for the benefit of farming<br />
community in general<br />
and marginal and small<br />
farmers in particular.<br />
The Agricultural Census<br />
provides essential<br />
information on distribution<br />
of operational holdings and<br />
area operated by them<br />
along with other related<br />
characteristics such as<br />
tenancy, terms of leasing,<br />
cropping and land use<br />
patterns, irrigation status,<br />
etc. Since 1980-81, data<br />
are being separately<br />
collected for Scheduled<br />
Castes and Scheduled<br />
Tribes to provide<br />
necessary data in respect<br />
of these social groups also.<br />
The data under this survey<br />
are available for the years<br />
1976-77, 1981-82, 1986-87,<br />
1991-92, 1996-97, 2001-02<br />

NOTIFICATION<br />
1. Article 243G of the Constitution ( ,<br />
73 rd ) Amendment<br />
Act, 1992 authorizes the State/ UT Administration,<br />
by!aw, to endow the Panchayat with such powers and<br />
authorities as may be necessary to enable them to<br />
function as institutions of local self- governance and<br />
such law may contain provisions for the devolution of<br />
powers and responsibilities upon Panchayats at the<br />
appropriate level, subject to such conditions as may<br />
be - specified therein, with respect to:<br />
a) The preparation of plan for Economic:<br />
Development and Social Justice;<br />
b) The implementation of schemes for economic<br />
development and social Justice as may be entrusted<br />
to them including those in relation to the matters listed<br />
in the Eleventh Schedule.<br />
2. The Lakshadweep Panchayats Regulation, 1994<br />
(No. 4 of 1994) empowers the Administrator, U.T. of<br />
Lakshadweeo to transfer schemes and programmes<br />
to District Panchayat and Village (Dweep)<br />
Panchayats under any of the subjects incorporated<br />
in the IV th Schecule under Sub Section (2) of Section<br />
44 read with Section 46 of the Regulation in a phased<br />
manner and subject to such rules notified under the<br />
said regulation and such other conditions as he may<br />
think fit to impose.<br />
3. In addition to implementing its own schemes for<br />
economic development, social justice, and other<br />
programs which are likely to promote the cultural<br />
well - being and education, the Administrator,<br />
Lakshadweep is also empowered to transfer schemes<br />
and programs under any of the subjects incorporated<br />
in the 4 th schedule under Sub-section (1) of Section<br />
44 to the Panchayats from time to time, along<br />
withFunds, if any and such personnel as may be<br />
necessary on such conditions as may be prescribed<br />
for its operation by the Panchayats.<br />
4. The Administrator of Union Territory of<br />
Lakshadweep in exercise of the aforesaid powers has<br />
already transferred schemes and programs along with<br />
employees to the District Panchayat and Village<br />
(Dweep) Panchayat as enumerated the Executive<br />
Orders 4/2/97-DOP (1) dated 17.7.1998 and<br />
F.No. 7/4/2000- DOP&RD (2) dated 9-4-2001 and<br />
F.No. 2/8/2006-DOP&RD (1) dated 28 th June. 2006<br />
and F.No. 2/14/2009-DOP (1) dated 29.12.2009.<br />
5. The schemes and programmes transferred along<br />
with functionaries and funds have been reviewed by<br />
the Administration as to examine whether the<br />
devolved activities have been transferred to the<br />
Panchayats in the right spirit of the devolution and<br />
whether additional schemes and programmes are to<br />
be transferred to the Panchayats. Based on this<br />
review, and in exercise of powers conferred on him<br />
under Section 44 of the Lakshadweep Panchayats<br />
Regulation, 1994, read along with Section 46 of the<br />
said Regulation and the provisions contained in<br />
Constitution (73 rd amendment) Act and in continuation<br />
to the executive orders referred above in para 4, the<br />
Administrator, Union Territory of Lakshadweep, is<br />
pleased to transfer the schemes and programs being<br />
implemented by the Departments of Agriculture,<br />
Animal Husbandry, Education, Fisheries, Health and<br />
Sanitation along with all the plan schemes and nonplan<br />
components to the District Panchayat and Village<br />
(Dweep) Panchayats.<br />
6. The entire Plan and Non-Plan budget required<br />
for the above schemes transferred shall be given as<br />
Grant-in-Aid to the District Panchayat and Village<br />
(Dweep) Panchayats from the Directorates of<br />
concerned Departments for which detailed<br />
instructions will be issued separately by Finance<br />
Department. The Village ( .<br />
Dweep) Panchayats and<br />
District Panchayat will function independently within<br />
their sphere of delegation but in co-ordination for<br />
effective implementation of the activities. All the grants<br />
released to the Panchayats shall be spent strictly<br />
according to the Lakshadweep Panchayats<br />
Regulation, 1994, Lakshadweep Panchayats<br />
(Finance & Accounts) Rules, 1997 and GFR of<br />
Central Government. The Departments concerned<br />
will be issuing specific details, including schematic<br />
budget, on which activites the funds realeased shall<br />
be spent by the Panchayats. The Panchayats are<br />
not permitted to make any diversion and the grant<br />
shall be used for the specific purpose for which it<br />
has been earmarked and allotted in the budget.<br />
7. Orders in respect of authorities of reporting and<br />
reviewing authorities of the ACRs of the staff also<br />
will be issued separately.<br />
8. The Directorate buildings are transferred to the<br />
District Panchayat and all the unit buildings and other<br />
infrastructure in which different units of these<br />
departments are presently functioning are also<br />
transferred to the Village (Dweep) Panchayats. The<br />
Administrator, in exercise of powers conferred under<br />
Section 39, 40 and 41 of Lakshadweep Panchayats<br />
Regulation, 1994 transfer the entire establishments<br />
of Agriculture, Animal Husbandry, Fisheries,<br />
Education and Medical except those listed Annexure-I.<br />
The Directorates along with their staff of these five<br />
departments will function from separate buildings to<br />
be identified by Secretary (Panchayats). The<br />
ownership of all such buildings transferred will<br />
continue to be with Lakshadweep Administration.<br />
9. Accordingly the posts now transferred to the<br />
District Panchayat and Village (Dweep) Panchayats<br />
will be under the fulI control of the District Panchayat<br />
and Village (Dweep) Panchayats in all respects<br />
except promotion and disciplinary proceedings for<br />
major penalties. The District Panchayat will have the<br />
powers to impose minor penalty and transfer and<br />
posting of the staff from one island to another and<br />
within an island. The employees transferred will<br />
continue to be Govt. servants and their service<br />
conditions and disciplinary proceedings will be in<br />
accordance with CCS/CCA Rules. The vacant posts<br />
will be filled up by the respective Directorates as per<br />
the Recruitment Rules as and when it becomes<br />
vacant by way of superannuation, resignation,<br />
promotion or in any other manner.<br />
10. All Centrally Sponsored Schemes are also<br />
transferred to the District Panchayat with all the<br />
assets and staff including those engaged on contract<br />
basis in CSS and departmentally. The tenure of<br />
contract staffs can be extended only with the prior<br />
approval of the Directorates concerned based on<br />
performance. These schemes will be implemented<br />
by the District Panchayat in accordance with the<br />
guidelines of the Central Government and decisions<br />
on policy matters taken by the Administration of the<br />
Union Territory.<br />
11. The procurement wings of the concerned<br />
departments at Kochi are transferred to the District<br />
Panchayat to facilitate the centralised procurement<br />
by the District Panchayat for distribution to all islands<br />
based on the indent from VDPs.<br />
12. (I) Agriculture : All Agriculture Demonstration<br />
units through which the programmes of Coconut<br />
Development, Organic Farming, Livelihood Support<br />
Services, Horticulture Development, Integrated Pest<br />
Management, Maintenance of Gardens, Govt. House<br />
are implemented had hitherto been transferred to<br />
Village (Dweep) Panchayats in addition to the<br />
schemes which are implemented by VDPs under<br />
Grant-in-Aid. However the procurement of all items,<br />
as mentioned in para 11 will rest with District<br />
Panchayat in addition to Insurance to climbers,<br />
Extension Services, Coastal Plantations, Organic<br />
Certification. Except for the staff mentioned in<br />
Annexure-I to be retained at the Directorate, all other<br />
siaffs are transferred to the Panchayats. The<br />
programs and Functionaries to be transferred to<br />
District Panchayat and Village (Dweep) Panchayats<br />
are outlined in Annexure-II.<br />
II) Animal Husbandry : All kinds of purchases of<br />
feed, fodder, vaccines, medicines, equipments<br />
under Poultry Development Programme, Goat<br />
Development Programme, Cattle Development<br />
Programme, Veterinary Services, Extension Activities<br />
under Training & Technical Assistance Programme<br />
lie with the District Panchayat. The general functioning<br />
and control, production and distribution of milk, eggs,<br />
hatchery units at island level lie with the Village<br />
(Dweep) Panchayats.<br />
III) Education : All schemes and programmes of<br />
Primary, Secondary, Higher Secondary ie. From 1 st to<br />
12 th Standard of Education Sector and Technical<br />
Education are transferred to District Panchayat.<br />
However the Pre-primary section continues to function<br />
under Village (Dweep) Panchayats. The Senior<br />
Administrative Officer, Department of Education is redesignated<br />
as Joint Director (Administration) and<br />
placed under the District Panchayat. All the buildings<br />
and other infrastructure in which these schools function<br />
except pre-primary are transferred to the District<br />
Panchayat. The entire establishment of teacning and<br />
non-teaching staff of education sector except those<br />
mentioned in Annexure-I are also transferred to District<br />
Panchayat. The conduct of Examination and<br />
sponsoring of candidates for higher studies will be the<br />
responsibility of the Directorate of Education.<br />
(IV) Fisheries : At present many schemes are already<br />
transferred to Village (Dweep) Panchayats and District<br />
Panchayat under devolution of functions and<br />
functionaries. All such schemes continue to be deart<br />
by the Panchayats at Island level and District level. In<br />
continuation to this the schemes and functionaries to<br />
be devolved at different level are detailed in Annexure<br />
II. The Fishermen Training Centre, Extension,<br />
Fisheries Section, Kochi, Museum and Marine<br />
Aquarium shall stand transferred to District Panchayat.<br />
The senior most Assistant Director transferred to the<br />
District Panchayat will act as the District Fisheries<br />
Officer along with other staff. The Staff to be retained<br />
at the Directorate is detailed in Annexure I.<br />
V) Medical and Health Services : All schemes of<br />
Health and Sanitation including Hospitals, Primary<br />
Health Centres and Dispensaries, Family Welfare and<br />
Public Health activities are transferred to the District<br />
Panchayat. Accordingly all the Hospitals, Community<br />
Health Centres and Primary Health Centres except<br />
Indira Gandhi Hospital, Kavaratti and Rajiv Gandhi<br />
Speciality Hospital, Agatti along with all plan schemes<br />
and non-plan components are transferred to the<br />
District Panchayat. The entire establishment of<br />
Medical, Para Medical staff including the Chief Medical<br />
Officers except those listed in Annexure-I are<br />
transferred to the District Panchayat. The post of<br />
Public Health specialist is re-designated as Joint<br />
Director (Health Services) and transferred to District<br />
Panchayat.<br />
13. The Services Department of the UTL<br />
Administration shall issue a separate order transferring<br />
the ministerial and multi skilled employees/temporary<br />
status labourers to the District Panchayat, who will be<br />
placed at the disposal of District Panchayat for<br />
postings in various units of the departments and they<br />
will be posted and transferred by District Panchayat<br />
to various units/islands as per the transfer policy of<br />
UTL Administration. Once in 3 years, Services<br />
Department will replace Ministerial Staff/Multi Skiled<br />
Employees, at the disposal of District Panchayat for<br />
their postings/transfers.<br />
14. The District Panchayat based on the demands<br />
from VDPs will propose the civil construction works<br />
for the devolved functions in consultation with the<br />
Directorate concerned and the construction will be<br />
executed by the Public Works Department or Other<br />
Government Agencies.<br />
15. New contract posts or any other posts even<br />
casual labourers cannot be created without the prior<br />
approval of the Administrator by the District Panchayat<br />
or Village (Dweep) Panchayats.<br />
16. The Administrator, U. T. of Lakshadweep will be<br />
reviewing the transfer of the staff to the District<br />
Panchayat atleast onece in 4 years.<br />
17. Theses orders shall come in to force from<br />
1 st April, <strong>2012</strong>.<br />
