YOUR RIGHTS IN THE STREETS<br />

People’s experience when dealing with the police may vary.<br />
Whether those experiences are positive or negative, it’s important<br />
that you know you rights. Knowing your rights can help youidentify<br />
illegal conduct by the police, and help you decide when it’s in your<br />
interest to talk to them.<br />
This handbook describes many of your rights when approached by<br />
the police, including when it’s legal for the police to approach, stop,<br />
and arrest you. It gives you tips on how to deal with these situations,<br />
and what to do if you feel like your rights have been violated. It also<br />
answers many commonly asked questions about street encounters<br />
with the police.<br />
Always Remember:<br />
Ø Police can always approach you and ask basic<br />
questions, like your name and address.<br />
Ø If you don’t want to talk to cops, you can always ask<br />
them if you are free to leave.<br />
Ø You always have the right to remain silent, and in<br />
most situations you should exercise that right.<br />
Some of your constitutional rights<br />
The constitution of the United States includes 27 amendments.<br />
Some of theseamendments, were added in order to provide<br />
additional rights to US citizens-rights that were not originally<br />
included in the constitution.Below are the 4 th and<br />
5 th amendment rights, which are more important amendments<br />
that relate to police encounters on the street.<br />

The Fourth<br />
Amendment:<br />
Police cannot<br />
unreasonably<br />
search or seize<br />
(take) you and/or<br />
your property.<br />

The Fifth<br />
Amendment:<br />
You always have<br />
the right to remain<br />
silent when dealing<br />
with police!!!<br />
“the right of people to be secure in their<br />
person, houses, papers, and effects,<br />
against unreasonable searches and<br />
seizures, shall not be violated, and in no<br />
warrants shall issue, but upon probable<br />
cause, supported by the Oath or<br />
affirmation and particularly describing<br />
the place to be searched, and person or<br />
things to be seized.<br />
“No person shall be held to answer for a<br />
capitol or otherwise infamous crime,<br />
unless on a presentment or indictment of<br />
a grand Jury…nor shall any person…be<br />
compelled in any criminal case to be a<br />
witness against himself, nor be deprived<br />
of life, liberty, or property without due<br />
process of the law: nor shall private<br />
property be taken for public use without<br />
just compensation”<br />
