3.835.090 Additional private prohibitions. Nothing in this ordinance shall prevent a proprietor<br />

or other person in charge <strong>of</strong> any place from prohibiting smoking in any indoor or outdoor area<br />

under their control.<br />

3.835.100 Other applicable laws or regulations. This chapter shall not be interpreted or<br />

construed to permit smoking where it is otherwise restricted by any other law or regulation.<br />

3.835.120 Penalty. Any individual who violates any provision <strong>of</strong> this chapter shall be required to<br />

forfeit not less than $100.00 nor more than $250.00/violation. Persons in charge or business<br />

owners can be fined $100.00/day for violating this law. Each day <strong>of</strong> violation shall constitute a<br />

separate <strong>of</strong>fense.<br />

3.835.130 Severability. The provisions <strong>of</strong> this ordinance are severable. If any provision <strong>of</strong> this<br />

ordinance is invalid or if the application <strong>of</strong> any provision to any person or circumstance is invalid,<br />

such invalidity shall not affect the provisions or the applications <strong>of</strong> such, or the remaining provisions<br />

which can be given effect without the invalid provisions or invalid application.<br />

3.835.140 Effective date. The provisions <strong>of</strong> this chapter shall become effective upon publication.<br />

3.9 - FIRE PREVENTION ORDINANCE<br />

3.9 FIRE PREVENTION<br />

Except as otherwise specifically provided in this Code <strong>of</strong> Ordinances, all provisions <strong>of</strong><br />

Chapter Comm. 14 <strong>of</strong> the Wisconsin Administrative Code, as now enacted <strong>and</strong> as may be<br />

amended hereafter, describing <strong>and</strong> defining regulations with respect to general hazard fire<br />

prevention <strong>and</strong> for which the penalty is a forfeiture only, including the penalties to be imposed<br />

<strong>and</strong> the procedure for prosecution, are hereby adopted <strong>and</strong> by reference made a part <strong>of</strong> this<br />

ordinance as if fully set forth herein. Any act required to be performed by any administrative code<br />

or statute incorporated herein by reference is required by this ordinance, <strong>and</strong> any act which is<br />

prohibited by any statute or administrative code provision incorporated herein by reference is<br />

prohibited by this ordinance.<br />
