2.25 Arbitration and Jurisdiction:

penalize the bidder to the extent of cancelling the empanelment of the
bidder , without assigning the reasons thereof.
2.25.1 All disputes or differences arising under, out of or in connection with this contract
shall be referred for arbitration by an Arbitrator to be appointed by an officer,
who is the administrative head of BHEL, …..(Location). The Arbitration shall be
conducted and governed in accordance with the provisions of the current version
of Indian Arbitration and Conciliation Act 1996 or rules framed thereunder. The
award of the Arbitrator shall be final and binding on both the parties. The
Arbitrator shall have the power to extend time for arbitration proceedings and
making of the award with the consent of the parties.
2.25.2 All disputes or differences arising out of, under or in connection with this contract
shall be subject to the exclusive jurisdiction of the courts having jurisdiction over
BHEL, ….(Location)..
2.25.3 This contract shall be governed in all respects by Indian law.
