her even had he known about <strong>the</strong> future child. In addition, <strong>the</strong> journalist <strong>in</strong>terviewed <strong>the</strong><br />

children who allegedly had talked about what happened that night. The story also <strong>in</strong>dicated<br />

that <strong>the</strong> baby had been buried by <strong>the</strong> woman’s juvenile children, that <strong>the</strong> baby was alive and<br />

that a crim<strong>in</strong>al case was started <strong>in</strong> that regard, and if <strong>the</strong> woman was found guilty she risked<br />

n<strong>in</strong>e years of prison.<br />

The Council for <strong>Journalist</strong> Ethics issued a decision <strong>in</strong> which it agreed with <strong>the</strong> claimant that<br />

<strong>the</strong> Charter’s pr<strong>in</strong>ciple 10 had been violated. Accord<strong>in</strong>g to this pr<strong>in</strong>ciple, <strong>the</strong> journalist must<br />

respect a person’s privacy and not touch upon it if <strong>the</strong>re was no clear public <strong>in</strong>terest <strong>in</strong> that.<br />

Also, <strong>the</strong> Council found that <strong>the</strong> journalist had not given priority to <strong>the</strong> <strong>in</strong>terests of <strong>the</strong><br />

juvenile children, s<strong>in</strong>ce <strong>the</strong> publish<strong>in</strong>g of such a story logically hurt <strong>the</strong>m. The story fully<br />

ignored <strong>the</strong> pr<strong>in</strong>ciple 8 of <strong>the</strong> Charter that requires observance of ethical standards when<br />

writ<strong>in</strong>g about children: if <strong>the</strong> name of <strong>the</strong> village, district, name of <strong>the</strong> mo<strong>the</strong>r are mentioned<br />

as well as <strong>the</strong> environment <strong>in</strong> which <strong>the</strong> children live is described, <strong>the</strong> journalist cannot claim<br />

anymore that he had kept <strong>the</strong>ir confidentiality, even if he had not mentioned <strong>the</strong>ir names.<br />

The Council ruled <strong>in</strong> favor of <strong>the</strong> claimant but emphasized that <strong>the</strong>re was a justified public<br />

<strong>in</strong>terest <strong>in</strong> regard to that story because it dealt with <strong>the</strong> death of a newly born. However, s<strong>in</strong>ce<br />

nei<strong>the</strong>r <strong>the</strong> crim<strong>in</strong>al <strong>in</strong>vestigations nor <strong>the</strong> journalist had proved that that was a murder,<br />

even if un<strong>in</strong>tended, or that children had participated <strong>in</strong> <strong>the</strong> alleged crime, <strong>the</strong> pr<strong>in</strong>ciple of<br />

<strong>in</strong>violability of privacy was violated. In <strong>the</strong> Council’s op<strong>in</strong>ion, <strong>the</strong>re is high public <strong>in</strong>terest <strong>in</strong><br />

any crim<strong>in</strong>al act; however it shall prevail over <strong>the</strong> legitimate <strong>in</strong>terest of protect<strong>in</strong>g privacy<br />

only when <strong>the</strong> journalist has grounded doubts that <strong>the</strong> case would be <strong>in</strong>vestigated fairly and<br />

<strong>the</strong> publish<strong>in</strong>g of private data of <strong>the</strong> persons <strong>in</strong>volved is absolutely necessary.<br />
