The City of Playford recognises the need
to provide the community with “best
value” services. Through a consultative
approach with the workforce, Council has
developed its Service Delivery Policy that
specifies that Council will not undertake
competitive tendering during the life of the
Joint Enterprise Agreement. The Service
Delivery policy has specific principles directly
linked to continuous improvement and
skills development to ensure Council’s
internal service providers are competitive
and continue to provide a high level
of efficiency and cost-effectiveness.
Council’s Purchasing Policy states
“Council will support industry in the
Playford area where that industry is
competitive as to quality, quantity required,
lead time for supply and price”.
Council supports the application of
Service Delivery and
Competition Principles
The City of Playford recognises the need
to provide the community with “best
value” services. Through a consultative
approach with the workforce, Council has
developed its Service Delivery Policy that
specifies that Council will not undertake
competitive tendering during the life of the
Joint Enterprise Agreement. The Service
Delivery policy has specific principles directly
linked to continuous improvement and
skills development to ensure Council’s
internal service providers are competitive
and continue to provide a high level
of efficiency and cost-effectiveness.
Council’s Purchasing Policy states
“Council will support industry in the
Playford area where that industry is
competitive as to quality, quantity required,
lead time for supply and price”.
Council supports the application of
Competition Principles. Council does not
have any significant businesses in relation
to category 1. No in-house tenders have
been let during the year. No complaints were
received regarding competitive neutrality.
Community Land
Management Plans
All fifteen categories of Community Land
Management Plans were completed by
11 November 2004. Council is now reviewing
and updating these plans as required.
Gawler River Floodplain Management Authority Annual Report 2004 - 2005

The often-posed question "What came first, the chicken or the egg" has a strange but threatening
resemblance to the question "What comes first, the mitigation dam or the flood". Now almost
thirteen years into an average ten-year flood cycle the proposed works to alleviate flood damage in
the Gawler River area are still on the horizon but not at the time of writing guaranteed.
Planning for the three phase program is well advanced; procurement of the property (and home)
most affected by the mitigation dam construction has been negotiated; various departments of
government have been consulted; the six Local Government Councils in the Gawler Catchment
Area have reiterated that the work is essential; and the State Government has agreed the required
work is of high priority.
However, resolution on payment remains the prime issue, which continues to occupy attention at
an increasing number of meetings. It is not unrealistic to pose which comes first “the dam or the
flood".

The Gawler River Floodplain Management Authority (GRFMA) was formed as a Regional
Subsidiary under Section 43 and Schedule 2 of the Local Government Act 1999, by a Charter
published in The South Australian Government Gazette on 22 nd August 2002. The Constituent
Councils are the Adelaide Hills Council, The Barossa Council, The Town of Gawler, Light Regional
Council, District Council of Mallala and the City of Playford.
The Charter provides that a representative of the Northern Adelaide and Barossa Catchment
Water Management Board (NABCWMB) is the Chairperson of the Board of Management of the
GRFMA. The Charter sets down the powers, functions, safeguards, accountabilities and an
operational framework and the Business Plan sets down the operational plan and financial plan to
achieve agreed objectives.
The GRFMA has been established for the following purposes:
1. To co-ordinate the construction, operation and maintenance of flood mitigation infrastructure
in the Gawler River area (the Floodplain);
2. To raise finance for the purpose of developing, managing and operating and maintaining
flood mitigation works within the Floodplain;
3. To provide a forum for the discussion and consideration of topics relating to the Constituent
Council’s obligations and responsibilities in relation to management of flood mitigation within
the Floodplain;
4. To enter into agreements with Constituent Councils for the purpose of managing and
developing the Floodplain.

A Key Outcomes Summary is prepared following each Board Meeting that highlights the key issues
and achievements and is distributed to Stakeholders electronically. The Board also provides a
Quarterly Report to its Constituent Councils.
Mr Fred Pedler, Principal of Fred Pedler & Associates, has been engaged to provide Executive
Officer services under a services agreement until 31 st December 2006. Mr Pedler has experience
in the administration of Councils and regional subsidiaries under the Local Government Act.
The following Policies have been adopted to provide management guidelines for the day-to-day
business of the GRFMA:
Policy A1 - Access to Meetings and Documents
Policy C1 - Consultation
Policy I1 - Internal Review of Decisions
Policy O1 – Operations Manual
In September 2004 the Board published a Progress Report to Stakeholders that outlined the
progress in implementing the Gawler River Flood Mitigation Scheme as a follow up to the Public
Notification Strategy of 2003.
Key Issues Before the Board
Cost of the Scheme
Following the Stage 2 designs for the proposed flood control dam, and the Dam Safety Review and
Stage 1 designs for the flood control modifications to the South Para Reservoir, amended cost
estimates for the Scheme were received based on the detailed assessments so far.
The estimated costs are:
Scheme Part
Estimate based on
1994 Proposal
$ Millions
Estimate based on
Stage 2 Studies
$ Millions
South Para Flood Control Dam $7.190 $14.706
Modify South Para Reservoir $0.838 $1.826
Lower Gawler River Works $1.002 $1.080

The Stage 2 studies have found that the previous estimates were based on limited studies first
undertaken in 1994. While the new estimates contain significant contingencies it was noted that

Gawler River Floodplain Management Authority Annual Report 2004 - 2005
they are still subject to review as part of the final Stage 3 Detailed Design and that the Lower
Gawler River Works estimates are based on the proposal of ID&A Pty Ltd dated 2001.
The detailed design of the Scheme is proceeding within the budget estimates for the design and
with grant funding in place. It is the estimated construction costs that have increased which have
placed the project at risk.
At a cost of $17.612 million is the Scheme still cost effective
Following advice of the higher estimated costs Australian Water Environments in association with
Scholefield Robinson Horticultural Services prepared a Cost Benefit Analysis that included a full
inundation and damages assessment of all flood prone land. They reported:
In sum m ary three alternative dam age scenarios have been considered and theirdam age estimates are provided in
the table below .
1. Directcosts plus IndirectTangible costs thatcould be quantified.
2. Directcosts less an allow ance forflood warning reducing the dam age costs to residentialand com m ercial
buildings to 60% oftheirpotentialvalue, plus IndirectTangible estimated as a proportion (25% )ofDirect
costs.
3. Directcosts, less the above allow ance forflood warning, plus IndirectTangible costs and Intangible costs
estimated as a proportion (25% and 100% respectively)ofDirectcosts.
Summary ofPotentialFlood Damages ($M illions)
EventARI 1 in 10 1 in 40 1 in 100
Alternative 1 $3.5 $18.9 $103.2
Alternative 2 $4.2 $19.32 $112.5
Alternative 3 $7.2 $36.32 $209.5
The average annual dam age avoided by the m itigation schem e w as calculated for each scenario. The average
annualdam age avoided was then converted to a PresentValue (PV )assum ing 7% discountrate overa thirty-year
time. The PresentValue ofthe mitigation works were also estimated assum ing thatthe works would be staged
over a two-year period and w ould resultin an annualaverage m aintenance cost of $10,000.The NetPresent
Value (NPV)was then calculated as the difference between the two figures, and the BenefitCostratio (B/C)as
the ratio ofthe PresentValue ofthe dam ages avoided to the PresentValue ofthe construction and operation of
the flood mitigation schem e.
The results are sum m arised below .
Scenario PV ($m ) NPV ($m ) B/C
Alternative 1 24.9 7.2 1.4
Alternative 2 26.9 9.2 1.5
Alternative 3 49.6 31.9 2.9
The results clearly dem onstrate thatthe schem e is econom ically viable with the low range estimate (Alternative
1)having a benefitcostratio of1.4.Conversely ifthe schem e were notto proceed there is the potentialto incura
presentvalue loss ofup to $31.9 million.
Is there any other Option to manage the risks from flooding other than to build the Scheme
The Board adopted an Options Paper that discusses the risks and options that now face the
Councils and summarises that there is no other option to mitigate the risks facing the community
from future flooding from the Gawler River than to build the Flood Mitigation Scheme. The Paper
also found that there are no other sources of local grants that could assist the Councils to raise the
one third share of the Scheme and proposed that the Constituent Councils increase their
commitment to the Scheme from $3.01 million to $5.873 million (including a contribution of
$406,350 from the NABCWMB).
What are the Loan Funding Options
The Board prepared a Discussion Paper – ‘Loan Fund Options to Fund the Local Contribution’ that
was forwarded to the Constituent Councils to be considered in conjunction with the GRFMA
Options Paper – Review of GRFMA Business Plan 2002 – 2006 to fund the Scheme. The Paper
explores the option of borrowing the Local Contribution on behalf of Councils and provides a range
of data for loans with a term from 5 to 100 years.

Gawler River Floodplain Management Authority Annual Report 2004 - 2005
Recommitment from the Constituent Councils
The current Business Plan 2002 – 2006 (adopted on 3 rd April 2003 and amended on 19 th February
2004) provides that the Local Contribution to fund the Scheme is by the Constituent Councils and
the NABCWMB to an agreed 4-year plan. That Plan contains the following note:
Itshould be noted thatthe three upstream Councils, nam ely Adelaide Hills Council,The Barossa Counciland the
Light Regional Council have joined the Schem e follow ing negotiation and w hile they have agreed to their
percentage share, theirdollarcontribution is limited to the projectbeing costed at$9.03 million with respective
maximum cash contributions of$45,150,$225,750,$225,750 respectively.
The process to change that financial arrangement is by way of amending the Plan.
A Draft Business Plan 2002 – 2007 to accompany a Draft Budget 2005 – 2006 was provided for
Consultation to the Constituent Councils. The Drafts consolidated information provided to Councils
in the Options Paper and the Loan Options Discussion Paper.
In February 2005 the Local Government Association Mutual Liability Scheme joined with the Board
to encourage Councils to recommit to fund the Gawler River works, as it considers that the
construction of the Scheme is the most cost effective way to manage the possible risk of claims for
damages against Councils arising from flooding of the Gawler River. Part of their support to
Councils was the provision of legal advice particularly on the question of legal liability of the
upstream Councils, as both Light Regional Council and The Barossa Council had taken Queen’s
Counsel advice on this question. The following is the response from The Barossa Council:
‘ the letter of 11 M arch 2005 from the Schem e reflects… legal obligations to participate in,and fund,the
mitigation schem e”. Itwas in this context that the opinion of David G reenw ellw as sought. However, the
opinion reflects in sum m ary, thatwhilst upstream C ouncils m ay be atrisk w here they have undertaken w orks
thatincrease the w ater flow into tributaries of the Gawler River or have failed to actin lightof know n flood
risks, “a Plaintiffwillhave great difficulty in substantiating claim s against any of the participant Councils
because ofthe nature ofthe river …”. C onsequently, the basis upon which upstream Councils should participate
and contribute to the resolution of the m atter is suggested to be on a “m oral” and “w hole of catchm ent”
approach.
This is nota dissimilarconclusion to the advice we have received from Counseland which, when formulated in
writing, will be provided to you. If anything, our advice is stronger in that it em phasises that functional
responsibilities ofthe Councilextend only within its ow n boundaries and in the absence ofany works undertaken
within ourarea which positively contribute to dow nstream flooding, there are no liability issues thatwillaffect
us. In this regard Ican confirm thatwe have notundertaken any works which would affectus in this regard in
terms ofliability.
As you willappreciate, this was notthe tenororthe contentofadvice thathas been provided to the Councilin
the past suggesting at least a com m on law liability for failing to exercise a “duty” to participate in flood
m anagem entand suggesting thatthe Councilis com pelled to participate or cooperate w ith flood m anagem ent
strategies. This is reflected in the extracts from the Crow n Law advice quoted in David Greenw ell’s opinion.
Itwas as a directresultofrepresentations ofthis nature,in particular from the Catchm entWater M anagem ent
Board, thatthe Councilbecam e a constituentcouncilof the A uthority. Indeed, itis fairto say thatthe total
involvem ent and participation of this C ouncilin the A uthority has been predicated on the basis of a risk of
liability forfailing to participate and contribute.
The advice thatw e have now received suggests that,at best, there is no responsibility or risk ofliability for
failing to participate and, atworst, only a moraland collaborative responsibility to do so.’
The Light regional Council has expressed similar views. Both the Light Regional Council and The
Barossa Council have advised that while they continue to support the construction of the Scheme,
however they will not increase their initial commitment of $225,750. The other four Councils have
agreed to increase their contributions, however some have required that all Councils contribute to
the increased costs.
In April 2005, the Local Government Association was asked to become involved in the discussions
between the six Constituent Councils and the Board to secure an agreement to fund the local
contribution of the cost of the Gawler River Flood Mitigation Scheme. This decision was taken as
the responses from Councils at that time indicated that, while all Councils continue to support the
construction of the Scheme, the group of Councils were unable, with the contribution from the

Gawler River Floodplain Management Authority Annual Report 2004 - 2005
Northern Adelaide Barossa Catchment Water Management Board (NABCWMB), to come to an
agreement to share the local contribution funding for the project to proceed.
Notice from Light Regional Council
In late June The Light Regional Council served notice under the provisions of the Charter that
unless it’s offer of $225,750 is accepted by the Board and all Councils, it will make application to
the Minister to withdraw from the Authority on 30 th June 2006.
Government Funding Shares
The current agreed funding for the scheme is one third Commonwealth, State and Local
Contributions.
The State Government has advised that ‘it would need to be satisfied that the Constituent Councils
will collectively increase their contribution to $5.9 million to meet one third of the cost.’
The Member for Wakefield, Mr David Fawcett MHR, has lobbied the Federal Minister for Local
Government Territories and Roads, The Hon Jim Lloyd, MHR, for a review of the shares of the
funding arrangement for the Scheme and facilitated a submission by the Board under the ‘Special
Circumstances’ provisions of the Regional Flood Mitigation Scheme. In June the Minister advised
that:
‘Itis clear thatthe Schem e requires a m ajor financialcom m itmentfrom the group of councils involved and I
appreciate som e councils'concerns abouttheircapacity to fund theirshare of these w orks. However,I should
em phasise that the initial assessm ent and recom m endation of projects, and the determination of the level of
funding,is the responsibility ofthe state governm ent.’
While discussions with the Federal Minister’s office and State officers suggest the possibility of
renegotiating the shares of contribution to the Scheme the inability to reach a local agreement
remains a major obstacle to effectively progressing these discussions.
Change of Ministerial Responsibility
In June the Gawler River Flood Mitigation Scheme was brought under the portfolio of Hon Patrick
Conlon MP, one of the most senior members of the South Australian Government and who is
responsible for the key portfolios of Energy, Infrastructure and Transport. The scheme is scheduled
in the Strategic Infrastructure Plan for South Australia as ‘underway’ to be delivered by 2010.

A Technical Assessment Panel has been appointed to support the decision-making processes of
the Board with the following delegated powers:
The power to approve the wording and accuracy of technical drawings in contract
documents, performance specifications, land acquisition documentation, documents of a
technical nature; directly related to the achievement of the Business Plan.
To make a record of all actions taken and to submit that report to the next Board Meeting.

The NABCWMB has developed and coordinated the implementation phase of the Gawler River
Flood Mitigation Scheme. The Scheme includes a mixture of flood warning; physical works and
planning measures that collectively will reduce flood risk and flood damages. Many of the nonstructural
measures have already been implemented and so the main items remaining are the
large capital works (Scheme) necessary to mitigate floodwaters in the Gawler River system.
The Scheme has three parts:
Building a Flood Control Dam on the North Para River near Gawler.
Enhancing the flood attenuation capabilities of the South Para Reservoir
Undertaking sensitive, capacity improvement measures for the lower reaches of the
Gawler River.
Dam Design
URS Australia Pty Ltd of Kent Town was engaged in July 2003 to design the Flood Control Dam in
a three-phase process that is in its final stage.
The key design and hydraulic features of the flood control dam include:

A Roller Compacted Concrete (RCC) main dam section that will be 25 meters above the river
bed and have a crest 220 meters wide with a level of RL82.5 m, a low level outlet 2.1 metres
diameter at RL 57.5 m to maintain environmental flows and two high level outlets, 1.8 metres
in diameter at RL 70.00 m to mitigate flows, that will retain the water up to the 1 in 100 year
flood event without water passing over the crest of the dam.
A RCC secondary spillway, 220 metres wide with a crest level of RL84.0 m, will be
constructed on the left abutment adjoining the dam structure.

Gawler River Floodplain Management Authority Annual Report 2004 - 2005

The main dam will act as the primary spillway for events greater than the 1 in 100 year flood
up to about the 1 in 1,000 year flood event that will generate an upstream water level of
RL84.0 m and a depth of flow of 1.5 m over the main dam.
For greater than 1 in 1,000 year flood events water will begin to flow over the secondary
spillway. The 1 in 10,000 year flood event will generate an upstream reservoir level of just
above RL85.0 m and flows will be passed over the main spillway and the secondary spillway,
confined by RCC “end blocks” and walls that will be constructed to RL85.0 m. The depth of
flow over the main spillway will be 2.5 m and the depth of flow over the secondary spillway
will be 1.0 m.
A ‘Right to Flood’ easement will be sought from landowners above the dam for all land below the
84.0 m level which is all land that will be inundated by a 1 in 1,000 year flood event.
The Stage 3 draft dam design and tender documentation and plans have been completed and are
currently being independently reviewed prior to their consideration for adoption.
South Para Reservoir
SA Water Corporation, the operators of the South Para Reservoir, engaged GHD Pty Ltd who have
completed a Stage 2 Safety Review and Conceptual Design of Flood Mitigation and Remedial
Works for the South Para Reservoir. The proposed mitigation works that include modifications to
the dam wall and spillway would be undertaken at a cost to the Scheme.
Lower Gawler River
Australian Water Environments, Engineers of Norwood, was awarded the Lower Gawler River
assessment and detailed design project. The GRFMA wrote to all property owners in the study
area advising them of the study, the powers of the consultant to enter their property and a survey
about the levees, vegetation and obstructions in the river valley to guide the work of the consultant.
The brief includes a review of the Lower Gawler River hydrology, including the preparation of post
mitigation works flood inundation plans for a 100 ARI event. An ecological assessment for the
removal of exotic weeds and trees to improve the flow of floodwaters in the river valley and of a
possible impact on the Buckland Park wetland.
The Panel, through the support of Transport SA Drainage Branch, have reviewed the spillway
configuration of the South Para Reservoir that has enhanced the mitigation performance of the
dam that will deliver significant down stream benefit.
Based on this improved model work has commenced on the first stage of the three dimensional
modelling of the Lower Gawler River that will provide essential data to design the extent and
location of capital works on the floodplain.
Approvals
Approvals for the Scheme have yet to been obtained for development approval under the
provisions for Crown Development (Public Infrastructure), Section 49 of the Development Act and
for the removal of native vegetation from the Native Vegetation Council under the provisions of the
Native Vegetation Act 1991
Northeast Road Connector
The Department of Transport and Urban Planning has been advised that detailed design for a
Roller Compacted Concrete (RCC) dam at Site 1 near Gawler is now proceeding and that the
proposed ‘dam wall and in line saddle spillway’ will not be suitable to be combined with a bridge
structure which was an option being considered as part of a Northeast Gawler Bypass Study.
We have audited the attached special purpose financial report on pages 1 to 8 comprising the
Operating Statement, Statement of Financial Position, Statement of Changes in Equity,
Statement of Cash flows, Notes to the Financial Statements and Statement by the Executive
Officer for the year ended 30 th June 2005. Gawler River Floodplain Management Authority’s
Board is responsible for the preparation and presentation of the financial report and the
information contained therein, and has determined that the accounting policies used are
consistent with the financial reporting requirements of their constitution and are appropriate to
meet the needs of the members. We have conducted an independent audit of the financial
statements in order to express an opinion on them. No opinion is expressed as to whether the
accounting policies used are appropriate to the needs of the members.
The financial report has been prepared for distribution to members for the purpose of fulfilling the
Authority’s financial reporting requirements. As such, we disclaim any assumption of responsibility
for reliance on this report or on the financial report to which it relates to any person other than the
members, or for any purpose other than that which it was prepared. The audit has been
conducted in accordance with the Australian Auditing Standards to provide reasonable assurance
as to whether the financial statements are free of material misstatement. The procedures included
an examination, on a test basis, of evidence supporting the amounts and other disclosures in the
financial statements, and evaluation of accounting policies and significant account estimates.
These procedures have been undertaken to form an opinion as to whether in all material
respects, the financial statements are presented fairly in accordance with the accounting policies
described in Note 1 of the financial statements. (These policies do not require the application of
all Accounting Standards and other mandatory professional reporting requirements in Australia).
The audit opinion expressed in this report has been formed on the basis above.

In our opinion, the financial statements of the Gawler River Floodplain Management Authority are
properly drawn up in accordance with the accounting policies described in Note 1 to the financial
statements, and fairly present the financial position of the Gawler River Floodplain Management
Schedule of Constituent Council's Interests in Net Assets

"The ‘Schedule of Constituent Councils’ Interests in Net Assets’ will reflect the proportionate contribution
each Constituent Council has made to the growth of the net assets of the Authority having regard to the
proportionate contribution to subscriptions. The Schedule when updated by the Board at the end of each
financial year will reflect the proportionate contribution of each Constituent Council since the
commencement of the Authority and once accepted by each Constituent Council will be evidence of the
agreed proportion of a Constituent Council’s interests in the net assets as at 30 June in that year."
For the purposes of this Clause only Subscriptions for Scheme costs have been included in subscriptions
to the growth of assets
This Schedule has been prepared on the basis that the Authority was 'wound up' on 30th June 2005. At
that date the designs, assessments and cost of land have been capitalised at a cost of $728,142. Grants
and contributions from the Commonwealth Government, State Government and the NABCWMB have
holding an amount of State Government Grant paid in advance of $59,727. This calculation has been
