AN ORDINANCE CREATING SECTION 3.835 – SMOKING PROHIBITED<br />
ORDINANCE<br />
OF THE MUNICIPAL CODE OF THE VILLAGE OF HOBART, WISCONSIN<br />
THE VILLAGE BOARD OF THE VILLAGE OF HOBART, BROWN COUNTY,<br />
WISCONSIN, DOES ORDAIN THAT SECTION 3.835 BE CREATED<br />
3.835 - SMOKING PROHIBITED<br />
3.835.010 Purpose.<br />
3.835.020 Definitions.<br />
3.835.030 Smoking prohibited in public places.<br />
3.835.040 Smoking prohibited in places <strong>of</strong> employment.<br />
3.835.050 Smoking prohibited in specified outdoor areas.<br />
3.835.060 Exceptions.<br />
3.835.070 Signs required.<br />
3.835.080 Enforcement.<br />
3.835.090 Additional private prohibitions.<br />

3.835.010 Purpose. It is recognized that smoking <strong>of</strong> tobacco-related products is hazardous to<br />
the health <strong>of</strong> both smokers <strong>and</strong> nonsmokers who are exposed to smoke/smoking.<br />
Reliable scientific studies, including studies conducted by the Surgeon General <strong>of</strong> the<br />
United States, have shown that breathing sidestream or secondh<strong>and</strong> smoke is a<br />
significant health hazard to nonsmokers, particularly to children, elderly people,<br />
individuals with cardiovascular disease, <strong>and</strong> individuals with impaired respiratory<br />
function, including asthmatics <strong>and</strong> those with obstructive airway disease. Health hazards<br />
induced by breathing sidestream or secondh<strong>and</strong> smoke include lung cancer, respiratory<br />
infection, decreased respiratory function, decreased exercise tolerance,<br />
bronchoconstriction, <strong>and</strong> bronchospasm. This ordinance is adopted for the purpose <strong>of</strong><br />
protecting the public health, safety, comfort, <strong>and</strong> general welfare <strong>of</strong> the people <strong>of</strong> the<br />
<strong>Village</strong> <strong>of</strong> <strong>Hobart</strong>.<br />
3.835.020 Definitions. For purposes <strong>of</strong> this chapter, the following terms have the meaning:<br />
A. Adult day care facility has the meaning set forth in section 49.45(47)(a), Wis.<br />
Stats.<br />
B. Bed <strong>and</strong> breakfast establishment has the meaning set forth in section<br />
254.61(1), Wis.Stats.<br />
C. Child care facility shall mean any licensed or certified child care facility<br />
