2). Chimney Heights <strong>and</strong> Fuel Device Location.<br />

a. 25’ from nearest side or rear property line.<br />

b. 100’ from any road.<br />

c. 25’ from any structure.<br />

d. 15’ minimum chimney height.<br />

e. 2’ above the highest eve line <strong>of</strong> any building within 100’.<br />

f. Chimney shall be supported to withst<strong>and</strong> winds up to 90 miles<br />

per hour.<br />

e). Existing outdoor solid fuel heating devices: All existing units shall<br />

immediately comply with all manufacturer’s specifications <strong>and</strong> subject to 2.d)1),<br />

entitled fuel requirements within 30 days from effective date <strong>of</strong> this ordinance.<br />

All existing nonconforming devices upon the compliant <strong>of</strong> a <strong>Village</strong> resident<br />

shall be removed, replaced, or modified to meet the requirements <strong>of</strong> this<br />

ordinance within 45 days <strong>of</strong> notification <strong>of</strong> noncompliance from the <strong>Village</strong><br />

Building Inspector, Police Department, or other <strong>Village</strong> <strong>of</strong>ficer or agent.<br />

f). Permits.<br />

1). No person shall allow, maintain or use an outdoor wood furnace in<br />

the <strong>Village</strong> <strong>of</strong> <strong>Hobart</strong> without first having obtained a permit from the<br />

<strong>Village</strong> Zoning Administrator on the forms prescribed by such <strong>of</strong>ficial.<br />

Permit fee per schedule.<br />

2). Violations: A permit may be suspended in the event the owner fails<br />

to comply with this ordinance.<br />

3). Penalty: Any person who constructs, erects, or fails to remove,<br />

replace, or modify any outdoor solid fuel-fired heating devices that does<br />

not meet the requirements <strong>of</strong> this ordinance shall forfeit $25.00 per day<br />

for each day the non-complying unit remains on the premises.<br />
