12: A person must not, unless authorised by a permit, a<br />
sign exhibited in the park or a subordinate local law, use a<br />
park for the purpose of—<br />
(a) <strong>camping</strong>; or<br />
(b) occupying or remaining overnight in a park.<br />
Definitions<br />
To camp means to occupy or to sleep in or to attempt to<br />
sleep in a tent or motor vehicle, or otherwise in, on or<br />
under a facility, or on the ground of a park and; <strong>camping</strong><br />
has the corresponding meaning.<br />
Balonne Shire Council, Boulia Shire Council<br />
Local Law No. 17 (Parks and Reserves)<br />
S. 20: A person must not sleep overnight in a park or<br />
reserve (including a town reserve) without the local<br />
government’s written permission.<br />
Barcoo Shire Council, Barcaldine Regional Council,<br />
Charters Towers Regional Council<br />
Subordinate Local Law No. 1.6 (Operation of<br />
Camping Grounds)<br />
Operation of a <strong>camping</strong> ground does not require<br />
an approval.<br />
Boulia Shire Council, Bulloo Shire Council<br />
Local Law No. 23 (Camping and Camping Grounds)<br />
S. 32: (1) Subject to section 32.(2) of this local law, a<br />
person must not pitch or make a camp, make a camp site,<br />
pitch a tent, or park a caravan within 1 km of a <strong>camping</strong><br />
ground within the meaning of this local law, a caravan<br />
park within the meaning of the local government’s Local<br />
Law No. 22 (Caravan Park Operators), or any residential<br />
building.<br />
S. 32: (3) A person must not camp on local government<br />
land unless—<br />
(a) the land is within—<br />
i. a <strong>camping</strong> ground within the meaning of this<br />
local law; or<br />
ii.<br />
a caravan park within the meaning of the local<br />
government’s Local Law No. 22 (Caravan Park<br />
Operators); or<br />
(b) the person has the local government’s written<br />
approval to camp on the land.<br />
Carpentaria Shire Council<br />
Local Law No. 00 (Caravan Parks and Camping)<br />
S. 5: Camp in relation to land includes—<br />
(a) physical occupation;<br />
(b) staying overnight; or<br />
(c) the establishment of a site for the purposes<br />
of <strong>camping</strong>, by a person on land, whether in<br />
accommodation, car or otherwise sleeping out.<br />
S. 21: A person must not camp except in a caravan park<br />
within the areas prescribed by subordinate local law (does<br />
not apply within 5 km of the towns of Normanton and<br />
Karumba, when driving stock, Normanton Rodeo Grounds,<br />
Karumba Recreation Reserve, Gilbert River, Little Bynoe<br />
and Big Bynoe (Burketown Road), Flinders River (Walkers<br />
Bend), Walkers Creek, Glenore, Flinders River (Burketown<br />
Road), Mitchell River and Staaten River.<br />
Local Law No. 13 (Parks and Reserves)<br />
S. 18: A person must not sleep overnight in a park<br />
or reserve without the local government’s written<br />
permission.<br />
