payment has been repaid, but the amount of the Guarantee shall be progressively reduced by the<br />

proportion of advanced amounts adjusted by the Contractor and no interest shall be charged on<br />

the advance payment.<br />

(13) <strong>The</strong> basis for payment shall be the Bill of Quantities used to determine the<br />

Contract Price.<br />

(14) <strong>The</strong> Contractor shall submit to the Project Manager monthly statements of the<br />

estimated value of the work executed less the cumulative amount certified previously.<br />

(15) <strong>The</strong> Project Manager shall check the Contractor’s monthly statement and certify the<br />

amount to be paid to the Contractor.<br />

(16) <strong>The</strong> value of work executed shall be determined by the Project Manager and shall<br />

comprise the value of the items completed as per the rates in the Bill of Quantities.<br />

(17) <strong>The</strong> Project Manager on the basis of information received later may ` exclude<br />

any item certified in a previous certificate or reduce the proportion of any item previously certified.<br />

(18) A Variation Order shall be prepared, following the provisions of <strong>Rules</strong> 78, 79 and 80,<br />

so long as the value of such additional Works does not exceed the threshold specified in<br />

Schedule II.<br />

(19) <strong>The</strong> value of work executed shall include the valuation of approved Variations and<br />

Compensation Events.<br />

(20) If the final quantity of the work done for any particular item increases from the<br />

quantity in the Bill of Quantities by more than twenty-five percent (25%), the Project Manager shall<br />

adjust the unit rate for that particular item to allow for the change within the context and threshold<br />

of the Variation Order, provided that the change in each case exceeds one percent (1%) of the<br />

Initial Contract Price.<br />

(21) Necessary adjustments of payable amounts on account of advance payments and<br />

retention money, where applicable shall have to be made.<br />

(22) <strong>The</strong> Procuring Entity shall pay the Contractor the amounts certified by the Project<br />

Manager within the period specified in Schedule II .<br />

(23) Unless otherwise stated, all payments and deductions shall be in the proportions of<br />

currency(ies) as specified in the Contract Price.<br />

(24) <strong>The</strong> items quantified in the BOQ for which no rates or prices have been quoted<br />

shall be deemed covered by the amounts of other rates and prices in the Contract.<br />

(25) Advance Payment or its repayment shall not be taken into account in assessing<br />

valuations of work done, Variations, price adjustments, Compensation Events, Bonuses, or<br />

Liquidated Damages.<br />

(26) In the case of compensation events the provisions detailed in the GCC and PCC<br />

shall be followed.<br />

(27) <strong>The</strong> Contractor shall be liable to pay liquidated damages at the rate per day or<br />

week as specified in the contract for each day of delay from the Intended Completion Date of the<br />

original Contract or Extended Completion Date provided that -<br />

<strong>The</strong> total amount of liquidated damages shall not exceed the amount defined in<br />

the contract.<br />
