(B) if the Member has completed less than one year of pretax<br />

payroll deductions to establish Service Credit, and the<br />

remaining Service Credit that can be established would<br />

cause the Member to satisfy the Plan’s vesting<br />

requirements, such Member may complete the remaining<br />

payments with a one-time, lump sum after-tax payment<br />

made within 60 days after the date the Member ceases to<br />

be an Active Member.<br />

The payment made under (A) or (B) may not cause the limitations of<br />

§415 to be exceeded.<br />

For purposes of this clause (iii), the determination as to whether a<br />

Member has been involuntarily separated from service for budgetary<br />

reasons shall be based on the Member’s payroll separation reason<br />

as set forth in the Plan Regulations.<br />

Service Credit established under this provision shall be used to<br />

determine eligibility for early retirement and Preretirement Survivor<br />

Income, but shall not be used to determine eligibility for Disability<br />

Income.<br />

A Member who elects a Lump Sum Cashout subject to Section 2.33<br />

and is reappointed as an Eligible Employee may not establish<br />

Service Credit for any period of employment which is prior to receipt<br />

of the Lump Sum Cashout.<br />

(e) Service Credit Reestablished.<br />

An Active Member who had previously been a Member of this Plan,<br />

and who has only Service Credit for periods when no Member<br />

Contributions were made to this Plan shall reestablish Service Credit<br />

for such periods upon subsequently becoming an Active Member of<br />

the Plan at no cost to the Member. An exception to the preceding<br />

sentence applies in order to reestablish Service Credit for such<br />

periods on or before November 1, 1990 and requires that such<br />

Member must submit a proper request in accordance with Plan<br />

Regulations.<br />

An Active Member who had previously been a Member of this Plan,<br />

and who had received a Refund of Accumulations, may reestablish<br />

Service Credit for the entire period of previous membership by<br />

making payment to the Plan of an amount equal to such Refund of<br />

Accumulations previously received plus interest on the amount.<br />
