9.8.2001 is reproduced as under:<br />
Prior to 09.8.2001<br />
103. Notwithstanding anything<br />
contained in these regul<strong>at</strong>ions, where any<br />
teacher or employee <strong>of</strong> ministerial grade<br />
<strong>of</strong> any recognised, aided institution, who<br />
is appointed accordingly with prescribed<br />
procedure,dies during service period,<br />
then one member <strong>of</strong> his family, who is not<br />
less than eighteen years in age, can be<br />
appointed on the post <strong>of</strong> teacher in<br />
trained gradu<strong>at</strong>e grade or on any<br />
ministerial post, if he possesses<br />
prescribed requisite academic<br />
qualific<strong>at</strong>ions, training eligibilities, if any,<br />
and he is otherwise fit for appointment :<br />
Provided th<strong>at</strong> anything contained in<br />
this regul<strong>at</strong>ion would not apply to any<br />
recognised aided institution established<br />
and administered by any minority class.<br />
Explan<strong>at</strong>ion.- For the purpose <strong>of</strong> this<br />
regul<strong>at</strong>ion "member <strong>of</strong> the family" means<br />
widow or widower, son, unmarried or<br />
widowed daughter <strong>of</strong> the deceased<br />
employee.<br />
Note.- This regul<strong>at</strong>ion and<br />
Regul<strong>at</strong>ions 104 to 107 would apply in<br />
rel<strong>at</strong>ion to those employees who have died<br />
on or after 1 January, 1981."<br />
On & After 09.8.2001<br />

Thus the real distinction between two<br />
above is the 'proviso'.<br />
12. The validity <strong>of</strong> notific<strong>at</strong>ion d<strong>at</strong>ed<br />
9th August,2001 deleting proviso to<br />
Regul<strong>at</strong>ion 103 came to be challenged in<br />
writ petition Committee <strong>of</strong><br />
Management, MAH Inter College &<br />
Another Vs. District Inspector <strong>of</strong><br />
Schools, Ghazipur and others 2002 (2)<br />
UPLBEC 1742. This <strong>Court</strong> held the said<br />
notific<strong>at</strong>ion viol<strong>at</strong>ive <strong>of</strong> Article 30 <strong>of</strong> the<br />
Constitution and hence quashed the same.<br />
13. It is thus contended th<strong>at</strong> earlier<br />
Regul<strong>at</strong>ion continued to oper<strong>at</strong>e, and,<br />
hence no right was available to an<br />
employee, teaching or non teaching, <strong>of</strong><br />
minority institution, to claim a vested<br />
right <strong>of</strong> compassion<strong>at</strong>e appointment<br />
therefore, the impugned orders are wholly<br />
illegal and without jurisdiction.<br />
14. Per contra, learned counsel<br />
appearing for respondents No.6 st<strong>at</strong>ed th<strong>at</strong><br />
decision <strong>of</strong> learned Single Judge in
