Armenia: Decision of <strong>the</strong> Council of Observers<br />

Determ<strong>in</strong>ed Policeman Renounce Compla<strong>in</strong>t<br />

to Court aga<strong>in</strong>st a <strong>New</strong>spaper<br />

The Council of Observers for <strong>Journalist</strong> Ethics of Armenia was created on 10 March 2007 at<br />

a reunion of media managers and nongovernmental organizations. At <strong>the</strong> same event <strong>the</strong>y<br />

approved <strong>the</strong> <strong>Journalist</strong> Code of Ethics with <strong>the</strong> annex “Declaration of <strong>the</strong> Pr<strong>in</strong>ciples of Coverage<br />

of Elections and Referenda.” The <strong>in</strong>stitutions signatory to <strong>the</strong> Code recognized <strong>the</strong> right of <strong>the</strong><br />

Council to monitor to what extent <strong>the</strong>ir actions and articles complied with <strong>the</strong> ethical standards,<br />

and committed to publish its decisions. The Council is made up of seven persons – three media<br />

outlet managers, three NGO leaders and a media lawyer. The mission of <strong>the</strong> Council is to review<br />

<strong>the</strong> compla<strong>in</strong>ts of violations of <strong>the</strong> Code of Ethics. S<strong>in</strong>ce 2007 and until November 2011, <strong>the</strong><br />

Council of Observers issued 26 decisions-rul<strong>in</strong>gs and has two more compla<strong>in</strong>ts pend<strong>in</strong>g.<br />

On 31 October 2008, <strong>the</strong> Council of Observers issued a decision-rul<strong>in</strong>g <strong>in</strong> regard to a compla<strong>in</strong>t filed by a<br />

correspondent of <strong>the</strong> newspaper “Aravot”. The journalist asked <strong>the</strong> Council to issue a decision on an article<br />

that became <strong>the</strong> object of a court litigation started aga<strong>in</strong>st <strong>the</strong> newspaper by a police officer. The pla<strong>in</strong>tiff<br />

requested that <strong>the</strong> newspaper be obliged to deny <strong>the</strong> <strong>in</strong>formation from <strong>the</strong> article “When Your Neighbor<br />

is Police Officer,” published on 25 June 2008. The pla<strong>in</strong>tiff considered <strong>the</strong> article had <strong>in</strong>jured his honor and<br />

dignity.<br />

In its decision <strong>the</strong> Council of Observers held that <strong>the</strong> article “When Your Neighbor is Police Officer” did not<br />

conta<strong>in</strong> specific violations of <strong>the</strong> Code of Ethics nor of <strong>the</strong> <strong>in</strong>ternational journalistic standards. At <strong>the</strong> same<br />

time, <strong>the</strong> Council qualified as doubtful <strong>the</strong> phrase stat<strong>in</strong>g that <strong>the</strong> police officer “…us<strong>in</strong>g <strong>the</strong> relations he<br />

had <strong>in</strong> <strong>the</strong> police..,” s<strong>in</strong>ce <strong>the</strong> author, although claim<strong>in</strong>g this conclusion came from <strong>the</strong> witnesses, did not<br />

make reference to specific persons. Also, <strong>the</strong> Council noted that <strong>the</strong> expressions considered by <strong>the</strong> pla<strong>in</strong>tiff<br />

as statements <strong>in</strong>jur<strong>in</strong>g his honor and dignity and as be<strong>in</strong>g “<strong>in</strong>exact facts” were not facts but conclusions and<br />

value judgments based on <strong>the</strong> facts described <strong>in</strong> <strong>the</strong> story. However, <strong>the</strong> truthfulness or level of compliance<br />

of those conclusions with <strong>the</strong> reality could be proved. As argument, <strong>the</strong> Council of Observers made reference<br />

to a judgment issued <strong>in</strong> a similar case by <strong>the</strong> European Court for Human Rights.<br />

The self-regulation body also found that <strong>the</strong> story conta<strong>in</strong>ed a number of tough expressions “that proved<br />

<strong>the</strong> root<strong>in</strong>g of stereotypes <strong>in</strong> <strong>the</strong> society”, but noted that <strong>the</strong>y could not be qualified as <strong>in</strong>sults from <strong>the</strong><br />

journalist ethics po<strong>in</strong>t of view.”<br />

The journalist presented <strong>the</strong> decision of <strong>the</strong> Council of Observers <strong>in</strong> <strong>the</strong> court hear<strong>in</strong>g. The police officer<br />

stated that if <strong>the</strong> newspaper “Aravot” published that decision he would withdraw his compla<strong>in</strong>t from <strong>the</strong><br />

court. The newspaper published <strong>the</strong> decision on <strong>the</strong> follow<strong>in</strong>g day and <strong>in</strong> several days <strong>the</strong> court accepted <strong>the</strong><br />

police officer’s request for term<strong>in</strong>at<strong>in</strong>g <strong>the</strong> litigation.<br />

So, <strong>in</strong> Armenia a precedent was created when, at <strong>the</strong> request of a party, <strong>the</strong> media self-regulation body<br />

issued a decision <strong>in</strong> regard to a court litigation and <strong>the</strong> opposite party, be<strong>in</strong>g satisfied with <strong>the</strong> content and<br />

publish<strong>in</strong>g of <strong>the</strong> decision, withdrew his compla<strong>in</strong>t from court.<br />
