Central Booking and Arraignment<br />
(page 21 has phone numbers for NY central booking units)<br />
---Each borough has a central booking, where you will wait for<br />
arraignment<br />
---You will be given a meal (cheese sandwiches if you don’t eat<br />
meat<br />
Arraignment: Formal court process where you are read the charges<br />
against you.<br />
----Your Lawyer (court appointed or private) will discuss criminal charges<br />
and explain what you should expect when you go before the judge<br />
----If the case isn't disposed of in arraignment, the judge may set bail based<br />
on<br />
A. The seriousness of the case and/or<br />
B. Your previous contacts with the criminal system.<br />
If you've had recent bench warrants issued for not returning to court, even<br />
though the warrant was vacated, bail will likely be set.<br />
----Unless you take a plea, you won’t be asked to speak, so if you want to<br />
say something tell your lawyer. It's always a bad idea to say anything<br />
incriminating on the record hoping the court will understand.<br />
Police and Car Stops<br />
If the cops legally stop you (i.e., you did not signal for a turn,<br />
speeding) they cannot search the trunk or glove compartment<br />
without your consent. To protect yourself do not consent to a<br />
search of your trunk or glove compartment.<br />
When stopped, give the proper identification (license,<br />
registration, insurance) and always asked why you were<br />
stopped. If they refuse to tell you continue to ask in a calm<br />
fashion. YOU HAVE THE RIGHT TO KNOW WHY YOU<br />
WERE BEING PULLED OVER. If you feel afterwards that<br />

Anything illegal the police see in plain view of your vehicle,<br />
allows them to search your vehicle and possibly arrest you.<br />
Tip: Always keep your doors<br />
locked and windows rolled up, so<br />
the police cannot come into your<br />
car without your consent.<br />
Tip: Arraignments go by fast, so if something<br />
happens that you don’t understand or think may<br />
result in an unfavorable outcome, don’t hesitate to<br />
ask your attorneyand always get your attorney's<br />
name and number!!!!!!<br />
Tip: If contraband (drugs,<br />
weapons, open containers of<br />
alcohol are found in the car,<br />
everyone in the car can be arrested,<br />
even if it’s not yours.<br />
