When Police come to your house<br />
When police come to your house, they will either have a<br />
warrant, or there will be a call about activity in your house.<br />
If they have a search warrant, that means they can legally<br />
search in your property for evidence (physical or a person)<br />
related to a criminal investigation.<br />
Always<br />
----ask them to slide the warrant under the door<br />
----read the entire warrant, to see where they can search and where they can<br />
----understand that anything illegal in plain view can get you arrested (even<br />
if it is not in the warrant)<br />
If they do not have a warrant (for example there was calls<br />
about noise complaints, or domestic violence), police can arrest<br />
you for anything found in your house. Always step outside<br />
your door to speak with police so that there might be other<br />
witnesses outside of your house that can verify if police<br />
misconduct happens.<br />
Exigent Circumstances: These are the only times you have to<br />
let police into your house.<br />
If:<br />
---The police are chasing someone and they run into your house<br />
---The police believe that evidence is being destroyed<br />
----The police believe thata crime is occurring your house when they arrive<br />
These are called exigent circumstances, where the police<br />
are allowed to search your house without a warrant!!!!<br />
When cops break the rules: what can you do<br />
1) File a complaint with the CCRB.<br />
New York City Civilian Complaint Review Board<br />
The CCRB is an independent non-police city agency (all<br />
members are non-police civilians). It has the power to<br />
receive, investigate, deliberate and recommend action on<br />
complaints against the NYPD misconduct (including:<br />
excessive or unnecessary force, abuse of authority)<br />
Who can file a complaint<br />
You can file a complaint:<br />
-at any age<br />
-if you are in jail<br />
-in any language<br />
-anonymously<br />
If you witnessed police misconduct (but are not the victim)<br />
There are 5 ways to file a complaint<br />
• Call 1-800-341-CCRB (2272)<br />
• Call 311<br />
• Go to the CCRB office 40 rector street 2 nd<br />
floor NY, NY 10006 (M-F 8am-6pm)<br />
• Send a letter to the above address<br />
• File a complaint online at www.nyc.gov<br />
