Dear Mr. Developer:<br />
This letter is to confirm that the Marina Coast Water District (MCWD) can <strong>and</strong> will furnish water<br />
<strong>and</strong> sewer service to the above project upon your agreement with <strong>and</strong> completion of the following<br />
requirements to the satisfaction of MCWD:<br />
1. The developer shall furnish written approval from the local jurisdiction (Monterey County, City<br />
of Marina, City of Seaside, or City of Del Rey Oaks) of the water allocation for the project. The<br />
developer agrees to be solely responsible for determining annual water dem<strong>and</strong> <strong>and</strong> wastewater<br />
generation estimates.<br />
2. The developer shall enter into a Construction <strong>and</strong> Transfer of Water, Recycled Water, <strong>and</strong> Sewer<br />
Infrastructure Agreement with MCWD prior to beginning the preliminary plan review process or<br />
the plan check review process. This agreement <strong>and</strong> any major infrastructure improvements shall<br />
be referenced in the developer agreements with the local jurisdiction.<br />
3. All fees <strong>and</strong> charges shall be paid in accordance with MCWD Ordinances <strong>and</strong> at the time<br />
specified in the Infrastructure Agreement before initiating preliminary plan review, plan check<br />
review <strong>and</strong> <strong>connection</strong> to public water <strong>and</strong> sewer service.<br />
4. The new water, recycled water, <strong>and</strong> the wastewater collection systems within the project area<br />
<strong>and</strong> <strong>connection</strong>s to <strong>and</strong>/or ab<strong>and</strong>onment of existing infrastructure shall comply with all MCWD<br />
Ordinances. The developer agrees to accept the transfer of ownership of all ab<strong>and</strong>oned facilities<br />
as explained in the Infrastructure Agreement. In addition to con<strong>form</strong>ing to District design<br />
requirements, the developer agrees to meet California Department of Health Services<br />
requirements prior to constructing recycled water facilities.<br />
5. The developer shall provide potable water (including fire flow) <strong>and</strong> recycled water dem<strong>and</strong><br />
quantities, <strong>and</strong> wastewater generation figures. The developer agrees to complete a Development<br />
Water <strong>and</strong> Sewer Master Plan as specified in the Infrastructure Agreement. The developer<br />
agrees to provide the District at least one month review time for these plans.<br />
6. The developer shall identify any other infrastructure improvements outside the project area that<br />
may be necessary as a result of this project. Water <strong>and</strong> sewer improvements outside of the<br />
project area may be borne by the developer in part or in whole depending on an assessment of<br />
project benefits.
