ARTICLE 40. SCOPE OF AGREEMENT<br />

Section 1. Operations Covered<br />

a) This <strong>Agreement</strong> shall cover all classifications of employees hereinafter<br />

referred to or subsequently covered who are employed by<br />

any member Employer (which includes any other Employer, whose<br />

employees are represented by a Union who may become a member<br />

of the Employer Association after the date of this <strong>Agreement</strong> <strong>and</strong> a<br />

copy of whose approved application for membership in the<br />

Employer Association shall be filed with the Union by the<br />

Employer Association) as well as any non-member of the Employer<br />

Association which becomes a party to this <strong>Agreement</strong>, except that it<br />

shall not apply in the case of any such employees whose hours of<br />

work, wages <strong>and</strong> working conditions are governed by separate contracts<br />

between Union <strong>and</strong> the Employer Association, relating to particular<br />

branches of truck service, such as the moving of household<br />

goods.<br />

(b) The executive of this <strong>Agreement</strong> on the part of the Employer<br />

shall cover all local operations of the Employer within, into <strong>and</strong> out<br />

of the area <strong>and</strong> territory described above.<br />

(c) All operations <strong>and</strong> work covered herein shall be performed<br />

exclusively by employees covered by this <strong>Agreement</strong> (except as<br />

otherwise provided in this <strong>Agreement</strong>).<br />

Section 2. Employees Covered<br />

(a) Employees covered by this <strong>Agreement</strong> shall be construed to<br />

mean, but not limited to, any driver, chauffeur, or driver-helper<br />

operating a truck, tractor, motorcycle, passenger or horse-drawn<br />

vehicle, or any other vehicle operated on the highway, streets or private<br />

road for transportation purposes when used to defeat the purposes<br />

of this <strong>Agreement</strong>. The term employee also includes, but is<br />

not limited to, all employees used in dock work, checking, stacking,<br />

loading, unloading, h<strong>and</strong>ling, shipping, receiving, switching, forklift,<br />

Teamster Rigger, <strong>and</strong> assembling or drag line <strong>and</strong> allied work.<br />

It is understood, however, that the term employee shall be construed<br />
