The observance of presumption<br />
of <strong>in</strong>nocence was tackled dur<strong>in</strong>g<br />
<strong>the</strong> conference <strong>in</strong>clud<strong>in</strong>g with<strong>in</strong><br />
a ‘practicum’-type of session,<br />
moderated by <strong>the</strong> Co-Chairman<br />
of <strong>the</strong> Russian Civic College for<br />
Compla<strong>in</strong>ts aga<strong>in</strong>st Press Iurii<br />
Kazakov. “The most serious<br />
disease of <strong>the</strong> journalists who<br />
write on crim<strong>in</strong>al topics <strong>in</strong><br />
Russia is <strong>the</strong>ir bl<strong>in</strong>d trust <strong>in</strong> <strong>the</strong><br />
<strong>in</strong>formation provided by <strong>the</strong><br />
law-enforcement bodies, Iurii<br />
Kazakov said. The <strong>in</strong>formation<br />
is not verified and many times<br />
<strong>the</strong> source is not quoted, and<br />
this violates <strong>the</strong> constitutional and ethical pr<strong>in</strong>ciples of presumption of <strong>in</strong>nocence.”<br />
The participants analyzed a number of situations presented by <strong>the</strong> Executive Director of <strong>the</strong> Romanian<br />
Independent Journalism Center Ioana Avădani. Also, <strong>the</strong>y analyzed <strong>the</strong> publish<strong>in</strong>g of photographs of<br />
public persons taken <strong>in</strong> non-traditional situations, which stirred reactions after <strong>the</strong>ir publish<strong>in</strong>g but<br />
which made <strong>the</strong> editors consult <strong>the</strong> media experts before pr<strong>in</strong>t<strong>in</strong>g.<br />
“It was <strong>in</strong>terest<strong>in</strong>g to learn through what o<strong>the</strong>r press councils had to go and I shared our experience,<br />
Mihail Batig said at <strong>the</strong> end of <strong>the</strong> conference. For <strong>in</strong>stance, I told my colleagues that <strong>in</strong> pr<strong>in</strong>ciple<br />
I didn’t agree with <strong>the</strong> fact that a number of commissions <strong>in</strong> o<strong>the</strong>r countries reacted only to <strong>the</strong><br />
compla<strong>in</strong>ts aga<strong>in</strong>st journalists who had signed <strong>the</strong> Code of Ethics. I th<strong>in</strong>k this is <strong>in</strong>correct. The selfregulation<br />
bodies must react to each compla<strong>in</strong>t filed. Everyth<strong>in</strong>g that is pr<strong>in</strong>ted or broadcast, if it<br />
generates grounded objections, it must be considered and a decision must be made.”<br />
“I th<strong>in</strong>k that this regional conference was exceptionally useful to us. These two pr<strong>in</strong>ciples –<br />
presumption of <strong>in</strong>nocence and protection of privacy are traumatiz<strong>in</strong>g positions and bear<strong>in</strong>g a<br />
high level of uncerta<strong>in</strong>ty. But <strong>the</strong> society and we, <strong>the</strong> lawyers, have seen precedents now and<br />
possible settlements at regional level. We meditate on <strong>the</strong> reasons for mak<strong>in</strong>g a decision and on<br />
<strong>the</strong> quality of <strong>the</strong> decisions made. So our homework will be to meditate on those precedents,”<br />
Iurii Kazakov said at <strong>the</strong> end of <strong>the</strong> conference.<br />
