1. INTRODUCTION<br />

1.1. The terms and conditions of this Electronic Data Interchange Agreement (“this EDI Agreement”)<br />

govern the conduct and methods of operation of the Parties in relation to the interchange of<br />

data <strong>for</strong> the purpose of or associated with the supply of vessel, inland carriers and container<br />

related data, by electronic transmission. They take account of the Uni<strong>for</strong>m Rules of Conduct <strong>for</strong><br />

Interchange of Trade Data by electronic transmission adopted by the International Chamber of<br />

Commerce, in conjunction with the TEDIS Programme European Model EDI Agreement. If<br />

necessary, additional rules may be agreed between the Parties, these rules are specific/bilateral<br />

and must be agreed upon in writing and signed by both the Terminal Operator and the<br />

Customer in order to become binding.<br />

1.2. The provisions of this Clause 1.2, notwithstanding anything to the contrary in this EDI<br />

Agreement apply where the Customer requests the Terminal Operator in terms of a:<br />

1.2.1. <strong>Container</strong> Terminal Order or pre-advice (and booking) EDI message <strong>for</strong> Shipping, to<br />

receive (and if applicable stack), and ship the containers aboard the vessel referred to<br />

therein and as stipulated therein;<br />

1.2.2. <strong>Container</strong> Terminal Order or EDI release message <strong>for</strong> Landing, to receive (and if<br />

applicable store), and <strong>for</strong>ward the containers listed herein to named consignee by the<br />

means of transport stipulated herein;<br />

1.2.3. <strong>Container</strong> Terminal Order <strong>for</strong> Transhipping, to tranship the containers referred to therein<br />

to the named destination by the means of transport stipulated therein;<br />

1.2.4. Import <strong>Container</strong> List or EDI discharge message, to discharge (and if applicable store),<br />

and <strong>for</strong>ward the containers listed therein to the named consignee by the means of<br />

transport stipulated therein (including rail in<strong>for</strong>mation <strong>for</strong>warded to TFR);<br />

1.2.5. Vessel load instruction or EDI load message, to ship the containers referred to therein to<br />

the named destination by means of transport stipulated therein;<br />

1.2.6. Vessel bay-plan or EDI bay-plan, to discharge containers stipulated therein.<br />

1.3. The Terminal Operator is not responsible <strong>for</strong> any incorrect statement of mass or content of any<br />

consignment of cargo reflected in the documents referred to in Clause 1.2 above and the<br />

Terminal Operator’s liability <strong>for</strong> any claims, howsoever arising, is limited as provided <strong>for</strong> in the<br />

Conditions and/or Statutory Provisions. The Customer must pay any additional charges which<br />

may be incurred by the Terminal Operator in carrying out any instructions in the documents<br />

referred to in Clause 1.2 above.<br />
