BENEFICIARY<br />

BREAK IN SERVICE<br />

Beneficiary means the person or persons designated by a Member to<br />

receive a lump sum payment, if any, or the Capital Accumulation<br />

Payment as provided by the Plan upon the death of the Member. A<br />

person so designated under the 1961-1971 Plan or 1971-1988 Plan shall<br />

continue to be a Beneficiary under this Plan until that designation is<br />

changed or ceases to be effective because the Beneficiary predeceases<br />

the Member.<br />

If the Member does not name a Beneficiary or if the designation of<br />

Beneficiary is no longer effective, the person or persons (on a share and<br />

share alike basis) in the first of the following categories in which there is<br />

a survivor shall be the Beneficiary:<br />

(a) legal spouse or Domestic Partner of the Member;<br />

(b) child or children, including adopted child or children, of the Member<br />

(child or children of a deceased child shall take the share of such<br />

child by representation);<br />

(c) parent or parents of the Member;<br />

(d) effective January 1, 2004, sibling or siblings of the Member.<br />

If there is no such survivor, any lump sum death payment or the Capital<br />

Accumulation Payment shall be paid to the Member's estate.<br />

Any Beneficiary designation shall be deemed modified if necessary to<br />

comply with any order described in Section 12.07.<br />

Break in Service means the date on which any of the following occurs:<br />

(a) any separation from service;<br />

(b) any period on pay status but without Covered Compensation; or<br />

(c) any period off pay status for four or more consecutive months.<br />

A Break in Service is deemed not to have occurred if:<br />

(i) an Active Member returns to pay status from an approved leave of<br />

absence without pay;<br />

(ii) an Active Member is on a temporary layoff of less than four<br />

consecutive months;<br />
