Employer, the Employer taking on the House Concern work, <strong>and</strong><br />

the Union shall enter into a written agreement which shall be presented<br />

to the Joint Area Grievance Committee for approval.<br />

Section 5.<br />

In accordance with Article 8, Section 6(g), the parties agree that in<br />

the event of an approved change of operations, employees who bid<br />

on the initial move but are not successful because of seniority shall<br />

be afforded additional opportunity to transfer in the event additional<br />

regular work opportunity develops within six (6) months of the<br />

approved change of operations.<br />

ARTICLE 43. MAINTENANCE OF STANDARDS<br />

Section 1. Protection of Conditions<br />

(a) The Employer agrees that all conditions of employment relating<br />

to wages, hours of work, overtime differentials, general working<br />

conditions <strong>and</strong> bonuses shall be maintained at not less than the highest<br />

st<strong>and</strong>ards in effect at the time of the signing of this <strong>Agreement</strong><br />

<strong>and</strong> the conditions of employment shall be improved wherever specific<br />

provisions for improvement are made elsewhere in this<br />

<strong>Agreement</strong>.<br />

(b) Oral testimony by an employee claiming a past practice not<br />

accompanied by substantiating proof or records existing at the time<br />

of the alleged past practice shall not be considered as presumptive<br />

proof that such past practice existed.<br />

ARTICLE 44. GRIEVANCE MACHINERY<br />

Section 1.<br />

The Union <strong>and</strong> the Employers agree that there shall be no strike,<br />

lockout, tie-up or legal proceedings without first using all possible<br />

means of a settlement, as provided for in this <strong>Agreement</strong>, of any<br />

controversy which might arise.<br />

Section 2.<br />

(a) Disputes <strong>and</strong> grievances may first be taken up by the steward,<br />
