Mr. Young has since found marihuana to be an effective medication for alleviating the symptoms of his condition. Many of the medications otherwise available to Mr. Young have serious health-related side effects that he wishes to avoid. [8] In June 1999, Mr. Young obtained a medical prescription for marihuana for the treatment of his condition. He
Young v. Saanich Police Department, et al Page 7 subsequently applied to the Minister of Health for an exemption permitting him lawful access to marihuana for medicinal purposes. [9] On March 10, 2000, Health Canada advised Mr. Young by letter that his application had been favourably reviewed. Pursuant to s. 56 of the CDSA, the Minister of Health granted Mr. Young an exemption from the application of various 2003 BCSC 926 (CanLII) provisions of the CDSA. Mr. Young was thereby permitted to lawfully possess and produce marihuana subject to certain restrictions, including conditions that the marihuana be used solely for personal use in the treatment of his medical condition and that he not allow any other person to use his supply of marihuana. [10] The letter stated that the exemption would expire on September 11, 2000, subject to renewal. The letter also contained the following paragraph: Further to your consent (see form attached), your name, date of birth and details of this exemption will be provided to police agencies in order to limit the risk that you may be inadvertently arrested or charged by the police. You should also carry this exemption with you whenever you are in physical possession of the controlled substance, to show that you have received an exemption from the Minister of Health.
