PRINCIPLES OF PUBLIC PROCUREMENT<br />

PART – 1<br />

GENERAL GUIDELINES<br />

13. <strong>Public</strong> Accessibility of <strong>Procurement</strong> Act, etc. |—For the purpose of making easily<br />

available the Act and the <strong>Rules</strong> made there under, orders, instructions, guidelines or other<br />

Documents to the general public, the CPTU shall perform the following responsibilities namely -<br />

(a) print and publish the Bangla version and the authentic English text of the Act,<br />

and these <strong>Rules</strong>;<br />

(b) publish from time to time the <strong>Procurement</strong>-related Documents needed to<br />

facilitate the conduct of <strong>Procurement</strong> activities by Procuring Entities;<br />

(c) make the Documents under Item (a) and (b) easily available to the general<br />

public in hard copy and post them on the CPTU website; and<br />

(d) ensure that these Documents are properly maintained and updated. .<br />

14. Forms of Communications |— (1) All communications between Procuring Entities<br />

and other parties participating in the <strong>Procurement</strong> process (such as Applicants, Tenderers,<br />

Suppliers, Contractors or Consultants), shall be in writing to ensure that all such communications<br />

are legally binding as confirmed by the signature of the sender or an authorised officer or nominee<br />

of the sender on the communication.<br />

(2) Communications made by fax or e-mail shall be confirmed by submission of a duly<br />

signed document by the sender or an authorised officer or nominee of the sender.<br />

(3) For e-GP, the provisions of Chapter Eight shall be applicable.<br />

15. <strong>Procurement</strong> Planning and Selection of <strong>Procurement</strong> methods |— (1) Prior to the<br />

preparation of a <strong>Procurement</strong> Plan in the case of splitting up a single procurement object into<br />

more than one package, the Procuring Entity shall decide on splitting the packages and the<br />

applicability of the <strong>Procurement</strong> methods considering the nature and size of the <strong>Procurement</strong>, by<br />

carefully reviewing the proposed <strong>Procurement</strong> activities and issues. .<br />

(2) <strong>The</strong> Procuring Entity shall take into account the following when determining the<br />

method of <strong>Procurement</strong> and consolidating of Goods packages:<br />

(a) type of goods to be procured;<br />

(b) estimated cost as approved by the HOPE or an officer authorised by him or her;<br />

(c) availability of the relevant Goods in the local market;<br />

(d) quality, sources and brand of the Goods available in the local market;<br />

(e) price levels of the designated Goods;<br />

(f) capacity of local Suppliers to supply the required quantities;<br />

(g) capacity of the national industry and quality of its products;<br />

(h) market conditions and expected competition;<br />

(i) urgency of the <strong>Procurement</strong>;<br />
