them under this article the competent authority shall have access to the<br />

facilities and machinery as well as to the signalling devices.<br />

Article-204-The sea information collected during activities of research or exploitation of<br />

mineral substances in the algerian maritime areas shall be transmitted to the<br />

competent authorities by the persons referred to in article 203 above.<br />

Article-205-The port legislation shall be applicable to the signalling of the facilities and<br />

machinery referred to in article 198 as well as of the safety zones specified in<br />

article 201 above. To this end the person conducting, on the facilities and<br />

machinery, research or exploitation works shall be considered, towards the<br />

competent authorities, as the captain or the employer for the purposes of the<br />

said articles.<br />

In all cases such person shall come under the competent jurisdiction in<br />

accordance with the laws and regulations in force.<br />

Article-206-The owners or operators shall be bound to lift totally the facilities and machinery<br />

which are no more used. If necessary they shall receive a formal notice to fulfil<br />

such obligation and the time limits shall be fixed to them for the start and<br />

completion of works.<br />

In case of refusal or negligence in the performance of such works, the same<br />

may be executed automatically at the owners or operator’s costs and risks.<br />

In such case the owners or operators may lose their rights on the said<br />

facilities and machinery.<br />

CHAPTER - 2 SPECIAL FISCAL PROVISIONS FOR SEA MINING ACTIVITY<br />

Article-207-In accordance with article 2 herein, the products extracted from the maritime<br />

areas subject to the <strong>Algeria</strong>n jurisdiction shall be considered, with regard to<br />

customs regulations, as extracted from a new part of the customs territory as<br />

stipulated in article 1 of the customs code. For the application of the tax<br />

legislation the same products shall be considered also as extracted from the<br />

national terrritory.<br />

Article-208-A register of mineral and fossil substances shall be kept in the facilities and<br />

machinery specified in article 198 hereabove. The form in which such register<br />

shall be kept and the notices to apear thereon shall be specified by regulatory
