DRAFT<br />
• After <strong>the</strong> student has presented his or her response, he or she may present witnesses<br />
on his or her behalf;<br />
• Any verbal abuse or threats directed <strong>to</strong>ward members of <strong>the</strong> SCRC or any of <strong>the</strong> hearing<br />
participants is a violation of <strong>the</strong> <strong>Student</strong> Code of Conduct and will result in <strong>the</strong> discontinuance<br />
and/or rescheduling of <strong>the</strong> hearing.<br />
After all <strong>the</strong> evidence has been presented, <strong>the</strong> SCRC shall immediately deliberate <strong>to</strong> come <strong>to</strong> a<br />
recommendation according <strong>to</strong> <strong>the</strong> following procedures:<br />
• The vote will be by secret, paper ballot <strong>to</strong> be collected and counted by <strong>the</strong> chairperson;<br />
• Every member, including <strong>the</strong> chairperson, has one vote;<br />
• To vote that a violation of <strong>the</strong> <strong>Student</strong> Code of Conduct has occurred, <strong>the</strong> SCRC members<br />
must be convinced by mere preponderance of <strong>the</strong> evidence that a violation has occurred;<br />
• Each vote must specify <strong>the</strong> member’s decision on two items: (1) whe<strong>the</strong>r a violation of <strong>the</strong><br />
<strong>Student</strong> Code of Conduct has occurred; and if so (2) if <strong>the</strong> disciplinary action imposed by<br />
<strong>the</strong> Associate Vice Chancellor of <strong>Student</strong> Services or designee was proper given <strong>the</strong><br />
circumstances;<br />
• To reach a recommendation, three of <strong>the</strong> five SCRC members must agree that a violation of<br />
<strong>the</strong> <strong>Student</strong> Code of Conduct has occurred. If three of <strong>the</strong> five so agree, <strong>the</strong>n <strong>the</strong>re must be a<br />
majority of <strong>the</strong> members in agreement as <strong>to</strong> <strong>the</strong> recommendation regarding disciplinary action<br />
<strong>to</strong> be taken, if any;<br />
• Upon reaching an agreement, <strong>the</strong> chairperson will reduce <strong>the</strong> recommendation(s) <strong>to</strong> writing,<br />
which will be signed by each committee member, <strong>the</strong>n forwarded <strong>to</strong> <strong>the</strong> Vice Chancellor of<br />
<strong>Student</strong> Services and <strong>the</strong> Campus President.<br />
SCRC RECOMMENDATIONS<br />
The SCRC may make one of <strong>the</strong> following recommendations or o<strong>the</strong>r recommendations relating<br />
<strong>to</strong> <strong>the</strong> resolution of <strong>the</strong> matter:<br />
• Uphold <strong>the</strong> disciplinary action imposed by <strong>the</strong> Associate Vice Chancellor of <strong>Student</strong> Services<br />
or designee<br />
• Withdraw <strong>the</strong> disciplinary action imposed by <strong>the</strong> Associate Vice Chancellor or designee<br />
• Impose a lesser or greater disciplinary action.<br />
The Vice Chancellor of <strong>Student</strong> Services, within seven (7) days, shall re<strong>view</strong> <strong>the</strong> recommendations<br />
of <strong>the</strong> SCRC and provide <strong>the</strong> student written notification of his/her final decision and shall provide a<br />
copy of that decision <strong>to</strong> <strong>the</strong> Campus President, <strong>the</strong> Associate Vice Chancellor of <strong>Student</strong> Services or<br />
designee, and <strong>the</strong> SCRC committee chairperson. The decision of <strong>the</strong> Vice Chancellor is final. The<br />
Office of <strong>the</strong> Vice Chancellor will be <strong>the</strong> official reposi<strong>to</strong>ry of records regarding decisions or actions<br />
involving <strong>the</strong> process SCRC. (?)<br />
The SCRC recommendation(s) sent <strong>to</strong> <strong>the</strong> Vice Chancellor of <strong>Student</strong> Services, Associate Vice<br />
Chancellor of <strong>Student</strong> Services or designee and <strong>the</strong> Campus President is/are confidential and will<br />
remain confidential. Should <strong>the</strong> student or person bringing <strong>the</strong> complaint or any witness voluntarily fail<br />
<strong>to</strong> appear before <strong>the</strong> SCRC after receiving notification, <strong>the</strong> SCRC has full authority <strong>to</strong> proceed <strong>to</strong><br />
a recommendation.<br />
