Level 2: Common Law Right to Inquiry<br />
In a Level 2 encounter cops can questions you when they<br />
suspect that you have committed a crime or know something<br />
about one. Level 2 inquiries are more detailed questions<br />
designed to get answers related to whatever crime it is the cops<br />
think is going on. These questions may seem more<br />
confrontational than Level 1 questions. Again, ask if you are<br />
free to go, if so you do not have to answer these questions.<br />
Examples of Level 2 questions<br />
“Have you and your friends been getting into<br />
trouble lately”<br />
“Who is selling drugs here”<br />
“Do you have drugs on you”<br />
But: you should know that cops can detain you if they have<br />
evidence that raises their suspicion to level, which is on the<br />
next page.<br />
Level 3: Stop and Frisk<br />
At Level 3, you are no longer free to leave. To get to a level 3<br />
stop and frisk cops must have reasonable suspicion, which<br />
means they think you have committed, are committing, or<br />
about to commit a crime. Once this is established, they can<br />
detain (stop) you to frisk you on the outside of our clothes (pat<br />
you down) if they believe that you are carrying a weapon.<br />
HOWEVER THEY CAN ONLY LEGALLY GO INSIDE<br />
YOUR POCKETS WITH YOUR CONSENT!!!!<br />
It is illegal for cops to frisk you for drugs or anything else that<br />
is not a weapon. When frisking you, it is illegal for cops to go<br />
through your pockets unless they think that what they’ve felt is<br />
a weapon.<br />
Tip: If the cops ask to go in your<br />
pockets, say that you do not consent<br />
to a search, if they continue to go<br />
into your pockets this is a violation<br />
of our 4 th amendment rights.<br />
Tip: You should never lie to a cop. Don’t<br />
make up a name, address, or lie about<br />
your age. You can get into a lot of trouble.<br />
If you don’t want to answer, you should<br />
ask if you are free to go. If you are, then<br />
you can walk away without answering<br />
questions.<br />
Tip: If you are a female being detained,<br />
always ask for a female officer to frisk<br />
you, police officers must make an<br />
attempt to have a female officer frisk<br />
you.<br />
